pfcm19960718@ POLICE AND FIRE COMMISSION CITY OF MUSKEGO MINUTES OF MEETING AND ADJOURNED HEARING HELD JULY 18, 1996 AS TO THE IN THE MATTER OF CHARGES DATED THE 5TH DAY OF JUNE, GEORGE MIELKE, ACCUSED, AND SERVED UPON ACCUSED ON THE 5TH DAY 1996, FILED BY CHIEF JOHN JOHNSON, COMPLAINANT, AGAINST OFFICER OF JUNE, 1996 The meeting and hearing were called to order at 7:OO P.M. by President Kreuser. Present were Commissioners Robert Kreuser, William Martin, Richard Horn, Michael Kuwitzky and Blenda Treba. Also present were Chief John Johnson, Atty. Don Molter, Clerk-Treas. Jean Marenda and Court Reporter Gayle Pruefert. Clerk-Treas. Marenda reported the meeting was noticed in accordance with the Open Meeting Law on June 24, 1996. Clerk-Treas. Marenda read the Notice of Meeting and Adjourned Hearing of the City of Muskego Police and Fire Commission. Atty. Stadler called his first witness, Officer George E. Mielke, who was'sworn in by the court reporter. Exhibits 21-39 consisting of Performance Standards Evaluations were presented by Atty. Stadler. Atty. Stadler also presented miscellaneous documents in Exhibits 40-49. Atty. Stadler moved Exhibits ordered Exhibits 21-49 entered. Testimony was presented by 21-49. No objection from Atty. Mackenzie. Chairman Kreuser Officer Mielke under direct examination by Atty. Stadler and cross examination by Atty. Mackenzie. Closing arguments were presented by Atty. Mackenzie and Atty. Stadler . At this time Chairman Kreuser declared the evidentiary portion of the hearing closed, noting the Commission would now go into the deliberation portion of the hearing. Atty. Mackenzie and Atty. Stadler stipulated the three-day rule for written report. It was stated no decision will be declared tonight in order to allow the Commissioners to review the written report prepared by Atty. Molter after deliberations. Mr. Horn moved to convene in Closed Session pursuant to §19.85(l)(a), Deliberating concerning a case which was the before that governmental body, more specifically concerning the subject of any judicial or quasi-judicial trial or hearing Matter Of Charges Dated the 5th day of June, 1996, Filed by Chief John Johnson, Complainant, Against Officer George Mielke, Accused, and Served Upon Accused on the 5th day of June, 1996 and pursuant to $19.85(1)(g), To confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with 0 0 0 Police and Fire Commission Page 2 Minutes of Meeting and Adjourned Hearing July 18, 1996 respect to litigation in which it is or is likely to become involved, more specifically concerning the charges which are the subject matter of this hearing. Mr. Martin seconded, motion carried by a roll call vote of 5-0. At 11:OS P.M. the Commission adjourned and agreed to reconvene at 7:OO P.M. on Thursday, August 1, 1996.
