pfcm19970116CITY OF MUSKEGO POLICE AND FIRE COMbfISSION MINUTES OF MEETING AND HEARING HELD JANUARY 16, 1997, as to the Filed by Chief John Johnson, Complainant, Against Officer In the Matter of Charges Dated the 18th day of November, 1996 George Mielke, Accused, and Served Upon Accused on the 19th day of November, 1996. The meeting and adjourned hearing were called to order at 7:02 P.M. by President Robert Kreuser. Also present were Commissioners Richard Horn, Michael Kuwitzky, William Martin, and Blenda Treba; Atty. John Macy representing the Commission; Chief John Johnson; and, Clerk-Treasurer Jean Marenda. Mr. Horn moved to convene into Closed Session pursuant to 19.85(l)(a) Wis. Stats., Deliberating concerning a case which was the subject of any judicial or quasi-judicial trial or hearing before that governmental body, more specifically concerning The Matter Of Charges dated the 18th day of November, 1996, Filed by Chief John Johnson, Complainant, Against Officer George Mielke, Accused, and Served Upon Accused on the 19th day of November, 1996 and pursuant to 19.85(l)(g), Wis. Stats., To confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation specifically concerning the charges which are the subject in which it is or is likely to become involved, more matter of this hearing. Mr. Martin seconded. Upon a roll Call vote the motion carried 5-0. The Commission reconvened into Open Session. NEW BUSINESS Determination as to the charges referred to above. Atty. Macy Determinations and Orders of the City of Muskego Police and read the Determination and Order included in the Findings, Fire Commission attached to Resolution #1-97. The Orders state been proved and are sustained by the Board; and that the Board in part that the charges set forth against George Mielke have hereby orders dismissal and removal from the Department. Mr. Martin moved to adopt Reso. #1-97 and the attached findings. Mr. Kuwitzky seconded. Atty. Macy recommended the Police Department serve the resolution and attachments on Officer Mielke with an Affidavit of Service. Atty. Macy adopt Reso. #1-97 and the attached Findings, Determinations and reviewed other procedural matters. Upon a roll call vote to Orders, the motion carried 5-0. Duplicate originals of Reso. #1-97 and the attached Findings, Determinations and Orders were filed with the Muskego Police and Fire Commission official secretary, Richard Horn, and with recording secretary, Clerk-Treasurer Jean Marenda. Mr. Kreuser stated that based on the evidence presented, the Commission determined Officer Mielke should be fired. Police and Fire Commission Meeting January 16, 1997 Page 2 April 17, 1997.
