PCM19850824~ PLAN COMMISSION CITY OF MUSKEG0 MINUTES OF PLAN COMMISSION MEETING HELD ON August 24, 1985 Mayor Wayne Salentine called the meeting to order at 9 14 A.M. to disuss the Engineering Report from Ruekert and Mielke for the Proposed Future Parkland Development Foundry Waste Disposal Site. I Arrowood. Alderman Richard Nilsson, Secretary Les Constantineau, PRESENT^ Chairman Wayne Salentine. Edward Raimann. Richard Dr. Peter Parthum, Jack Schmidt, and Zoning Officer Gerald Lee. Also present were Mr. Tom Rutkowski, Mr. Michael Mooney. Mr. Arthur Vogel and Mr. Curt Malozzi representing Future Parkland Development. Ruekert and Mielke's revised report, with changes by Future Mr. Rutkowski presented a report paralleling the 25 points in Parkland Development. The Recording Secretary read each point of the Ruekert and Mielke Future Parkland and the Commission. report with discussion following. The points note the changes by Point #1 remove " permit . . . .I' . Approved ... and approval of the conditional use The conditional use permit will occur before the plan of operation will be completed. The feasiabilty report is determined by the DNR; 90 days for review, 120 for the plan of operation, 90 days for review of the plan of operation. Two hearings and the other from the City. Approved This statement repeats that dust treatment will be provided on the gravel road going to the site. The language change is to reflect the previous understanding. Zoning Plan Commission August 24, 1985 Officer Lee stated this is restoration bond, not a performance bond. The restoration bond should be increased to meet the rate of inflation. Other bonds might be necessary for the asphalting. Council decide these dollar amounts. Mr. Malozzi explained that tree planting, and landscaping, etc. and would recommend the a closure bond and financial responsiblity for long term be coordinated with the State. The bond mentioned by the engineer's report is to cover the sedimentation pond during operation, and is more of a performance bond. Mr. Malozzi explained that when phase 2 is closed there will be 2 feet of clay and 6" of topsoil covering the waste, running to the west on clean soil. In the open active area will be sloped so that any rainfall will go into the leachate area. Dr. Parthum agreement, to insure against any ground water contamination. suggested bonding around ten million dollars in a hold harmless Point 116 add 'I.. .excluding the sedimentation basin.. ." Approved Mr. Malozzi pointed out that the sedimentation basin is not part of the waterway. but the sediment removal is part of the plan. The purpose of the pond is to collect sediment. It was agreed the statment should be more clear as no waste, only sediments will go into the pond. 0 add "Sediment shall be removed from the sedimentation basin as needed to eliminate the discharge of sediment to the waterway." Approved There would be a swale to collect that water to keep the water from spreading out, and the DNR in an on-site inspection, would not allow an operation to begin unless it performs as shown in of the berm there will be a drainage ditch to catch water which the plans. The maximum height of the site is 796. At the bottom will be at a lower elevation, and the 788 elevation will drop to 780 and there will be a cut below that to continue the flow to the sedimation basin, any low spots will be built up so the water will never collect any waste. During the operation, water will be collected after a rainfall and pumped out having less water waterway will be maintained to the property line. leaving the site. The waterway comes from the basin, and the Mayor Salentine suggested discussion regarding the volume of water. Mr. Malozzi said water would flow to the northwest, there will be a barrier so it doesn't go into the site, and there will be two culverts, one on each side, and would exit at the same point it does now. Mr. Constantineau pointed out that residents may be confusing the velocity of water with the volume. The final plans are screened so they are faded out on the as-builts, and the as-built lines and elevation are Laid on, ending with a restatement of the final plan of constuction. Point #13 Approved as read Leachate flow distance means if rain falls inside the leachate distance. A greater flow distance takes longer for the liquids line the maximum travel distance is 100 feet horizontal to get to the lines to be removed. A new regulation called NR140 requires adding of wells to define a contaminate management zone to 150 feet from the boundry, and there will be additional wells further out. Mr. Malozzi proposed to sample the wells of Future Parkland to test the wells before the site begins water is a concern of property owners on Highway 36. Dr. Parthum said the City should have this immediate control. Mr. Schmidt suggested this may be difficult to monitor, and it may be out of the City's jurisdiction. The legal description is for the entire property. Any changes or additions of use would be determined by the Plan Commission, including any buildings. the other in the bedrock, most of the wells in the area of the Mayor Salentine would like the Attorney to make sure this landfill would never turn into a garage landfill.
