PCM19820202CITY OF MUSKEGO PLAN COMMISSION MINUTES OF MEETING HELD FEBRUARY 2, 1982 CITY HALL Mayor Gottfried called the meeting to order at 8:15 P.M. PRESENT: Chairman Jerome J. Gottfried, Rixhard Arrowood, Laura Kilb, Ald. Robert Klenz, Jack Schmidt and Walter Spann. Planning Consultant Mangiamele and Zoning Officer Gerald Lee were also present. ABSENT: Secretary Edward Raimann MINUTES: The minutes of the previous meeting of January 5, 1982, were approved as mailed. OLD BUSINESS: Pettibone Corporation, appeared to request approval of an operational plan for his business to be located in the Cade Building in the Industrial Park. He advised the primary business is building hydraulic recovery units, which involves welding, assembly and painting, with occasional display of equipment out- doors in a fenced area for sales purposes. He added he wo,uld prefer a cyclone fence, and that on occasion the equipment on or front of the building for better viewing by the prospective display for sales purposes might be brought around to the side buyer. an acceptable plan being submitted to the Building Inspector for approval which will show how the equipment will be displayed, for what purpose and for what period of time. Mr. Schmidt seconded the motion, and upon a voice vote the motion carried unanimously. Mr. Roger L. Duplex Use in RS-2 by overlay. Although overlay use is often used to provide exceptions in the application of the general requirenents of a zoning district, the application of an over- use of the zoning procedures or an unreasonably inconstant application of lay over one lot or small parcel of land may be considered to be a capricious zoning. However, the City of hskego'has established an RS-2 OD (overlay) requiring a double-sized lot whenever a duplex is to be built in an existing single- a two-family house on the area the size of two lots. However, the application family district. The double-sized lot gives rationaleto the development of of Rs-2 OD (overlay) a single-family lot does not appear to have that justif- ication and may have a deteriorating effect in some neighborhoods. This would give a general application to the item. If however, the City were to place this item in the 9.09 OD DUPLm DISTRICT--an overlay and conditional-type district, then item 2. under A. should read 2. &istiax duplex use, in order to preclude the building of a new duplex in a single-family district without conditions. The planning consultant considers the former the best approach to take if duplexes petition for such use by Florence Fahning under Resolution #P. C. 12-82.
