PCM19810303CITY OF MUSKEG0 PLAN COPIMISSION e MINUTES OF MEETING HELD MARCH 3, 1981 CITY HALL Mayor Gottfried called the meeting to order at 8:OO P.M. PRESENT: Chairman Jerome J. Gottfried, Richard Arrowood, Laura Kilb, Ald. Wayne Salentine, Jack Schmidt and Walter Spann. Planning Consultant Joseph Mangiamele and Zoning Officer Gerald Lee were also present. ABSENT: Secretary Edward Raimann MINUTES: The minutes of the previous meeting of February 17, 981 were approved as mailed. OLD BUSINESS ROLFSON/DPFIELD - Zoning Officer Lee reported that Resolutions #P. C. 9-81 and #P. C. 10-81, Approval of Certified proper road dedication. He indicated that the City of Muskego Survey Maps were adopted on February 17, 1981, subject to the showed South Denoon Rd. to have a proposed width of 80' on the Highway Width Map, and the survey showed a 49.5' road. Mr. Spann moved for reconsideration of Resolutions SIP. C. 9-81 and SIP. C. 10-81. Mr. Plate It was suggested that the last paragraph of the resolutions stated that difficulty would occur in attempting to re-divide parcel 3 on the north side if additional dedication were necessary, making it undesirable to the prospective buyer. and #P. C. 10-81 to give Mr. Plate an opportunity to present a revised layout sketch showing all the parcels and how the 80' dedication might be achieved. Mrs. Kilb seconded the motion, and upon a voice vote the motion carried unanimously. 0 Mr. Arrowood moved to defer action on Resolutions YIP. C. 9-81 DONALD GARFIELD - The Recording Secretary read Resolution Permit, which had been deferred at the last meeting. Mr. Schmidt seconded the motion, and upon a roll call vote the motion to Table Resolution #P. C. 11-81 (As Amended) carried unanimously. #P. c. 11 - 81 ( As Amended), Approval of Request for Truck Parking NEW BUSINESS: SIP. C. 12 81 moved for adoption. Mr. Spann seconded the motion. Mr. Hodgson ALLEN R. HODGSON - The Recording Secretary read Resolution - , Approval of Broadcasting Tower. Mr. Arrowood stated he was-an amateur radio operator, and that although the tower was 70' in height he planned to add a motor to retract it granted for the location shown on the site plan and that if a to 21' when not operating. Upon a roll call vote the motion to adopt #P. C. 12-81 carried unanimously. #P. C. 13 81 Zoning Officer Lee reported that this would be the last possible division in Block 13 of the Jewel Crest Subdivision. He added that under Section 2.5 of the Land Division Ordinance, the Plan Commission can approve a variance from Section 7.0. He stated the surveyor had found a 4' discrepancy in the recorded plat along Gold Drive and divided that among the properties along that street from Onyx to Diamond. It was determined that It would be more desirable to create one non-conforming lot and one conforming lot than to split the variance requested over the two lots, and that the portion with the existing dwelling should be the non-conforming parcel, as shown on the site plan. Ald Salentine moved to adopt Resolution BP. C. 13-81 to Approve the sketch. Mr. Arrowood seconded the motion. After further discussion, Mr. Spann moved to amend the resolution by adding: "Be it further resolved that this approval is made pursuant to Section 2.5 of the Land Division Ordinance based on less than 75'. 2. The open space (City park) near the division the following: 1. The average width of many lots in the area are would reduce the concern of high density. 3. The 226 sq. ft. variance in lot area and 5.18' in average width does not signifi- cantly affect the surrounding area 4. This would not be a significant variance to the ordinance. 5. This would be the last possible division in the immediate area." Mr Schmidt seconded the motion to amend, and upon a voice vote the motion carried unanimously. 13-81 (As Amended) carried unanimously. MIKE STELMASZEWSKI - The Recording Secretary read Resolution - , Approval/Disapproval of Sketch for Land Division. e Upon a roll call vote, the motion to adopt Resolution #P. C. WAUKESHA COUNTY COMPREHENSIVE PLAN - The Recording Secretary read Resolution #P. C. 14 - 81 , Reconunending Approval of the Waukesha County Comprehensive Plan Proposal. Mr. Spann moved for adoption. Schmidt and Mr. Spann voting "yes" and Mr. Arrowood, Mrs. Kilb Concerns were expressed regarding the need for such a plan 0 Upon a roll call vote, the motion to adopt #P. C. 15-81, Recommending Amendnents to the Land Division Ordinance - Solar Access. Mr. Spann moved for adoption. Ald. Salentine seconded the motion, and upon a roll call vote the motion carried unanimously. ZONING OFFICER'S REPORTS PROPOSED AMENDMENTS TO THE ZONING ORDINANCE - SOLAR ACCESS - Ordinance to provide for the protection of solar access rights. Zoning Officer Lee reviewed the proposed amendments to the Zoning The amendments will be presented in resolution form for further review at the next meeting. Mayor Gottfried declared a short recess at 9:57 PM and the meecing reconvened at 9 59 PM. Mr. Lee was requested to follow up to determine if a lease has been signed and to obtain a date for the proposed move.
