PRESENT: Mayor Jerome Gottfried, Chairman, Charles Buehler, Foldy and Edward Flaimann. Planning Consultant Joseph Mangiamele Secretary, Alvin Basse, Ald. Robert Burgermeister, Ald. Charles and Zoning Officer Lee were also present. ABSENT: Willard Bertram MINWES: The minutes of the previous meeting of July 21, 1970, were approved as mailed. """"" PERSONAL APPEARANCES DAVID CUNNINGHAM - Mr. Cunningham, developer, and Architect Charles Luedtke ameared to discuss the Dlanned deVelODment proposal for 13 skies of the George Schaefer property in Section 8 presently under consideration for rezoning to RSM with OPD overlay. for a group of citizens who oppose the proposed apartment complex, desire to keep their areas single family residential, that the citing as basis for objections that the residents in the.area would burden the schools, that the water table presently serving number of children from the two and three bedroom apartments individual wells might be affected by a community well to serve such a large complex, that the sewage plant might not be able to handle the additional sewage, increased traffic at the corner of new Racine Avenue and Highway 24, and the additional burden put on the Police and Fire Departments which in turn will increase real estate taxes. An additional 39 names were submitted to be added to the petition opposing the complex which had been read at the public hearing held July 28, 1970. In answer to questions from Ald. Foldy, Mr. Cunning- ham advised that they would stancl behind their figurts of 1/3 school age child per unit. Ald. Foldy then questioned if their plans include low cost subsidized housing and Mr. Cunningham advised that it is their intention to handle this through a , conventional loan. ham advised that if the ratio were changed from the proposed 24 one bedroom, 24 two bedroom and 60 three bedroom units, it would probably mean that the development could not take place for a period of several years and that it has been their experience that one bedroom units are occupied by two people only. 9 x 10 dens are not included in the three bedroom units and that only 6 or 8 of the one bedroom units have dens. Mr. Cunningham advised that the Page 2 - Plan Commission August 4, 1970 Mayor Gottfried advised that according to figures from Southeastern Wisconsin Regional Planning Commission it appears possible that there could be 83 children in the complex and a deficit of $24,227 per year for educating these children. He expressed concern that the commercial potential at the corner of new Racine Avenue and Highway 24 has been limited because of the revised location of the area to be rezoned. Planning Consultant Mangiamele clarified the planned development requirements and pointed out that when the commercial area is developed it will offset any deficit for education. that it would be his opinion that a community well will not be in the same water table as individual wells. that the rezoning of the 13 acres of the George Schaefer property be approved as submitted. Mr. Basse seconded the motion. that the number of three bedroom units be reduced so that the Ald. Burgermeister seconded the motion. ratio between the one, two and three bedroom units is closer. it is his opinion that the proposal should be accepted as submitted. Mr. Basse expressed concern at theauendment, advising that The motion to amend carried with Mr. Basse casting the only dissenting vote. Ald. Burgermeister, Ald. Foldy and Mr. Raimann voted "aye" and On the motion as amended, upon a roll call vote, Mr. Buehler, Mr. Basse voted "no" and the motion carried. In answer to Ald. Burgermeister, Zoning Officer Lee advised Ald. Burgermeister moved to recommend to the Common Council Ald. Foldy moved to amend the motion to include the provision STEVEN SCHULER - Mr. Schuler, W198 S10857 Racine Avenue, and Attorney Willis Lang appeared requesting approval of prelimi- nary plat and certified survey map for the division of 5.58 acres of land in Section 32 on Lake Denoon which had been prepared by Surveyor John F. Degan. It was noted by the Commission that this division includes Schuler's Denoon Resort. Attorney Lang clarified the road patterns serving the lots along Lake Denoon not owned by Mr. Schuler. He advised that there is a 13.643 acre parcel remaining on which the buyer of the 5+ acre parcel has option. It was the Commission's opinion that when the remaining 13+ acres is divided, additional roads and accesses to the area can be determined. certified survey map as submitted. Mr. Raimann seconded the motion and the motion carried. Mayor Gottfried declared recess at 9:18 P. M. and the meeting reconvened at 9:25 P. M. Mr. Buehler moved to approve the preliminary plat and FRITZ RAASCH - Mr. Raasch, operator of Phillips 66 Service Station, was not present regarding his request for approval of a sales area for land and water vehicles in conjunction with the service station, corner of Janesville Road and Lions Park Drive. under Conditional Use Grant #1. It was noted by the Commission that this business is operating display one snowmobile and that if he keeps an additional one on the property it wiU be crated. Burgermeister moved that it is the Commission's determi- nation in accordance with Sec. 6.03 (2) G. that the display of one snowmobile on the premises will not constitute such a sub- stantial change as to require a public hearing and to approve seconded the motion and the motion carried. the request for display of one snowmobile only. Ald. Foldy SAM LAWENT - Attorney Sam Lawent, appeared to review the conditions for the Parkland Plaza planned development at the corner of Janesville Road and Lannon Drive. He advised that it is their intention that the first phase of development will be approximately 20 residential units, the second stage will be construction of some apartments, and the third stage will be commercial development. Mayor Gottfried advised that Ruekert & Mielke has indicated that any large sewer interceptors which might be necessary for future the sewer will be available, although the city will not finance development in other areas. the following communication to the Commission: "Gentlemen: Development known as Parkland, which development has been previously approved by your Honorable Body. the same format as that which has been approved in the past. The project consisted of a mixed development of commercial, multi- family and single family. Recently we have entered in various offers to purchase for the acquisition of various portions of Parkland and are presently negotiating for the balance of the land. Corp. is prepared We feel that the sale of home sites will proceed as follows: August 4, 1970 Page 4 - Plan Commission Architectural Control - We intend to form an architectural con- trol committee whose duty it would be to pass on all plans of homes to be constructed within Parkland. This committee would also approve grade elevations and position of house on site. It would be the duty of this committee to maintain the existing high with construction and realize that the success of any development standards of Muskego. All members of this committee are experienced is predicated on the desirability of good design. the gollowing restrictions: Building Setbacks and Sideyard Restrictions - We would observe 2. Mr. Basse moved to refer this entire matter to Planning Consultant Mangiamele for review, evaluation and report at the next meeting. Ald. Foldy seconded the motion and the motion carried. have legal opinions available at the next meeting. In answer to Mr. Lawent, Mayor Gottfried advised that he will ANDREW SCHOPP - Mr. & Mrs. Andrew Schopp, Wind Lake, appeared seeking approval of a sketch for a three acre division of the Elsie Pellmann property in Section 26. It was noted by the Commission that the area is in an Agriculture District and requirement is for three acres with 300' average lot width, this lot in accordance with these requirements. Ald. Burgermeister moved to approve the sketch as submitted and that the Commission will be receptive to a preliminary plat. Mr. Raimann seconded the motion and the motion carried. Zoning Officer Lee suggested that the Schopps contact his office for information on the soils in that area and the suitability for a private sewage disposal system. SALEKSINE - The Commission reviewed plans for an accessory building to be located on Tess Corners Road for a new and used car reconditioning stall in conjunction with the exis- ting sales and service building. It was noted by the Commission that the plans had been prepared by DeQuardo, Robinson & Crouch Conditional Use Grant $46. July 28, 1970, and that this business is operating under two weeks and to refer same to Planning Consultant Mangiamele for study and recommendation. Mr. Buehler seconded the motion and the motion carried. Ald. Burgermeister moved to defer action on this request for ROBERT SMART - The Commission reviewed a sketch from Robert Smart, S64 W19097 School Drive, to divide a one acre parcel in half. It was noted by the Commission that this area is intended for sewer in the near future and that the lots as proposed will meet the requirement for the RS-3 OED District and will be compatible with existing lots in the area. that the Commission will be receptive to a certified survey map. Ald. Burgermeister seconded the motion and the motion carried. Mr. Raimann moved to approve the sketch as submitted and BETTY'S BEAmY BAR - The Commission reviewed a request from Mrs. Ray Wojtczak, S79 W18841 Janesville Road, for a corner sign advertising "Betty's Beauty Bar". It was noted by the Commission that there is an existing sign at the driveway entrance advertising "Beauty Salon" which they had approved May 8, 1969. explicitly for the 00s District, however, the sign height is Zoning Officer Lee reported that there are no sign regulations limited to 2.5' because of its location on a vision corner. Basse seconded the motion and the motion carried. Mr. Beuhler moved to approve the sign as submitted. Mr. DOUGLAS FRANZEN - Ald. Burgermeister advised the Commission that kr. Franzen, who owns Lot 1, Block 24, Jewel Crest Subd. (W187 S6486 Diamond Drive) which is adjacent to Jensen Recreation Center desires to purchase a 45' x 110' strip of property.from the city to add to this existing 110' x 110' lot. Board has approved of the sale and it was noted by the Commission Ald. Burgermeister advised that the Park and Recreation that with this additional property, the lot will not be large enough in area to split in the future. that this piece of property be sold to Mr. Franzen. Mr. Raimann Ald. Burgermeister moved to recommend to the Common Council seconded the motion and the motion carri,ed. ZONING OFFICER'S REPORTS """""" JACK GLOCKNER'S JUNK LICENSE - Zoning Officer Lee advised that he has made an on-site inspection of Mr. Glockner's junking operation, S71 W13219 Tess Corners Drive, and that the operation complies with the conditions required in Section 12:08 of the Municipal Code with the exception of an 8' high fence. He advised that the area is adequately screened by a berm surrounding the roadside property, however, the berm needs some reconstruction. Page 6 - Plan Commission August 4, 1970 Mr. Glockner's Junk License be renewed subject to the condition that the berm be reconstructed. Ald. Burgermeister seconded the motion and the motion carried. Mr. Raimann moved to recommend to the Common Council that JOAN KOHNE'S JUNK LICENSE - Zoning Officer Lee advised that he has made an on-site inspection of Mrs. Kohne's junking operation, W200 S7203 Hi Y Drive, and-that the operation compiies wzth- the with the exception of the 8' high fence. He advised that this area requirements indicated in Section 12.08 of the Municipal Code is adequately screened by the natural terrain. Kohne's junk license be renewed.
