pfcm19821021a POLICE AND FIRE COMMISSION OF THE CITY OF MUSKEG0 October 21, 1982 The regular meeting of the Police and Fire Commission of the City of Muskego was held on Thursday, October 21, 1982, in the conference room of the Muskego Police Department. President Horn called the meeting to order at 8:05PM. Present were President Horn, Secretary Swarthout, Mr. Bohrer, Mr. Kreuser. Mr. Young and Chief Scholz. Two citizens, Myron and Allen Hodgson, who were in attendance, were introduced. The minutes of the July 15, 1982 meeting were read. Mr. Kreuser ques- tioned the cost of the new comnication system. Chief Scholz stated that the cost of $116,000 would be obtained from T.I.F. District W7 financing. Mr. Bohrer moved that the minutes be approved as read. Seconded by Marsha Swarthout. Motion carried unanimously. OLD BUSINESS: 0 1. 2. 3. Chief Scholz reported: Officer Steven Kukowski was the recipient of commendations in the form of a City Resolution and an award from the V.F.V. for his lifesaving efforts on June 23, 1982. The police department's share of the City's financial deficit is $26,400. To cover this deficit the last pay period for 1982 has been moved into 1983 and the Policeman's Association has agreed to waive paid overtime for the remainder of 1982. The City has passed resolutions permitting the erection of a 199 foot tower for RVS Cable TV on police department land enabling the police department to utilize same for its antennas. Muskego &e and Fire Commission 4. The police department is still awaitlng the new radio console. CITIZENS' COMPLAINT: The agenda was put aside so that the Hodgson brothers could speak as they had a complaint on how the police handled a fireworks complaint. Myron Hodgson stated that a neighbor was shooting off fireworks that were landing on his property and the roof of the town house he owns. This was witnessed by his brother and the tenant. Mr. Hodgson reports that the police were summoned and he signed a complaint. Now Sgt. Wolfgram. who re- sponded to the call, says there was no complaint signed and, therefore, the subjects that allegedly were setting off the fireworks will not be prosecuted. Sgt. Wolfgram did confiscate fireworks from the home of these subjects. Chief Scholz stated that police officers do have discretion regarding arresting people, confiscating illegal items, issuing citations and/or send- ing a complaint to the District Attorney's office for prosecution. 0 Because Sgt. Wolfgram or the facts for his side, were not present at this meeting, it was decided to forward this information to the City Attorney to ascertain if he would prosecute on it. An appointment will be set ~p prior to Municipal Court at City Hall on October 25, 1982 at.6:50PM for the Hodgsons to meet with City Attorney Gross. PROCEDURE FOR COMPLAINTS: After the Hodgsons left, the procedure for hearing citizens' complaints was discussed with the following criteria established: 1. Citizens must present complaints in writing within a time period so it can be placed on the agenda for the next meeting of the Commission. 2. If citizens appear at a Commission meeting with a complaint and are not 0 on the agenda, they will be requested to follow step 1 and be put on the agenda for the next meeting. It was decided that if the Common Council approves the hiring Of a cadet, the Wisconsin City and County Testing Service be contacted to handle the testing. The position should be advertised with a 9 or 10 day return. and then a special meeting of the Commission be called when the number of candidates, the approximate cost of testing and.a tentative examination date are known. An Alderman suggested that the Commissioners extend their support of the 1983 police budget tc the Common Council especially regarding the pur- chase of squad cars. Marsha Swarthout moved that a letter be written to the Common Council in support of the 1983 police budget. Seconded by Randy Young. A discus- sion was held with the suggestion being made that the Commissioners contact the Aldermen individually rather than as a committee. A vote was taken with Commissioners Swarthout and Young voting aye and Commissioners Horn. Bohrer and Kreuser voting no. Motion was defeated. There was no correspondence. The next meeting was scheduled for Thursday, January 20. 1983. The agenda should be posted at City Hall and the police department and Sent to the new8 media. Mr. Kreuser moved that the meeting be adjourned. Seconded by Mr. Young. Motion carried unanimously. The meeting adjourned at 10:07PM. Respectfully submitted, Secretary
