ASPHALTING REQUIREMENTS - Mr. Arrowood noted that at the time
Jovanovich applied a surface to his parking area it was accepted
by the Plan Commission as a hard surface. He added that if there
is a question, maybe the definition of hard surface should be changed. Dr. Mangiamele said the Commission should look at the
requirement of paved parking areas, and is it to be enforced in
new and existing areas. Mr. Lee noted that the Plan Commission
recently required Zangerle's to only asphalt the drives and not the parking area. Dr. Mangiamele pointed out that the difference
between bituminous concrete and concrete is the first is made
with asphalt and the other with cement. Mr. Lee stated he has always interpreted the ordinance as hard surface being bituminous
asphaltic concrete or portland cement concrete.

RE: Petition for Conditional Use Grant -
Vern Eder.
Dear Mayor and Plan Commissioners:
Ordinarily a mltiple family residence,2 or more units, walkups and without
private entrance would require RSM zoning. Six units "requgre..: 30,000
sq. ft. (approx. 3/4 ac.), a 40-ft. set-back, 2-20-ft. sideyards or offsets,
and 4,000 sq. ft. of open space. These minimm requirements need to be
considered whether or not located in a RSM or Business district. The pro-
posed site meets none of these requirements. Under conditional use, the
plan commission can waive any or all of these standards. Ordinarily, 12
parking spaces would be required on the site for 6 dwelling units. 0
Although plan commission considers individual situations, conditional uses
must take into account the overall situation and the impact of specific uses
on adjacent and nearby properties. The general area on Pioneer Drive from

in the context of Specific Area Planning. Even in anticipation of a specific
plan for this area, the city planner would be faced with a number of functional
problems: . , the set-back for a residential setting is not adequate, the
common drive being used both by this residence and the food processing indust-
provision of 12 parking spaces leaves no open space or room for play area, the
and pedestrians.
ry to the South (Horn Bros.) creates hazardous traffic conditions for children
The granting of conditional use would have to be based on a specific resolution
of each of these problems. None of the set-back or off-set.deficiencies can be
corrected. The on-site parking requirements can be reduced to six, with the
additional requirement that the other six spaces be provided for elsewhere on an
off-street site nearby. In this way space can be ma'de for an organized play
area which would probably have to be fenced-in to prgvent children from running
on driveway to separate the truck traffic from the residential traffic. The

residential qualities, especially as it is located so near to the street. This
appearance of the building is quite commercial in character and presents no

The nearby 'industrial and commercial uses seem to point more to enterprising
activities than to residential facilities. Under these circumstances, it is

ions made here could be followed in an imaginative manner. A Developmental
Area Plan could provide for an extended front yard area which would require
the narrowing of the street, at least at this point, as part of an overall
plan. The small building to the North, under such a plan should be removed
or relocated. Without a plan of this type, the plan commission would have
to deal only with the building in question and be unable to resolve the prob-
lems and concerns indicated here.
In so doing, the plan commission may alleviate some of the difficulties of

From a community standpoint, it would be recommended that this whole area be
treated as a special developmental area -- details would be developed at a
period and short run, those suggestions made here would need to be incorpor-

ated and with a viev toward solving the problems indicated here by establish-
ing a:Developmental Zoning Unit to solve the planning problems presented here.
In either case, the Developmental approach is required from a planning stand-
point. If the building is'tohconverted to a six-family facility. it is then
recommended that an architectural treatment to reflect this use also be under-
taken.
The size of living units, bedrooms and bathrooms would have to conform to the
requirements of the building code. The Plan Conmission should require a
