PCM19730605CITY OF MUSKEG0 CITY PLAN COMMISSION MINUTES OF MEETING HELD JUNE 5, 1973 CITY HALL Mayor Gottfried called the meeting to order at 8:14 P. M. PRESENT: Chairman Jerome Gottfried, Secretary Alvin Basse, Kenneth Czaplewski, Blair Dixon, Edward Raimann, and Donald Yahr. Planning Consultant Joseph Mangiamele and Zoning Officer Gerald Lee were also present. Ald. Schaumberg arrived at 9:OO P. M. MINUTES: The minutes of the previous meeting of May 15, 1973, were approved as mailed. """"" PERSONAL APPEARANCES was present in reRard to Resolution #P. C. 37-73. Recommendation of ANTON A. BERINGER - Mr. Beringer, W190 S7236 Lochcrest Boulevard, Denial for Legal Lot Status. It was noted by the Commission that this resolution is on the floor, however, action was deferred at the meetings of April 3rd. May lst, and May 15th pending receipt of an opinion from the city attorney as to the legal status of the road. The Commission reviewed a communication dated May 29, 1973, from Attorney Buckley. Zoning Officer Lee reported that there is sufficient area to build a easement area. He pointed out that there would not be ample room to 1200 sq. ft. home with proper setback and without encroaching on the construct a garage in addition to the home, however, nor would there be sufficient room to construct a home larger than 1200 sq. ft. Mayor Gottfried advised that two laterals had been installed for Mr. Beringer's property and that if the lot were not granted legal status by the Common Council the cost of one lateral would be refunded. Mr. Czaplewski, Mr. Dixon and Mr. Raimann voted "yes", Mr. Basse and Mr. Yahr voted "no" and the motion to adopt Resolution #P. C. 37-73 carried. After further discussion, upon a roll call vote, Mayor Gottfried, LORETTA YANNY - Mrs. Yanny, S74 W17648 Lake Drive, was present in regard to Resolution #P. C. 58-73, Approval of Revised Building, Site and Operational Plans. It was noted by this Commission that the resolu- tion is on the floor, however, action was deferred at the last meeting pending review and report from the Public Works Committee. Mayor Gottfried and Ald. Schaumberg reported that there is a problem with drainage flow in the area, however, that the natural flow of the water does not touch grade were changed. Ald. Foldy expressed concern that the drainage the Yanny property, that it would not help the situation if her property must be corrected in this area. carried unanimously. The Commission reviewed a communication dated May 31st, 1973, from City Attorney Buckley advising in part, "It is my opinion that the city would not incur any liability, although it is too late for the city to do anything about Lot 2 since it has been sold." Planning Consultant Mangiamele recommended sufficient square footage. that additional property on the east be added to these lots to give them Mr. Czaplewski moved to amend Resolution #P. C. 55-73 by adding to the last paragraph "....subject to the condition that the length of the property be extended to the east to give sufficient square footage to meet the requirements of the zonine ordinance of 80.000 SO. ft." Mr. HANS KEISER - Mr. Czaplewski moved to adopt Resolution #P. C. Yahr seconded the motion and the mGtion to amend carried. Upon a roll call vote, the motion to adopt Resolution #P. Mr. Raimann seconded the motion and upon a roll call vote, the entitled Approval of Sign to Advertise Sandy Beach. Mr. Basse moved for motion carried unanimously. ROBERT ADAMS - The Recording Secretary read Resolution #P. C. 61-73 0 entitled Denial of Sketch for Land Division. Mr. Raimann moved for adoption. Mr. Czaplewski seconded the motion. Zoning Officer Lee reviewed proposed division and problems involved. Upon a roll call vote, the motion to adopt Resolution #P. C. 61-73 carried unanimously. 62-73 entitled Referral of Preliminary Plat to Plannine Consultant. SCHMIDT - FAHNING - The Recording Secretary read Resolution #P. C. Mr. Czaplewski moved for adoption. Mi. Basse seconded-the motion and the motion carried upon a voice vote. 63-73 entitled ADDroval of Revised Site Plan for Parkland Plaza Planned PARKLAND PLAZA - The Recording Secretary read Resolution #P. C. Development. Mr. Yahr moved for adoption. Ald. Schaumberg seconded the motion. The Commission reviewed the proposal for recreational facilities. Mr. Yahr moved to defer action and refer the plan to Planning Consultant Mangiamele for review and recommendation. Mr. Dixon seconded the motion and the motion carried. L. ~ ~ ~~ DURHAM HEATH - The Recording Secretary read Resolution #P. C. 64-73 entitled Referral of Sketch for Durham Heath to Planning Consultant and Sewer Committee. Mr. Raimann moved for adoption. Mr. Yahr seconded the motion and the motion carried upon a voice vote. Page 3 - Plan Commission June 5, 1973 65-73 entitled Approval of Certified Survey Map. Mr. Yahr moved for adoption. Mr. Raimann seconded the motion. After review and discussion, Mr. Yahr moved to amend Resolution #P. C. 65-73 by adding to the last paragraph "....subject to the city widths, and subject to the condition that the triangular remnant of engineer's approval, subject to the proper dedication of the street property be attached to the business lots." Ald. Schaumberg seconded the motion and the motion carried. Upon a roll call vote, the motion to adopt Resolution #P. c. 65-73 As Amended carried unanimously. Mayor Gottfried declared recess at 9:40 P. M. and the meeting reconvened at 10:02 P. M. DONALD MILLER - The Recording Secretary read Resolution #P. C. ZONING MAP UP-DATE - Planning Consultant Mangiamele reviewed the first phase of the up-dated zoning district map which had been prepared in accordance with the newly accepted comprehmive plan. PIAN COMMISSION SUB-COMMITTEE - In addition to the mayor, zoning officer and Dlannina consultant. Hr. Raimann and Ald. Schaumberg were appointed to'serve on the Plan Commission sub-committee to meet-after the development and subdivision of the Paul Grober property on Tans this regular meeting with Mr. Bryce Stysa of Harmoney Homes to discuss Drive.
