MINUTES OF MEETING AND ADJOURNED HEARING HELD ;NLY 17, 1996
AS TO THE IN THE MATTER OF CHARGES DATED THE 5TH DAY OF JUNE,
GEORGE MIELKE, ACCUSED, AND SERVED UPON ACCUSED ON THE 5TH DAY
1996, FILED BY CHIEF JOHN JOHNSON, COMPLAINANT, AGAINST OFFICER
OF JUNE, 1996
The meeting and hearing were called to order at 7:Ol P.M. by
President Kreuser.
Present were Commissioners Robert Kreuser, William Martin,
Richard Horn, Michael Kuwitzky and Blenda Treba. Also present
were Chief John Johnson, Lt. John Daley, Atty. Don Molter,
Clerk-Treas. Jean Marenda and Court Reporter Gayle Pruefert.
Clerk-Treas. Marenda reported the meeting was noticed in
accordance with the Open Meeting Law on June 24, 1996.
Clerk-Treas. Marenda read the Notice of Meeting and Adjourned
Hearing of the City of Muskego Police and Fire Commission.
Atty. Don Molter was introduced as attorney for the City of
Muskego Police and Fire Commission and presented the outline of
the procedures which would be followed. Each commissioner was
introduced.
Atty. Molter advised a stipulation had been reached on a Motion
to Quash Subpoena Served on Chief John Johnson. Atty. Ron
Stadler representing Officer Mielke and Atty. Tom Mackenzie
representing Chief Johnson agreed the Commission does not need
to act on the motion.
Atty. Stadler moved any witnesses that will give witness be

sequester because the statutes specifically say this hearing is
open to the public. The Commission could ask the witnesses to
volunteer to leave the room. Atty. Mackenzie said that to
eliminate this issue we are in agreement everybody other than
the Chief will be sequestered voluntarily.
No other motions were presented.
Mielke dated June 5, 1996 by Chief John Johnson.
Clerk-Treasurer Marenda read the Charges Against Officer George
Opening statements were presented by Atty. Mackenzie
representing Chief Johnson and Atty. Stadler representing
Officer Mielke.
At this time all people intended to be called as witnesses left
the room.

Chief Johnson was sworn in by the court reporter as first
witness. Direct examination by Atty. Mackenzie. Exhibits
marked 1-16 and 18 were presented by Atty. Mackenzie. Atty.
Stadler objected to Exh. 16. Chairman Kreuser ordered Exhibits
Atty. Mackenzie.
1-15 and 18 admitted as evidence. Exhibit 16 was withdrawn by
Chief Johnson was cross examined by Atty. Stadler. Exhibit 19
was presented and moved. Chairman ordered Exhibit 19 accepted.
Next witness Ann Wissing was sworn in by the court reporter.
Direct examination by Atty. Mackenzie. Exhibit 17 was
presented by Atty. Mackenzie and moved into the record.
Chairman Kreuser accepted. Cross examination by Atty.
Stadler. Exhibit 20 presented, with no motion to enter into
record.
Next witness Matt Johnson was sworn in by the court reporter.
Atty. Stadler.
Direct examination by Atty. Mackenzie and cross examination by
Mr. Kuwitzky moved to adjourn at 11:05 P.M. and reconvene at
7:OO P.M. on Thursday, July 18, 1996 at the Educational Service
Center. Mr. Martin seconded, carried.
