MINUTES OF January 1, 1992 Meeting
PLAN COMMISSION
Mayor Salentine called the meeting to order at 7:OO p.m.
PRESENT: Chairman Wayne G. Salentine, Edward Raimann, Darl Honl,
Director of Planning.
Jerald Hulbert, Ald. Dave Sanders, Tracie Smith, Lawrence Kirch,
Mr. Bob Biebel, Chief Planner with SEWRPC attended to discuss
Resolution #P.C. 2-92 (Denoon Point Estates)
ABSENT: Jack Schmidt.
MINUTES: Mr. Honl made a motion to approve the Minutes of the
December 17, 1991 meeting and Mr. Raimann seconded. Upon a voice
vote the motion to adopt the minutes passed unanimously.
OLD BUSINESS:
commissioners move on to the next resolution to give the
representatives of Terra Development more time.
Resolution #P.C. 221-91--Chairman Salentine suggested the
Peterson in the NW 1/4 of Section 11. Chairman Salentine said

this Resolution is on the floor for discussion and requested Mr.
Kirch bring the commission up to date on the situation. Mr. Kirch
told the commissioners Mr. h Mrs. Peterson had stopped in the
office and requested a deferral to the next meeting to enable them
to contact the neighbors of the property adjoining this land.
Ald. Dave Sanders made a motion to defer and Mr. Hulbert
seconded. Upon a voice vote the motion to defer passed
unanimously.

Resolution #P.C. 230-91--Approval to construct a pond for
Salentine said this resolution is on the floor for discussion with
based on a meeting at the pond site. A revised site plan is
a previous resolution. Mr. Kirch said he amended the resolution
needed. Mr. Honl made a motion to defer this resolution for two
weeks and Mrs. Smith seconded.
Upon a voice vote the motion to defer passed unanimously.

locate a sign shop business for Wayne Hollenstein. Mr. Raimann
requested discussion. Mr. Kirch explained the reason the
resolution was written for "Disapproval". The city has 00s
overlay zoning to allow this use. Mr. Hollenstein would need site
plan approval also. A Common Council Public Hearing is already
scheduled with this rezoning request for B-1 zoning on January

Resolution #P.C. 2-9a--Approval to rezone NW 1/4 of Section
31 from RS-2 to RS-2/0PD for Denoon Point Estates-Kaerek Builders,
Bob Biebel, Chief Planner with SEWRPC (Southeastern Wisconsin
Inc. Mr. Hulbert moved for adoption and Mr. Honl seconded. Mr.

be controlled. The primary problem is sediment. The water depth

Ald. Dave Sanders asked if it would be designed to hold water.
Mr. Biebel said it would. There would be a spill flow outlet. A
citizen asked if there has been any involvement with the source of
the run-off, and if those problems on private land could be
addressed? Mr. Biebel said the agricultural problems and

standards, but they haven't degraded the wetlands and the

wetlands? Mr. Biebel said they are high quality wetlands, and it
would be unlikely that the DNR would issue a permit, but the

discussion about the type of run-off (street vs. agricultural).
Mr. Biebel summarized his comments by saying they should monitor
the silt, watch for flooding, keep the banks clean and possibly
install fencing.
Mr. Ray Christiansen, President of the Lake Denoon Association
spoke on behalf of the Association. He talked about the history
of the lake area and the Lake Meadows Subdivision and why the
existing ponds were developed. Lake Denoon is owned by the State
of Wisconsin and grant funds are being used to improve the area.
Mr. Eric Fitzgerald, President of the Lake Meadows Lake
Association presented a petition with over 200 signatures opposing
the development of the pond. He stated that it would have a
negative impact on the park. The pond would have a foul smell and
if non-aerated be like a sewerage pond. The farmland is the
problem.
Another citizen said this is a natural resource and we shouldn't
just watch it deteriorate.
Ms. Jean Baumgartner, who lives near the proposed pond opposes the
pond in her back yard and feels we should look at the source.
Mr. Kevin Sievert said the Lake Meadows residents were told when
hasn't heard anyone suggest that the person creating the pollution
they bought their lots that the park would stay that way. He
try to solve the very objectionable problem. From May-September
the scum and smells from the other ponds are offensive.
Ms. Cheryl Mantes, a nearby resident with four children, feels it
is wrong to build a pond there.
Mr. Robert L. Bannert of E. Shore Drive feels we should all be
concerned with the water quality of Lake Denoon and he agrees with
Mr. Biebel of SEWRPC.
Mr. Ron Keinart said he has a 42 acre farm with 15 acres being
marsh, which he maintains at his own cost. He has noticed that
Lake Denoon has lots of silt on the entire west end of the lake
from the northwest end of the lake.
Mr. Harold De Back commented that people with children living near
lakes must watch their children and this is no different. The
property values of both subdivisions will go down if the lake
isn't cleaned.
Mr. Morry Dawes, a resident of Lake Denoon, said we must look at
the whole scheme and take this opportunity to clean the lake.
Mr. Kevin Sievert offered the suggestion that a zoning change
could be done if they purchased property north of Kelsey for this
pond and have a berm near a silt pond on a farm field. We should
look at other options; he isn't satisfied asking for deferral.
This isn't their responsibility.

Mr. Bob Biebel of SEWRPC said there will be other types of plant
growth there, too. They should get a pond designer to consider
the safety, size and vegetation and have an informal meeting to
discuss details.
Upon a roll call vote the motion to adopt passed unanimously.
Resolution #P.C. 3-92--Reauthorization of Approval of
certified survey map approved 9/19/89 in Resolution #P.C. 179-89
for Michael Fischer (Ace Glass) in the SE 1/4 of Section 2. Mr.
Honl moved for adoption and Mr. Hulbert seconded.
Mr. Honl asked if there were any changes? Mr. Fischer said no.
Upon a roll call vote the motion to adopt passed unanimously.
(Ald. Sanders was absent for the vote) Upon a roll call vote the
motion to adopt passed unanimously.
Chairman Salentine asked if everyone was in agreement to take a
break? The Plan Commission took a break at 1O:lO p.m. and
reconvened at 10:20 p.m.

SW 1/4 of Section 5. Mr. Hulbert moved for adoption and Mr.
Raimann seconded. After some discussion Mr. Hulbert made a motion
to amend the resolution to read: "Be It Further Resolved, That the
condition place in P.C. Resolution 196-91 relating to the rights
of first refusal for access for the proposed winter activities
area be removed." Mr. Raimann seconded. Upon a voice vote the
motion to amend passed unanimously. Upon a roll call vote the
motion to adopt the amended resolution passed unanimously.
Resolution #P.C. 4-92--Approval to remove parkland
permission for parkina of semi tractor with trailer for John
Resolution #P.C. 5-92--Approval of review and renewal of
Krabbenhoft, S83 W206i8 Janesville Road. Mr. Hulbert moved for
adoption and Ald. Sanders seconded. There was some discussion
about the removal of a second semi-tractor to be removed. Upon a
roll call vote the motion to adopt passed unanimously.
Francesco Aiuppa in the NE 1/4 of Section 18. Mr. Raimann moved
for adoption and Mrs. Smith seconded. Mr. Kirch talked about
Ruekert & Mielke's report requesting a 60' road dedication on
Pasadena. Mr. Aiuppa agreed to this change. The evidence of a
bond, as requested in a previous resolution was given to the Plan
Commission. The house will be moved in 8 days, as the basement is
almost done. Upon a roll call vote the motion to adopt passed
unanimously.
Resolution #P.C. 6-92--Approval of certified survey map for
Robert Klenz in the NE 1/4 of Section 15. Mr. Honl moved for
Resolution #P.C. 7-92--Approval of certified survey map for
adoption and Ald. Sanders seconded. Mr. Honl commented on the
flag shaped lot. Mr. Kirch told the commissioners Ruekert &

Mielke's report had 11 technical changes. In the last "Whereas"
it mentions an easement. Parcel 3 needs an easement from Parcel
2. Upon a roll call vote the motion to adopt passed unanimously.
Miscellaneous Business:
Larry Kirch brought up several points:
1- He would like to change the Tuesday deadline to the previous
Friday for certified survey maps and subdivision sketches in order
to get responses back earlier from Ruekert h Mielke.
2- He is also having the department heads review subdivision
meeting in order to make the department heads aware of the project
sketches and preliminary plats prior to the Plan Commission
and its effects on their operations.
3- A commissioner asked that someone from the department check Mr.
Kempen's property on Tess Corners Road.
ADJOURNMENT:
Mr. Raimann moved to adjourn at 11:OO p.m. and Ald. Sanders
seconded. Upon a voice vote the motion to adjourn passed
unanimously.
