MINUTES OF MEETING HELD DECEMBER 15, 1981
CITY HALL
Mayor Gottfried called the meeting to order at 8:05 P.M.
PRESENT^ Chairman Jerome J. Gottfried, Secretary Edward
Raimann, Laura Kilb, Ald. Robert Klenz, Jack Schmidt and Walter
Spann. Planning Consultant Joseph Mangiamele and Deputy Inspec-
tor Dan Nowak were also present.
ABSENT: Richard Arrowood
MINUTES The minutes of the previous meeting of December 1,

OLD BUSINESS :

CHARLES C. COLBURN - The Recording Secretary read Resolu-
tion $P. C. 105 - 81 , Recommendation to Approve/Disapprove Legal
Lot Status. Planning Consultant Mangiamele read his report
dated December 9, 1981. Mr. Colburn submitted the signatures
of 6 neighbors with no objections to the legal status. He also
presented a number of points for consideration. By general
consent, the resolution was removed from the agenda to allow
time for review of the points brought up by Mr. Colburn.
Resolutions #106-112, Amending the Project Plans for TIF 81-7
were removed from the agenda.
Mr. Seegar Swanson, financial consultant, noeed that feasi-
bility in all Districts was not obtained - more dollar projects
proposed amended project plan for TID #l. In order to reduce

Re: Legal Lot Status request--

Dear Uayor and Plan Commission Members:
As hskego Shores Subdivision vas planned and "layed out" at a time vtlen
density and lot sizes were not as closesly watched as mey Cave been more
recently, a re-zoning resulted in a number of undeveloped lots of sub-stand-
ard sizes. The plan conmiasion ilas been particularly watchful of this area
because of the obvious results of thia high denaity and small lots. As
lots not conforming to the zoning requirements are not considered to be
legally buildable lots, it is necessary for the plan conrmiseion to consider
requests for legal status. Where a body is expected to exercise judgement
in these matters not being guided strictly by the specific requirements of
an ordinance, policy, past precedent and precedent for the future becomes
quite important.
As land use planning is concerned primarily with the general interest of the
total commnity or a large area rather than the economic gains to be made
from a single lot, the plan commission must keep thesebader intereatsin mind
when making s judgement on granting legal lot status. In the opinion of the
planning consultant, it is not in the best interest of this general area to
increase the land coverage or the baing density of this area.
For these reasons, the planning consultant reconnnends that the precedent that
has been established based on a policy aimed at maintaining the over values
of the area end quality of living be reatated by maintaining that legal lot
