BOARD OF REVIEW Minutes 20100512 CITY OF MUSKEGO Audio on file for seven years 2010 BOARD OF REVIEW MINUTES OF MEETING HELD MAY 12, 2010 City Attorney Eric Larson called the Board of Review meeting to order at 5:00 p.m. The following Board of Review members were present: Lynda Guhr, Raymond Ingold, Henry Posbrig, Steven Roncke and Dawn Schiel. City Assessor Laura Mecha, Assessors Marty Kuehn and Stewart Hamel from Tyler Technologies, Attorney Eric Larson and Deputy Clerk Jill Blenski were also present. The Deputy Clerk stated that the meeting was noticed in accordance with the Open Meeting Law. She also stated that the Board of Review Notice was posted on April 14, 2010 and published on April 22, 2010. Henry Posbrig moved to nominate Lynda Guhr as Chairman. There were no other nominations. Lynda Guhr was elected Chairman. Lynda Guhr assumed the chair. Raymond Ingold moved to nominate Henry Posbrig as Vice Chairman. Steven Roncke seconded. There were no other nominations; motion carried. Henry Posbrig was elected Vice Chairman. The Deputy Clerk stated that the Department of Revenue was notified on May 6, 2010, that the requirement for training had been met by Henry Posbrig and Lynda Guhr. The Deputy Clerk presented the 2010 Assessment Roll with the Assessor’s Affidavit to the Board. City Assessor Laura Mecha noted the following for the 2010 assessment year:  Locally assessed value of all general taxable property is $2,683,962,700.  Growth is estimated at $19 million.  The level of assessment is 105%. Establish Procedures of Operation - the Board of Review decided to hear objections at the scheduled times and then deliberate the cases at the end. Board Member Dawn Schiel noted that she had to leave at 6:45 p.m. The Board determined that it would deliberate after hearing the first objection (Conrardy) since it was the only residential property. A Findings of Fact, Determinations and Decision form will be used for each case. The Deputy Clerk stated that each property owner had properly filed a Notice of Intent to File Objection and Objection Form for Real Property Assessment. No late objections were filed. Attorney Larson noted that all property owners who filed objections did receive the required 48-hour notice. Attorney Eric Larson reviewed the Board of Review process with the members. 2010 Board of Review Page 2 May 12, 2010 At this time, the Board went off the record to review the 2010 Assessment Roll. At approximately 5:30 p.m., the Board went back on the record. Chairman Guhr briefly outlined the procedure prior to each objection; she noted that the Clerk would swear in all individuals that would provide testimony. She also stated that under State law, the Board of Review is required to uphold the assessor’s valuation unless testimony is presented to show that the valuation is incorrect. The Board proceeded to hear the following objections: Philip Conrardy Tax Key #2179.043 W199 S6904 Crabapple Court Following the testimony presented for the Conrardy objection, Board Member Dawn Schiel left the meeting at approximately 6:45 p.m. The Board continued to hear the other objections and deliberated following hearing all the testimony. Tax Key #2225.987.002 S79 W18885 Janesville Road The Board deliberated all of the objections as follows: Philip Conrardy: Henry Posbrig moved to sustain the Assessor’s valuation and to adopt the Findings of Fact, Determinations and Decision. Raymond Ingold seconded; motion carried 4 in favor. Kohl’s Department Stores, Inc.: Steven Roncke moved to sustain the Assessor’s valuation and to adopt the Findings of Fact, Determinations and Decision. Henry Posbrig seconded; motion carried 4 in favor. Boulder Venture 28 LLC: Henry Posbrig moved to sustain the Assessor’s valuation and to adopt the Findings of Fact, Determinations and Decision. Steven Roncke seconded; motion carried 4 in favor. Walgreen Co. (Tax Key No. 2172.030.001): Henry Posbrig moved to sustain the Assessor’s valuation and to adopt the Findings of Fact, Determinations and Decision. Steven Roncke seconded; motion carried 4 in favor. Walgreen Co. (Tax Key No. 2225.987.002): Steven Roncke moved to sustain the Assessor’s valuation and to adopt the Findings of Fact, Determinations and Decision. Henry Posbrig seconded; motion carried 4 in favor. 2010 Board of Review Page 3 May 12, 2010 The Notice of Board of Review Determination forms for the above objections will be mailed by certified mail. Raymond Ingold moved that the City of Muskego Board of Review approve the 2010 Assessment Roll as presented by the City Assessor and having performed all of its statutory duties and completed all of its work, the Board of the Review adjourns sine die at 9:45 p.m., subject to the Clerk fulfilling the Clerk’s statutory duties.
