PCM19740319CITY OF MUSKEGO PLAN COMMISSION MINUTES OF MEETING HELD MARCH 19, 1974 CITY HALL Mayor Gottfried called the meeting to order at 8:05 P. M. PRESENT: Chairman Jerome Gottfried, Secretary Alvin Basse, Kenneth Czaplewski, Blair Dixon, Edward Raimann, Ald. Paul Schaumberg and Donald Yahr. Planning Consultant Joseph Mangiamele and Zoning Officer Gerald Lee were also present. MINUTES: The minutes of the previous meeting of February 19, 1974, were approved as mailed. AGENDA ITEMS WILLIAM HONECK - Mr. Honeck, S106 W16480 Loomis Road, appeared to discuss his opposition to the proposed rezoning of a 3/4 acre parcel Highway Service back to Agriculture. He advised the Commission that of his property in Section 34 from Agriculture with an Overlay for it is his intention to eventually construct a custard stand on the parcel as was his intention in 1971 when he had petitioned for and received the OHS zoning, that his plans for construction have been delayed because of his present work status, that the construction and operation of the custard stand would be for him "to fall back on in the event he is layed off at Delco Electronics", that in his opinion it would be a good business location as it is across from Ludwig Bros., that the parcel would not lend itself to residential use and could only otherwise be used for gardening purposes, that the piece is isolated because of the new Highway 36 and separated from his property - 6 1/4 acres directly across Highway 36. take any action on this rezoning at this meeting, however, the Commission Mayor Gottfried advised Mr. Honeck that the Commission would not will give consideration to Mr. Honeck's comments. C. 17-74, Recommendation of Proposed Amendments to Muskego Zoning Ordinance. Mr. Czaplewski moved for adoption. Mr. Yahr seconded the motion. amended to permit duplexes in 1971 only one petition had been submitted Zoning Officer Lee explained that since the ordinance had been for conditional use grant and this had been for a duplex subdivision. Planning Consultant Mangiamele reviewed his report and recommenda- tion dated March 19, 1974, concerning the proposed amendments. Upon a roll call vote, the motion to adopt Resolution #P. C. 17-74 carried unanimously. HALLADA CONSTRUCTION CO. - It was noted by the Commission that at the last meeting, the matter of the Hallada Construction Co. had been feferred to Planning Consultant Mangiamele for recommendation as it relates to OBBnning and to City Attorney Buckley for his opinion as it relates to legal status and to the petitioner for additional information as to the use and operation of the premises. The Recording Secretary read a communication dated March 12, 1974, directed to Mayor Gottfried from City Attorney Buckley regarding the legal status of the Hallada Construction Co.. directed to Building Inspector Lee from Attorney David J. Schoetz, representative of the Hallada Construction Co,, regarding the use and operation of the premises. dated March 13, 1974, concerning the remodeling project. have submitted a request for an occupancy permit, that the remodeling concerning the use of the premises, pointing out that recently they proposed would not exceed 50% of the fair market value of the building, that the real question facing the Commission is the prefabrication of walls and the storage of construction equipment compared to the manu- facture of septic tanks and the storage of equipment. the Hallada premises, appeared to advise the Commission of the concerns Attorney Clayton Cramer, representative of residents surrounding of the residents in the area. He pointed out that Hallada had not complied with city ordinances, had not applied for an occupancy permit, had started alterations to the building which were not approved by the Plan Commission and had debris in the yard, that in their opinion he had lost the non-conforming status and that the property should now conform to the residential district in which it is located. Referral of Revised Site Plan to Planning Consultant HOUSE OF HOMES, INC. - The Recording Secretary read Resolution and Zoning Officer. Mr. Yahr moved for adoption. Mr.-Raimann seconded the motion. Upon a voice vote, the motion to adopt carried unanimously. Mayor Gottfried suggested that the members also review the site. SANDY BEACH SUBDIVISION - The Recording Secretary read Resolution #P. C. 20-74, Approval of Sketch for Sandy Beach Subdivision. Mr. Dixon moved for adoption. Mr. Basse moved for adoption. Mr. Raimann seconded the motion and upon a roll call vote the motion carried unanimously. JOSEPH STARICH - The Recording Secretary read Resolution #P. Mr. Bob Gunerman, representative of Hoffmann, Polzin, Becker & ASSOC., reviewed the proposed subdivision layout for the Commission. Upon a roll call vote the motion to adopt Resolution #P. C. 25-74 carried unanimously. SCHAEFER FARMS - The Recording Secretary read Resolution #P. C. Mr. Yahr moved for adoption. Mr. Czaplewski seconded the motion. 26-74, Referral of Schaefer Farm Phases to Planning Consultant. reviewed the four proposed phases for development. 26-74 carried unanimously. Mr. Yahr seconded the motion and the motion carried upon a voice vote. LEONARD SHERPER - The Recording Secretary read Resolution #P. C. 28-74. Referral of Sketch for Land Division to Planning Consultant. Ald. Schaumberg moved for adoption. Mr. Yahr seconded-the motion and the motion carried upon a voice vote. KNOLLWOOD MANOR - The Recording Secretary read Resolution #P. C. 29-74, Referral of Plans for Senior Citizen Retirement Center to Planning Consultant. Mr. Raimann moved for adoption. Mr. Basse seconded the motion. Rev. James Williams reviewed the proposal pointing out that they were originally proposing 360 units, however, they would like to now propose 234 units, a density of 1.6 units per acre, which would be less than the 65% allowable development.
