MINUTES OF MEETING HELD THURSDAY, MAY 29, 2008
Chairman Lynda Guhr called the meeting to order at 5:10 p.m. Also present were
Board Members Henry Posbrig, Dean Bartosh, Steven Roncke and Thomas Ralston,
Atty. Eric Larson representing the Board, Assessor Laura Mecha, Mark Link of Tyler
Technologies, and Deputy Clerk Jill Blenski. Ms. Blenski stated that the meeting was
noticed in accordance with the open meeting law.
The Board proceeded to review the assessment roll in accordance with its statutory
duties until its first appointment scheduled for 5:30 p.m.
The Board heard the following objections:
Tyler Nyborg, S72 W14842 Candlewood Lane, Tax Key #2202.080
David Davis, W200 S8609 Woods Road, Tax Key #2227.989.006
Mr. John Sidesky timely filed a Notice of Intent to File Objection with Board of Review.
However, the Objection Form was submitted on May 22, 2008, which was a day after
the initial of Board of Review meeting. Attorney Larson informed the Board that the
taxpayer had to provide evidence of extraordinary circumstances because the Objection
Form was not timely filed. Mr. Sidesky stated he was not informed that the form had to
be submitted by a specific date. Thomas Ralston moved that the taxpayer did not show
evidence of extraordinary circumstances and, therefore, would not be granted a
hearing. Dean Bartosh seconded. Motion carried 5 in favor.
The Board continued to hear the following objections:
Roger Frycienski, W186 S6834 Jewel Crest Drive, Tax Key #2174.033
Gene Hitz, W200 S10771 East Shore Drive, Tax Key #2287.010
The Board took a brief recess and then proceeded to hear the following objections:
David DeAngelis, W145 S9641 Groveway Lane, Tax Key #2261.983
Sandra Herda, W145 S9659 Groveway Lane, Tax Key #2261.982
Anthony Banaszynski, S104 W15370 Loomis Drive, Tax Key #2298.986
Kevin Kubacki, W203 S11072 Point Denoon Road, #2287.028
The Board deliberated all of the objections as follows:
Nyborg: Thomas Ralston moved to sustain the Assessor’s valuation and to adopt the
Findings of Fact, Determination and Decision. Henry Posbrig seconded; motion carried
5-0.
Davis: Henry Posbrig moved to sustain the Assessor’s valuation and to adopt the
Findings of Fact, Determination and Decision. Thomas Ralston seconded; motion
carried 5-0.

Frycienski: Dean Bartosh moved to sustain the Assessor’s valuation and to adopt the
Findings of Fact, Determination and Decision. Henry Posbrig seconded. Motion carried
3-2 with Henry Posbrig, Lynda Guhr and Dean Bartosh voting yes and Steven Roncke
and Thomas Ralston voting no.
Hitz: Thomas Ralston moved that the Assessor’s valuation is incorrect and to set the
assessment at Land: $318,400; Improvements: $12,000 for a total of $330,400 and to
adopt the Findings of Fact, Determination and Decision. Steven Roncke seconded.
Motion carried 3-2 with Steven Roncke, Henry Posbrig and Thomas Ralston voting yes
and Lynda Guhr and Dean Bartosh voting no.
DeAngelis: Steven Roncke moved that the Assessor’s valuation is incorrect and to set
the assessment at Land: $135,200; Improvements: $149,800 for a total of $285,000
and to adopt the Findings of Fact, Determination and Decision. Dean Bartosh
seconded; motion carried 5-0.
Herda: Dean Bartosh moved to accept the Assessor’s recommendation to set the
assessment at Land: $136,500; Improvements: $128,500 for a total of $265,000 and to
adopt the Findings of Fact, Determination and Decision. Henry Posbrig seconded;
motion carried 5-0.
Banaszynski: Thomas Ralston moved to sustain the Assessor’s valuation and to adopt
the Findings of Fact, Determination and Decision. Dean Bartosh seconded; motion
carried 5-0.
Kubacki: Steven Roncke moved to sustain the Assessor’s valuation and to adopt the
Findings of Fact, Determination and Decision. Thomas Ralston seconded; motion
carried 5-0.
The Notice of Board of Review Determination forms for the above objections will be
mailed by certified mail.
Steven Rockne moved to adjourn to Wednesday, June 3, 2008 at 5:00 p.m. Henry
Posbrig seconded; motion carried.
