Backpround Ralph Houseman. village attorney, Grafan, vroce on December 19, 1989 to suggest legislation to allov villages to contract for fire protection services. Under sec. 61.65, Seats, villages vith a population of 5,500 OK more must provide fire protection by creating their ovn department, Contracting for fire senices vith a city, village or tovn. or creating a joint fire deparcmnt vith a city, village or tovn. The statute also recognizes that senices under sec. 61.66. the requirement may be met by existing deparaents with combined protective Mr. Houseman pointed out that many villages provide for fire protection by contracting with volunteer fire departments. but the statutes do not recognize this method of providing for fire proteccion. Hr. Houseman also pointed out volunteer fire department, He recommended drafting legislation to allow that under sec. 62.13(8) cities are allowed to provide for a paid or villages to concrxct for volunteer fire protection. Discussion municipal departnents or companies organized under ch. 213, Scats. This Firs:, a point of clarification: volunteer fire departments may be either archaic chapter provides for non-municipal fire companies, but allovs municipalities to disband such companies located vithin their borders. Sec. 213.011. Since sec. 62.09(1)(a) lists the fire chie€ as a city officer, it appears that all cities must provide for fire protection and may do so by a paid or volunteer city department (or a joint department vith another local unit). .Although a ch. 213 fire deparunent might complement an existing city fire .. ). -2- department, it appears that the statutes contemplate the existence of a city fire department (or joint deparment), whether it be paid or vobmteer. 1 do deparment, but merely rely on a local ch. 213 deparment. In contrast to cities, only villages of 5,500 or more must provide for fire protection. and they are not required to establish their own departments or joint departments, but may contracr for the protection vith anocher local unit. not know whether there are any small cities which do not have a city fire The recently revised tom law chapter requires a11 towns to provide for fire by "Conrracring with any person" OK "Utilizing a fire company organized under protection. They may do so by establishing their own or joint departments, or ch. 213." Sec. 60.55(1). Recomendation I; seems a good idea to authorize the established practice of having villages of 5,500 or more meet the requirement of providing for fire protection by means of an agreement with a ch. 213 fire company. Probably the best way to do this is to use the language from the analogous statute covering towns and authorize contracting with any person OK utilizing a ch. 213 fire company. The committae should also decide whether the sratutorj requirement of providing for fire protection should be extended to villages with populations under 5,500. The committee may also wish to discuss whether the law should be changed so that small tiries would not have to have their own (or joint) fire of a ch. 213 fire company. If this course is followe'd, the authorization departnents, but would be authorized to provide protection by contract or use could be made applicable to cities under 4.000, since cities over that size are required to have police and fire commissions. 0 JHS : 5373
