PCM19790717CITY OF MUSKEG0 PLAN COMMISSION MINUTES OF MEETING HELD JULY 17, 1979 Mayor Jerome Gottfried called the meeting to order at 8:29 P,M. Ald. Salentine, Richard Arrowood, Laura Kilb, Fred Lavey and PRESENT: Chairman Jerome Gottfried, Secretary Edward Raimann, Walter Spann. Planning Consultant Joseph Mangiamele and Zoning Officer Gerald Lee were also present. MINUTES: The minutes of the previous meeting of June 19, 1979 were approved as mailed. OLD BUSINESS: RICHARD ANDERLEY - Resolution #P. C 77-79, entitled, A$proval of Broadcasting Tower - Richard Anderley, was on the floor and had been deferred from the previous meeting. Mr. Anderley, who was present at the meeting, explained that some of his neighbors had expressed concern regarding the possible interference with their with his neighbors in the event interference did occur, however, television reception. He indicated his willingness to cooperate since there.had been no problen at his previous residence he did not feel one would prevail now. He explained how the activities of "ham radio operators" are completely controlled by the FCC. Upon a roll call vote the motion to adopt Resolution #P. C. 77-79 carried unanimously. a NEW BUSINESS DAIRY QUEEN SIGN - The Acting Recording Secretary read Resolution #P. C. 86-79. entitled. AoorovallDisaooroval of Sign. Mr. Arrowood moved to adopt the resoiLtion with the word "appFova1". of the resolution as follows: "Therefore be it resolved that the Seconded by Mr. Spann. Mr. Lavey moved to amend the last paragraph Plan Cormission of the City of Muskego does hereby, upon recomen- dation of the Architectural Subcommittee, approve the request of Larry Thompson to erect a 46 sq. ft sign with overall height of 20 ft., red and white in color, or 55 sq. ft., 18 ft. setback from the base setback line, 20 ft. in height." Seconded by Mr. Spann. Upon a roll call vote the motion to amend carried unanimously. Upon a roll call vote the motion to adopt Resolution #P. C. 86-79, As Amended, carried unanimously. ATTORNEY ED RUDOLPH - The Acting Recording Secretary read Resolution BP. C 81 - /9 , entitled, Aooroval/Disauoroval of Sign Request. Mr. Lavey moved to adopt tie resolution-with the wo;d moved to defer action on Resolution 887-79 until the next meeting Seconded by Mrs Kilb. C. 88 - 7V Request - Pick 'n Save Warehouse Foods Mr. Lavey moved to adopt , entitled, Approval/Disapproval of Sign Mayor Gottfried advised the commission the operators of the store the resolution with the word "disapproval". Seconded by Mr. Spann. had agreed to re-design the sign to meet the requirements of the proposed guidelines presently being considered. Upon a roll call vote the motion to adopt Resolution SIP. C. 88-79 carried unaninously CARADARO CLUB - The Acting Recording Secretary read Reso- lution SIP. C. 89-79, entitled, Approval/Disapproval of Sign Request - Caradaro Club. Mr. Raimann moved for the adoption of Resolution WP. C. 89-79 with the word "Approval". Seconded by Yrs. Kilb. Nr Spann moved to defer action on Resolution #P C. 89-79 until the next meeting of the commission. Seconded by Mrs. Kilb. Motion carried unanimously. LAKE MEADOWS SIGN REQUEST - The Acting Recording Secretary read Resolution #P C. 90-/9, entitled, Approval/Disapproval of Temporary Sign Request - Lake Meadows. Mr. Lavey moved to adopt the resolution with the word "Approval". Seconded by Mr. Arrowood. Mr. Arrowood moved to amend Resolution #P. C. 90-79 by permitting two temporary signs for Lake Meadows. One sign to be located in Lake Meadows along Kelsey Drive for a period of one year, the other located on the Caesar property for a nine-month period Each sign to be 8 ft. by 16 ft. Seconded by Mr. Raimann. Upon a roll call vote to amend the motion carried unanimously. Upon a roll call vote the motion to adopt Resolution "P. C. 90-79, As Amended, carrigd unanimously. Denial of Sketch for Land Division. R. W. BURKOWITZ - The Acting Recording Secretary read Reso- Mr. Lavey moved for'adoption. ' Seconded by Mr. Raimann. Yr. Burkowitz, who was present in the audience, explained his reasons for a request for a land division. Mayor Gottfried advised Mr. Burkowitz's request is contrary to the City's Zoning Ordinance, which requires 20,000 sq ft. lots in that area and the proposed call vote the motion to adopt Resolution #P. C. 92-79 carried division would create a lot 17,458 sq. ft. in area. Upon a roll Unanimously. C. 96-79, entitled, Approval of Sketch for Land Division- Eugene-Kraklow. Mr. Lavey moved for adoption of Reso- lution #P.C. 96-79. Seconded by Mr Raimann. Planning Consultant Mangiamele read his report dated July 17, 1979 recommending a road reservation either on the west side or the east side of the proposed division in order to assure propert' development of the remaining property in the future. Following discussion regarding the location of the proposed house and reservation, upon a roll call vote the motion to adopt carried unanimously. SaleEtine moved for adoption. Seconded by Mr. Spann. Upon roll call the mo- tion carried unanimously. TED LANE - The Acting Recording Secretary read Resolution Ted Lane. Mr. Raimann moved for adoption. Seconded by Mr. Arrowood. Mr. Lane stated he had purchased the lot in question with a house in 1976. The house was later condemned and razed. Still later he purchased the adjacent lot not knowing that this would prohibit him from selling or construction a home on the lot for which he is seeking legal status. He further stated his lots were larger than that required by zoning and felt he was being discriminated against. Following further discussion, upon a roll call vote on the motion Ald. Salentine voted "no". Mr. Arrowood, Mrs Kilb, Mr. Lavey and to adopt Resolution #P. C. 98-79, Mayor Gottfried, Mr. Raimann and Mr. Spann voted "aye". The motion to adopt carried. C. 99-79, entitled, Denial of Preliminary Plat - Mr. Arrowood. Mr. Stan Potrykus, developer of proposed Oak Meadow Oak Meadow Estates. Mr. Spann moved for adoption. Seconded by Estates, stated he felt he had conformed to all local ordinances and plat be more specifically defined. Upon a roll call vote on the state statutes. He requested the reasons for denial of the submitted Ald. Salentine voting "no". motion to adoptedResolution #E'. Salentine moved for adoption. Seconded by Mr Arrowood. Mayor and Zoning Officer - Request for Pole Building - Richard Koput. Gottfried advised that because we are concerned as to how the pole barn would be constructed and if it would be compatible to surround- ing areas. Further information to be submitted at the next Plan Commission meeting. JOSEPH P. JAGIELSKI - The Acting Recording Secretary read Resolution #P. ADDrOVd of Expansion of Conditional Use Grant and Reco&nending rpproval~of Re- newal of Extractive Permit - State Sand & Gravel and Payne & Dolan. Mr. Raimann moved for adoption. Seconded by Mr. Lavey. Upon a roll call vote the motion carried unanimously. PLANNER'S REPORT RUSTIC ACRES - Planning Consultant Mangiamele advised the 0 preliminary plat will be further reviewed. A question was raised regarding the drainage pattern as it: relates to Lake Denoon. BOSTATER-DEBACK - Planning Consultant Mangiamele read a written report regarding the Planned Development proposal for the Deback and' Bostater property dated July 17 ,* 1979. .. COMMUNICATIONS AND MISCELLANEOUS BUSINESS TAX INCREMENT FINANCING - Mr. Seegar Swanson, Financial Consultant, was unable to be present at this evening's meeting. Mayor Gottfried advised it would be probable he would be attending the next meeting of the commission. WAUER GRAVEL - The Acting Recording Secretary advised a petition has been received from Wauer Gravel for renewal of Conditional Use Grant #20 for the purpose of mining and processing on Tuesday August 21, 1979. sand and gravel. The meeting adjourned at 10:05 P.M. 0 +l~+rnu, ne Elger Acting Recording Secretary JE/ch memo PROGRESS REPORT TO : City of Muskego Plan Commission FROM: Joe Mangiamele, Planning Consultant SUEiJECT: Planned Development proposal for Deback and Bostater DATE: July 17, 1979 The proposed layout has been reviewed with certain questions raised by the developers and with the Zoning officer. the Planning Consultant. These have been discussed at a meeting with The staff is concerned with the treatment of the lake with itsuse as an open space element or amenity to the community. There are evidences The developers will be preparing a soils map and astudy of the watertables of wet soil conditions which may require design or engineering attention. and drainage systems. The soils informat,ion may affect a substantial part of the proposed layout. A 9.5 acre parcel is to be excluded from the proposed development at this time. The future treatment of that parcel is yet to be determined. Also the use of the existing buildings on that parcel needs clarification. The extension of Muskego Dam road is not on the northern edge of the property as indicated on the official road map. The official map shows it as a major 100' right of way, as it was intended to carry a relatively high volume of traffic. The proposed extension of hskego Dam road, con- ceives of the road as a residential road--this discrepancy needs to be resolved. The designed access of lots at the corner of Racine Ave. and hskego Dam road to the south may also require redesign consideration. The Consultant has advised the developers to give consideration to the above concerns in relation to the proposed layout and concept. memo CONSULTANT'S REPORT TO: City of bskego Plan Comission FROM: Joe Mangiamele, Planning Consultant SUBJECT: Land division - Richard Kraklow DATE : July 17, 1979 In order to assure proper development of the remaining property in the future, it is recommended a road reservation either on the west side or the east side of the proposed division be provided. The reserved road then to be dedicated to the City at the time sewers are extended or the time the remaining land is to be developed. Such reservation to be shown on the certified survey with the provision for dedication.
