CALL TO ORDER
Meeting was called to order at 6:00PM by Commissioner Mooney.
PLEDGE OF ALLEGIANCE
ROLL CALL
Commissioners Mooney, Whittow, Kuspa and Boyer were present. Commissioner Jaske was
excused. Chief Westphal, City Attorney Warchol and City Intern Robert Maniak were also
present.
STATEMENT OF PUBLIC NOTICE
APPROVAL OF MINUTES
Commissioner Kuspa made a motion to approve the minutes from January 21, 2021; February
1, 2021; February 2, 2021; February 21, 2021 and February 24, 2021. Commission Whittow
seconded. Motion passed all in favor.
PUBLIC APPEARANCE
REPORT FROM POLICE DEPARTMENT
Chief Westphal advised that he was unofficially sworn in on April 16, 2021, and will be officially sworn in
on May 6, 2021, at the PD’s annual awards ceremony. Chief Westphal advised he held a department
wide meeting on April 19th. Other department heads, Alderman/Mayor/PFC and school officials were in
attendance. He believed it went well, he advised he discussed his vision for the department and where
he would like to see it go. Chief Westphal advised that SRO’s gave their annual report to the school
board that same day and reaffirmed our commitment and collaboration to the school and how mutually
beneficial our relationship is with the schools.
Detective Natalie Johnston was recognized on April 20th by Waukesha County DA/Victim Witness
program for Investigator of the Year. Her work was recognized not only in the county, but she also
received an honorable mention in the state for her work with victims of crimes. Congratulations Detective
Johnston.
On April 21, 2021, Chief Westphal hosted District Attorney Sue Opper and Jackie Kort, Dona May
Bayerl’s daughter, for the Wisconsin Association of Homicide Investigators Conference. The three
presented a 3-prong victim/detective/prosecutor presentation via zoom. The 40-year-old cold case was
presented with the hopes of giving hope to other victims and inspiring investigators to pursue cold cases.
Chief Westphal advised he attended a Chamber meet and greet, sharing his vision with the chamber and
business representatives that were present.
Chief invited everyone to attend the Muskego PD Annual Award’s ceremony which will be held on
05/06/21, at 6PM.

Monday there will be a meeting reference the fireworks at Idle Idle, scheduled for July 3rd.
Representatives from the police department will be meeting with organizers to plan a safe family friendly
event.
Hillendale Road project is in full swing. The department has been working with school representatives to
create a logistical traffic pattern for safe pickup/drop off for students at Mill Valley. As of now, they are
hoping all traffic will exit onto Racine Avenue. In the event things need to be tweaked, they will
collaborate with school/city to make it work.
The Greater Milwaukee Water Alliance project will be impacting Muskego. They will be working on
Moorland Road to North Cape. Officers are continuing to monitor the construction and determined to
make things safe for citizens and workers.
National Night Out is scheduled for August 4, 2021.
Congratulations to Michaela Shiroda who will be graduating the WCTC’s academy on 05/06/21. Our two
newest officers, Marcus Klink and Daniel Reed will join Shiroda on 05/10/21, all starting the FTO program
that day.
NEW BUSINESS
Presentation by City Attorney and Legal Intern Regarding Open Meetings Laws - Robert Maniak
presented a power point on Wisconsin Open Meetings Laws. City Attorney Warchol advised
Maniak will be done with the intern program after today, he has done a great job! A new intern
will be starting in May.
Police Officer Hiring Process – Chief Westphal presented the commission with the hiring process for
police officer. He explained that in the past the department looks to the PFC to interview and determine
good moral character. The PFC interviews are pass/fail, and those who are recommended to move on
will have an interview with a PD board to determine the best “officer material” candidate. Commission
Kuspa requested research be done on what other departments do. He noted that the great length of time
between the PFC interview and PD interview lost good candidates and he does not want to see that
continue to happen. Chief Westphal advised we would check on how other departments do it, however, if
we put out a timeline in the beginning of the process that may help alleviate the length of time between
interviews.

Commissioner Kuspa made a motion to go into closed session, Commissioner Whittow seconded.
Motion passed all in favor. Meeting went into closed session at 7:28PM.

Chief Westphal appeared in front of the committee requesting they look at some changes he
would like to make to General Order #312 – Recruitment and Selection. Chief Westphal is
requesting the following changes.
C. Steps of the Selection Process in Order
1. Applicants will generally follow the selection process set forth below; however,
the chief of police shall have the authority to permit an applicant or applicants to
undergo an expedited selection process and forego the written test and oral
interview if, in the chief’s sole discretion, the applicant or applicants has relevant
prior experience or qualifications such that the chief believes those steps to be
unnecessary. Under this expedited hiring process, the chief of police may
consider an applicant or applicants who are not on the eligibility list forwarde d
and approved by the police and fire commission; however, the chief of police will
timely notify the police and fire commission that such applicant(s) is under
consideration.
The Physical Agility Test will now be #2. Written Test will now be #3. Oral I nterview will be #4.
The remainder of the General Order will stay the same. Staff Interview will be #5. Background
Investigation will be #6. Drug Screening will be #7. Personal Interview will be #8. Psychological
Examination will be #9. Medical Examination will be #10.

process, whether the standard or expedited selection process, shall be selected by the
chief of police to fill the available vacancies. The police and fire commission will be
notified of such selections, and upon approval by the police and fire commission, the
newly hired officer will begin a one-year probationary period. The probationary period
may be extended pursuant to the labor contract. Throughout the probationary period,
including any extended probationary period, officers may have their employment
terminated by the chief of police without any action by the police and fire commission.
The below language in red will be added to Section D – Selection, Approval and Probation

secured by the Muskego Police Department until such time that they are either
removed from the eligibility list, or are hired by the police department. The files of
police applicants removed from the eligibility list shall be maintained and secured by
the Muskego Police Department. Applicants who have been considered by the chief of
police under the expedited hiring process but who were eliminated from the process
shall have their files maintained and secured by the Muskego Police Department in
accordance with the record retention requirements under Chapter 5 of the Muskego
Municipal Code. The files of applicants who are hired as police officers shall become
part of the officer’s personnel file
After a brief discussion and a few questions by commissioners, Commissioner Kuspa made a
motion to approve the changes as submitted. Commissioner Boyer seconded. Motion passed
all in favor.

Commissioner Whittow made a motion to adjourn, Commissioner Kuspa seconded. Motion
passed all in favor.
