PCM19820817CITY OF MUSKEG0 PLAN COMMISSION MINUTES OF MEETING HELD AUGUST 17, 1982 CITY HALL Mayor Salentine called the meeting to order at 8:02 P.M Richard Arrowood, Ald. Charles Colburn. Les Constantineau, PRESENT: Chairman Wayne Salentine, Secretary Edward Raimann, Mangiamele. Zoning Officer Gerald Lee and Planning Consultant Joseph ABSENT^ Laura Kilb and Jack Schmidt MINUTE% Ald. Colburn moved to approve the minutes of the August 3rd meeting. Seconded by Mr. Raimann, motion carried. NEW BUSINESS: Resolution #P. C. 76-82 was moved to the bottom of the agenda because petitioner was not yet present. LEKFIELD RESTORATION - The Recording Secretary read Reso- lution #P, C. 17 - 82 . Auuroval of Lekfield Restoration Plan. Mr. Arrowood moved for' adoption. Mr. Constantineau seconded the motion. Zoning Officer Lee noted that in addition to the restoration bond of $25,000, a bond in the amount of $100,000 would be submitted to the Public Works Conunittee for Crowbar and Henneberry Road. The daily precautions to prevent soil erosion into the creek could include mulching, darning with hay bales, or creating a pocket to catch run-off, and representatives of DeBack Grading agreed to the precautions recommended. The Building Inspection Dept. will spot check the operation. Upon a roll call vote the rotion carrled unanlrously. STEINER AND BECK - The Recording Secretary read Resoltuion #P. c. 18 - 82 Mr. Raimann moved for adoption. Mr. Arrowood seconded the motion, , Approval of Certified Survey Map, Town of Norway. and upon a roll call vote the motion carried unanimously. #P. c. f9 a2 Avenue, Lannon Dr., Moorland Rd. Extended . Mr. Constantineau , Amendments to City's Highwa Width Map (College moved for adoption. Mr. Arrowood seconded the motion. Regarding Moorland Rd., Mr. Lee advised that the City and the County agreed to the location, but the City of New Berlin preferred a different route, and that the County had suggested the City discuss the matter with New Berlin. Mr. Constantineau seconded the motion, and upon a roll call vote the motion carried unanimously. - Page 2 - Plan Comission August 17, 1982 NEW BUSINESS (cont’d) RON FORD - The Recording Secretary read Resolution #P. C. 76-82, Recommendation to Approve/Disapprove Legal Lot Status. Planning Consultant Mangiamele presented his report dated August 17, 1982, noting a correction to his report in that the adjoining property is not zoned RS-3 as reported but is RS-2. He recommended that the area could be rezoned to RS-3 OED and then a new petition submitted for legal lot status, whereby the reduction in size would not be so great. After much discussion, Mr. Constantineau moved to defer to give the petitioner an opportunity to be present. Seconded by Ald Colburn. Because with the permission of his second. Because of the substantial of the time limit involved, Mr. Constantineau withdrew his motion reduction in size of the parcel, Mr. Arrowood moved to adopt Resolution #P. C. 76-82 to “Disapprove”. Mr. Raimann seconded the motion. The motion carried 4-1 with Ald. Colburn casting the only dissenting vote. COMMUNICATIONS AND MISCELLANEOUS BUSINESS A Notice of Public Hearing from the City of Franklin regarding a special use permit for Hwy. 45 Auto Sales & Salvage was read. (September 9, 1982 - 7 45 P.M., Franklin City Hall) A letter from Atty. Dale Arenz dated 8/13/82 regarding Fons vs. City of Muskego was read. The current status of this suit will be reviewed and a report presented at the next meeting. ADJOURNMENT^ Mr. Constantineau moved to adjourn at 9 00 P.M. The Plan Commission has generally reconnnended against legal lot status for lots not relatively close in size to that required in the zoning. In keeping with the policy and the specific requirements of the Zoning Ordinance for the City, it is necessary for the Plan Commission to deny this petition as this lot size is not in conformance with the 20,000 sq. ft. minimm lot size. The planning consultant recommends denial of legal lot status under RS-2 zon- ing. 0 However, as this lot is part of the ownership of adjoining property which is zoned RS-3 (requiring only 15,000 sq. ft. in area) and which also has an over- lay -- OED (Existing Development District) which provides for adjustment of lot sizes in existing development where these standards cannot be met, it is re- commended that the petitioner request that the RS-3/0ED zoning be extended to this property which would now permit building of a house on a lot as small as 11,250 sq. ft.
