MINUTES OF MEETING HELD TUESDAY, JANUARY 13, 2009
Mayor Johnson called the meeting to order at 6:30 p.m. and led those present in the
Pledge of Allegiance.
ROLL CALL
Mayor Johnson, Ald. Schaefer, Snead, Borgman, Pavelko, Werner, Schneider, Utilities
Supervisor Kloskowski, Mr. & Mrs. Alan Jacobus, (their daughter was also present) and
Deputy Clerk Blenski. Ald. Fiedler was excused.
STATEMENT OF PUBLIC NOTICE
Deputy Clerk Blenski stated that the meeting had been noticed in accordance with the
Open Meeting Law.
APPROVAL OF AGENDA
There were no issues with the agenda.
APPROVAL OF MINUTES
Ald. Borgman moved to approve minutes, of the November 25, 2008 meeting. Ald.
Snead seconded; motion carried.
NEW BUSINESS
2. Review of Jacobus Claim. (Scott Kloskowski) Mr. Alan Jacobus submitted a claim, to
the Utilities committee. The Utilities committee could not reach a consensus and is
asking for review by the Committee of the Whole. An estimate was prepared by the
Wayne Stever, Inc., licensed plumber in the amount of $4,800.00, along with a listing of
damages in the amount of $4,147.00 (attached). The plumbing alterations by Wayne
Stever, Inc. would prevent future sewer backups. Mr. Jacobus is claiming that the sewer
service provided by the City of Muskego is responsible for the sewer backups in his
home. The Mayor indicated that in the “usual rain amounts” the Jacobus family has no
problem with sewer backups, however when there was an extreme amount of rain in June
of 2008, (they have the deepest basement) therefore their residence is affected by
extreme amounts of rain. The basement at Mr. Jacobus residence is too low. After some
discussion with the council members and their willingness to assist Mr. Jacobus, it was
proposed that he sign a waiver. Mr. Jacobus is not willing to sign a waiver, if he receives
the amount requested for the damages. There was no agreement or decision made on
this issue.
1. Sexual Predator Ordinance. (Mayor) Mayor Johnson reviewed the changes that were
highlighted in red. (Attached CH 42) Mayor feels that by adding the Lakes to the loitering
portion (42.03(c)) of the ordinance, it actually weakens the ordinance. Attorney Molter
agrees with Mayor Johnson on this issue. Mayor suggested putting in a definition of
“shoreline”. Several Aldermen disagreed. Ald. Schneider suggested researching what
other lake communities have in their ordinance and discussing it at a future meeting. The
bottom-line is that the City wants to have a good law. The consensus was to research
this issue further.

Ald. Snead moved to adjourn at 7:14 p.m. Seconded by Ald. Schaefer, motion carried
unanimously.
