PCM19820518CITY OF MUSKEGO PLAN COMMISSION MINUTES OF MEETING HELD PlAY 18, 1982 CITY HALL Mayor Salentine called the meeting to order at 8:02 P.M. PRESENT: Chairman Wayne Salentine, Secretary Edward Raimann, Richard Arrowood (arrived 8:40 P.M.), Ald. Charles Colburn, Les Constantineau, Laura Kilb and Jack Schmidt, Zoning Officer Lee and Planning Consultant Mangiamele were also present. MINUTES: Mr. Schmidt moved to approve the minutes of the pre- vious meeting of May 4, 1982. Seconded by Mrs. Kilb, motion carried. It was noted that the possible reconsiderations of Resolutions #P. C. 39-82 and #P. C. 40-82 should be removed from the agenda under Old Business, and Resolution SIP. C. 46-82 removed under New Business. OLD BUSINESS: AMENDMENTS TO ZONING ORDINANCE AND LAND DIVISION ORDINANCE - Resolution #P. C. 1f-82 was on the floor for discussion. Because of further review necessary for the sections regarding bonding of extractive operations and duplex zoning, Mr. Raimann moved to table the resolution. Mrs. Kilb seconded the motion, and upon a roll call vote the motion carried unanimously. 0 CLYDE HECKERT - The Recording Secretary read Resolution PP. C. 30 - 8.2 , Architectural Approval of Second Garage Structure, which was on the floor for discussion. Mr. Constantineau stated he had talked to the owners and the existing structure used as workshop would be for residential purposes only, and again noted a playhouse would be removed. Mr. Lee stated the use of the Board of Appeals action would be required to permit the structure as proposed on the site plan. Mr. Constantineau moved to amend the resolution to add, "Be it further resolved that this approval is subject to the condition that the existing playhouse be re- moved." Mr. Schmidt seconded the motion, and upon a roll call vote the motion carried unanimously. Upon a roll call vote the Resolution #P. C. 30-82 As Amended was adopted unanimously. HERITAGE PARK - The Recording Secretary read Resolution was on the floor for discussion. #P. C. 38-82, Recommending Approval of Rezoning Request, which Planning Consultant Mangiamele advised the Commission he had met with the applicants and reported that garages have now been shown on the plan. He stated he previously recommended they put 4 units in each building, and with the one in the club- house building, that would total 33 units. 37 units are shown on the plan, which would be permitted with the proposed zoning under a good planned unit development. C. 43 - 82 Operational Plans. Mr. Constantineau moved for adoption. Mrs. , Approval of Building, Site and Kilb seconded the motion. The owner indicated he would have the lot leveled by July 1st. Upon a roll call vote the motion carried unanimously. JOHN HASENSTAAB - The Recording Secretary read Resolu- tion 7P. C. 44 82 Raimann moved for adoption. Mr. Schmidt seconded the motion. - , Approval of Sketch for Land Division. Mr. Mr. Hasenstaab stated he felt he now owned two lots, having been previously divided from a lar e outlot, and that by now creating one additional parcel, a 8 200.00 park fee should be paid, and not $400.00 as required by the resolution. Mr. Raimann moved to amend the resolution by adding to the last paragraph "subject to a legal opinion on the validity of the $400.00 fee". Mr. Schmidt seconded the motion, and upon a roll call vote the notion carried unanimously. Upon a roll call vote the motion to adopt Resolution #P C. 44-82 As Amended carried unanimously. GEORGE RESCH - The Recording Secretary read Resolution Constantineau moved for adoption. Mr. Schmidt seconded the , Architectural Approval of Second Garage Mr. motion. The comissioners determined that the garage should be sited on the lot so as to be parallel with Martin Drive, the motion carried unanimously. and Mr. Resch agreed to the request. C. 45-82 Page 3 - Plan Commission May 18, 1982 PLANNER'S REPORTS presented his report dated May 18, 1982 regarding the proposal PARKLAND PLAZA PUD - Planning Consultant Mangiamele of Value Village Real Estate Corp. for three professional buildings to be located to the rear of Parkland Mall. In that report Dr. Mangiamele stated that consideration should be given by the Plan Commission for only one building between 3000 and 4000 sq. ft. to be used as a medical facility, which with appropriate landscaping and screening could serve as a high quality transitional use, improving the open space quality and indicated he would meet with Atty. Howarth who was unable to shielding the parking lot from the residential area. MEDICAL CLINIC - Zoning Of€icer Lee presented landscaping COMNUNICATIONS AND MISCELLANEOUS BUSINESS Mr. Vern Eder, owner of the building at W180 S7705 Pioneer Dr. which houses 3 apartrents upstairs and the former medical clinic downstairs, addressed the Comission. He stated he has been unable to sell or lease the building for 8 months due to an apparent lack of need for professional space, but did ments. Zoning Officer Lee reported that apartments were only permitted in business zoning in connection with a business, of open area per residential unit, and that an apartment building that the existing use is legal non-conforming because of a lack would be a greater degree of non-conformity and an ordinance change would have to be made to permit this use. The secretary was requested to write to Waukesha County indicating that the Plan Commission has reviewed this matter, does not feel the majority of area farmers are interested, Muskego already has a master plan and wants to retain local control, and that the Preservation Plan should be amended to exclude the entire Growth Area and to exclude the Non-Agricultural land in the Non-growth area.
