PCM19770503CITY OF MUSKEG0 PLAN COMMISSION MINUTES OF MEETING HELD MAY 3, 1977 CITY HALL Mayor Gottfried called the meeting to order at 8:15 P. M. PRESENT: Chairman Jerome Gottfried, Secretary Edward Raimann, Richard Arrowood, Ald. Les Constantineau, Laura Kilb, Fred Lavey, and Wayne Salentine. Planning Consultant Mangiamele and Zoning Officer Gerald Lee were also present. MINUTES: The minutes of the previous meeting of April 19, 1977, were approved as mailed. OLD BUSINESS BOHRER'S MEATS & APPLIANCE CO. - It was noted by the Conunission that the Architectural Sub-conunittee had reviewed a sign request for Bohrer's Meats & Appliance Co. prior to the last Plan Commission meeting, however, had recommended that Resolution #P. C. 37-77, (Approval / Disapproval) of Sign Request, be removed from the agenda until further review. The Recording Secretary read Resolution #P. C. 37-77. Mr. Lavey moved for the adoption of Resolution #P. C. 37-77, Approval of Sign Request. Ald. Constantineau seconded the motion. it is his intention to remove the existing TV sign, the Bohrer TV and Appliance sign, the Muskego Lion's Club sign and the changeable letter sign; however, it is his intention to keep the steer sign indicating the meat business and the Hotpoint appliance sign as it is also used for lighting the parking area. Mr. Lavey moved to amend Resolution BP. C. 37-77 with the addition: "Be it further resolved that the existing TV sign, the Bohrer TV and Appliance sign, the Muskego Lion's Club sign and the changeable letter sign shall be removed as soon as the new sign is installed. Mr. Raimann seconded the motion and the motion carried upon a voice vote. with the addition: "Be it further resolved that the Hotpoint appliance sign shall be removed and incorporated into the proposed free standing sign." Ald. Constantineau seconded the motion. Mr. Bohrer expressed concern at the removal of this sign explaining that it is used for lighting the parking area and that it will be approximately 200' from the proposed sign; that he has approximately 600' of property along the highway. Amended, Mr. Arrowood, Ald. Constantineau and Mrs. Kilb voted "yes", Mayor Gottfried, Mr. Raimann, Mr. Lavey and Mr. Salentine voted "no" and the motion lost. Upon a roll call vote, the motion to adopt Resolution #P. C. 37-77 As Amended carried unanimously. Mr. Ronald Bohrer was present and advised the Commission that Mr. Arrowood moved to amend Resolution #P. C. 37-77 As Amended 0 Upon a roll call vote to amend Resolution #P. C. 37-77 As Page 2 - Plan Commission May 3, 1977 SIEGER OLDSMOBILE - It was noted by the Commission that the Architectural Sub-committee had reviewed a sign request for Sieger Oldsmobile prior to the last Plan Comission meeting, however, had recommended that Resolution #P. C. 39-77, (Approval f Disapproval) of Sign Request, be removed from the agenda until further review. Mr. Raimann moved to adopt Resolution #P. C. 39-77 with approval of the 9' x 9' identification sign, disapproval of the 6' x 6' used car sign and approval of the 4' x 4' parts and service sign. Mr. Lavey seconded the motion. concern at the disapproval of the used car sign pointing out that this sign and the identification sign will be approximately 70' apart, that the three signs are a dealership package and that his competitor has 9 signs. of the 6' x 6' used car sign". Mr. Arrowood seconded the motion and the motion carried upon a roll call vote with Mr. Raimann casting the only dissenting vote. of the 6' x 6' used car sign". Mrs. Kilb seconded the motion and upon a roll call vote, Mayor Gottfried and Mr. Raimann voted "no", Mr. Arrowood, Ald. Constantineau, Mrs. Kilb, Mr. Lavey and Mr. Salentine voted "yes" and the motion carried. for Sieger Oldsmobile in May, 1976, was reviewed in which there had been a stipulation that parking of cars would not be permitted in the visual setback area. Mr. Sindic advised that he was not aware of this requirement. After considerable discussion with Mr. Sindic, it was generally agreed that an area created from the east entrance point on Janesville Road and the entrance point on Bay Lane to a point 10' from the corner of Bay Lane and Janesville Road would provide the visual setback area necessary and would still permit the display of cars behind that area. Ald. Constantineau moved to amend Resolution BP. C. 39-77 As Amended with the addition of the following: "Be it further resolved that this approval is subject to the condition that automobiles shall not be parked in the visual setback area at the corner of Janesville Road and Bay Lane. Mr. Lavey seconded the motion and upon a roll call vote, the motion carried unanimously. Amended, the motion carried unanimously. Mr. Robert Sindic, president for Si.eger Oldsmobile, expressed Mr. Lavey moved to amend the resolution by deleting "disapproval Mr. Lavey moved to amend the resolution by adding "approval At the request of Ald. C. 49-77, Denial of Legal Status, is on the floor, however, action was deferred at the last meeting pending further review. The Recording Secretary read Resolution #P. C. 49-77. Mayor Gottfried advised that Mrs. Gille had requested that action on this resolution be deferred to give her husband an opportunity to take percolation tests on the 3 acre parcel in question. He Edvised that the Gilles had purchased the one acre with existing home in 1971 from Lloyd Hamm and that in 1974, they purchased the three acre parcel adjoining their property from Mrs. Ida Tess. He also pointed out that the soil maps indicate very severe soils in this area. Mr. Lavey seconded the motion and the motion carried upon a voice vote with Mr. Salentine casting a dissenting vote. NEW BUSINESS Mr. Arrowood moved to defer action on Resolution VP. C. 49-77. F4.YMOND INGOLD - The Recording Secretary read Resolution #P. C. 55-77, Approval of Conditional Use Grant. Mr. Arrowood moved for adoption. Mr. Lavey seconded the motion. the conditions on the operation as indicated in the resolution. 55-77 carried unanimously. Mr. Ingold was present and indicated that he was agreeable to Upon a roll call vote, the motion to adopt Resolution BP. C. VALLEY TAP - The Recording Secretary read Resolution #P. C. 56-77, Architectural Approval of Addition. Mr. Salentine moved for adoption. Mr. Lavey seconded the motion. A representative of Valley Tap advised that it is quesionable if the addition can be constructed to the side because of the location of the well on the property, however, the addition to the front will be constructed. 56-77 carried unanimously. Upon a roll call vote, the motion to adopt Resolution #P. C. AMERICAN COLLEGE - The Recording Secretary read Resolution #P. C. 57-77, Approval of Revised Site Plan. Mr. RaimaM moved for adoption. Mr. Salentine seconded the motion. Mr. Heise, representative of the college, was present and advised that they will be submittkg a revised site plan which will include relocation of the activities building as well as Phases 2 and 3 of the development, however, he would like approval of the revised location for the fourth student housing building the development having a lake as they have encountered a water supply. Mayor Gottfried advised that there would be no objections if it were maintaine,d and that it be shown on the site plan. 57-77 carried unanimously. in this Phase 1. Mrs. Kilb seconded the motion and upon a roll call vote, the motion carried unanimously. FOUNTAINWOOD POOL ASSOCIATION - The Recording Secretary read Resolution #P. C. 60-77, Approval of Plat of Survey. Mr. Lavey moved for adoption. Mr. Arrowood seconded the motion and upon a roll call vote, the motion carried unanimously. Mayor Gottfried declared recess at 9:37 P. M. and the meeting reconvened at 9:45 P. M. ' COMMUNICATIONS & MISCELLANEOUS BUSINESS DOWN ONE DISCO - Several residents of Guernsey Meadows sub- division living near the Towne Casino appeared regarding the opening of the Down One Disco. Mrs. James Klimek, Mr. Stephen Carroll, Mrs. Sally Schultz and Mrs. Patti Philaja expressed concern at possible noise which would be generated from the disco, the new parking area to the rear of the building which is adjacent to their backyards, the possibility that cars will park on new plantings in the buffer area between the Casino property and their properties. pointing out the 30' buffer area between the Casino property and the subdivision. city approvals, however, if it should become a nuisance, the residents should call the Mayor or Zoning Officer Lee. Zoning Officer Lee reviewed the plans for Guernsey Meadows Mayor Gottfried advised that the disco was not subject to Page 5 - Plan Commission May 3, 1977 PLANNER'S REPORTS JOHN COUTURE - Planning Consultant Mangiamele reviewed his report and recommendation dated May 2, 1977, concerning a proposed one parcel division of the Couture property in the NW 114 of Section 10 on Janesville Road. WAYNE PETERSON - Planning Consultant Mangiamele reviewed his report and recommendation dated April 27, 1977, concerning a neighborhood study of the Peterson, Rinderle and Stickney properties on Martin Drive. DUPLEX DISTRICT - Planning Consultant Mangiamele reviewed a proposed amendment to the zoning ordinance which would create a duplex overlay district. 8 FOREST DRIVE EXTENSION -The Commission reviewed and discussed the uncompleted strip of Forest Drive extending north into the undeveloped Parks property. It was noted by the Commission that there were several other street extensions intended for continuation to that property. It was the consensus of opinion that this uncompleted strip should be abandoned and Mayor Gottfried advised that a resolution recommending the'vacation will be submitted to the Commission for their consideration at the next meeting. OD Duplex District (Conditional Use) - overlay. STATEMENT OF INTENT: This district is intended to orovide for two-familv dwelline units (duDlexes) in areas where special circumstances of location, land characteristics or or improve the surrounding living and environmental character of the potent- the type of existing use, building or proposed building would contribute to ial or the future development of that area. (1) Lot Size: - .. Min. Area-: 1% times that required for each dwelling unit of the under- lying use; Min. Width: 1% times that required for each dwelling unit of the under- lying use; (2) Density: 10,000 sq. ft. for principal unit and 5,000 sq. ft. for secondary unit -- total minimum lot size of 15,000 sq. ft. or 1% times the density required per D.U. in the under- lying use. After a public hearing, the plan cmission may recommend the reduction of this density up to 507. to the board of appeals. (3) Building location: Min. setback: 40 feet, one side 15 feet, other side 15 feet or setback and offsets as required in under- lying district, which ever is greater. (5) Open Space: 7,000 sq. feet or 7oX of the required lot area or average lot size .of the area, which ever is greatest. (6) Height: principal structure, 35 feet, accessory structure, 15 feet. A. Hangiamele, City of hskego Planning Consultant - SUBJECT: Land Division -- John Couture, Janesville Road NW 1/4 of Sec. 10. DATE : May 2, 1977 Submitted sketch plan indicates a road to the interior of this property. The proposed division to establish one lot is adjacent to the proposed road. If the proposed size and form of lot were approved at this time, it would also establish the location of road,the future road angle as well as its width. A preliminary review of the sketch plan reveals inadequa- cies in the layout of this proposed Planned Unit Development. Therefore, it is necessary to develop a planned development approach, at least through preliminary approval stage before a sketch for the certified approval of one-lot division can properly be reviewed. In order to do this,it with a planned development presentatfon, giving full consideration to the is necessary that the applicant apply for a rezoning to planned development so%l conditions, open space needs and the various requirements of that section of the zoining ordinance. Overall densities need to be considered and com- puted. Planned development cannot be considered on a piece-meal basis--the intent of the planned development concept and of the ordinance is that a comprehensive approach be taken. It is therefore recommended that this pro- posed development be taken through this step by step planning sequence.
