BUILDING INSPECTOR GERALD LEE AND PLAN CONSULTANT RUSSELL KNETZGER WERE ALSO PRESENT. ABSENT - CHARLES BUEHLER MINUTES - THE MINUTES OF THE PREVIOUS MEETING, JANUARY 2, 1960, WERE CORRECTED ON PAGE 3 UNDER THAT SECTION ENTITLED LIONS CLUB PARK, PUBLIC HEARING TO BE HELD FEBRUARY 6TH, 1968, RATHER THAN FEBRUARY 2ND AS SHOWN. THE MINUTES WERE APPROVED AS CORRECTED. PERSONAL APPEARANCES e JOHN LLOYD - MR. JOHN LLOYD, S75 /I4530 EASY ST., APPEARED AND SUBMITTED A SITE AND OPERATIONAL PLAN FOR LLOYD'S CAMPING TRAILERS, INC., PROPOSED FOR THE LINDNER-HARRIS BUILDING, S75 VI7461 JANESVILLE RD., WHICH FORMERLY HOUSED JEROME DRUGS. MR. LLOYD ADVISED THAT THIS BUSINESS WILL CONSIST OF RETAIL SALES OF CAMPING TRAILERS, CAMPING EQUIPMENT AND SPORTING GJOODS, AS WELL AS INCLUDE THE SEASONAL RENTAL OF CAMPING TRAILERS AND EQUIPMENT. HE FURTHER ADVISED THAT AN 8' WIDE X 7' HIGH OVERHEAD DOOR WILL BE INSTALLED IN THE REAR OF THE BUILDING TO FACILITATE MOVING THE CAMPERS INTO THE BUILDING FOR DISPLAY PURPOSES. IN ANSWER TO QUESTIONS FROM THE COMMISSION, MR. LLOYD ADVISED THAT RENTALS INVOLVED 25% OR LESS OF THE TOTAL BUSINESS, THAT HE HAD NO SPECIFIC PLANS FOR SIGNS AT THE PRESENT TIME, HOWEVER, TENTATIVE PLANS WERE FOR AN INSIDE WINDOW SIGN, THAT IT IS NOT HIS INTENTION TO SELL BAIT, BOATS OR GARDEN EQUIPMENT, BUT THAT POSSIBLY HE MAY SELL SNOWMOBILES, BUT THAT HE WOULD NOT OFFER A REPAIR SERVICE FOR SAME, THAT PROTECTIVE COVERINGS FOR THE TRAILERS SUCH AS AWNINGS, ETC., WOULD NOT BE NECESSARY. HE INDICATED THAT IT IS HIS INTENTION TO DISPLAY ONE CAMPER IN THE FRONT OF THE BUILDING AND TO PARK APPROXIMATELY 9 CAMPERS IN THE REAR. MR. LLOYD POINTED OUT THAT HIS LEASE PROHIBITED THE a PARKING OF MORE THAN ONE CAMPER IN THE FRONT OF THE BUILDING. MR. CHASE MOVED TO APPROVE THE SITE AND OPERATIONAL PLAN FOR A RETAIL SPORTING GOODS STORE WHICH INCLUDES PROVISIONS FOR RENTING CAMPING TRAILERS SUBJECT TO THE CONDITION THAT THE NUMBER OF TRAILERS BE LIMITED TO 15, ONE OF WHICH MAY BE PAGE 2 - PLAN COMM. DAVE COUTURE, AGENT FOR LESLIE ABEL, WHO DESIRES TO PURCHASE IDLE ISLE, APPEARED TO LITTLE MUSKEGO LAKE EVEN THOUGH THE COMMISSION HAD RECOMMENDED REVIEW THEIR PROPOSAL FOR THIS ISLAND AT THE NORTH END OF DENIAL OF THIS REQUEST TO REZONE FOR THE PURPOSE OF A MOBILE HOME PARK. MR. BEIERLE REFERRED TO THE FOLLOWING COMMUNICATION DATED JANUARY 0, 1960, WHICH HAD BEEN DIRECTED TO THE RECORDING SECRETARY: I1 DEAR MRS. SANDS: I AM WRITING IN REPLY TO YOUR LETTER OF DECEMBER 29, 1967, ADVISING ME THAT IT IS THE RECOMMENDATION OF THE CITY OF MUSKEGO PLAN COMMISSION, THAT MY REQUEST AS AGENT FOR MARY KILLA, TO REZONE IDLE ISLE BEACH (A 7f ACRE ISLAND AT THE EXTREME NORTH LIMITS OF LITTLE MUSKEGO LAKE) TO RSM AND AMENDMENT OF MUNICIPAL ORDINANCE TO PERMIT DEVELOPMENT, OPERATION, AND HABITATION OF A MOBILE HOME PARK ON THIS PROPERTY BE DENIED. As YOU WILL RECALL, IN MID-NOVEMBER OF 1967, MR. DAVID COUTURE OF THE DEVELOPMENT CORPORATION OF AMERICA, APPEARED (As CO-BROKER IN MY BEHALF AS AGENT FOR MARY KILLA AT THE REQUEST OF HIS BUYER, MR. LESLIE ABEL) BEFORE THE PLAN COM- MISSION ON AN INFORMAL BASIS, TO ASK FOR A GENERAL INDICATION OF THE FEELING OF THE MEMBERS OF THE COMMISSION AS TO WHETHER WHAT WE AT THAT POINT INTENDED TO FORMALLY PETITION FOR HAD IN THEIR CONSIDERED OPINION ANY MERIT. MR. COUTURE EXPLAINED AT THAT TIME THAT WE WERE NOT ASKING FOR A FORMAL RULING, BUT ONLY AN INFORMAL INDICATION ON THEIR PART AS A BODY, WHETHER TO, IN FACT, SUBMIT A FORMAL PETITION MOULD BE AT ALL LOGICAL. MR. COUTURE WAS ADVISED BY THE COMMISSION AT THAT TIME THAT THEY COULD MAKE NO INDICATION WHATSOEVER OR EVEN DISCUSS THE MATTER UNTIL THEY WERE IN RECEIPT OF A FORMAL PETITION. MR. COUTURE ORIGINALLY APPEARED AT MY SUGGESTION ON AN INFORMAL BASIS, BECAUSE IT HAS BEEN THE PRACTICE AT TIMES IN OTHER MUNICIPALITIES TO REQUEST AN INFORMAL APPEARANCE PRIOR TO SUBMISSION OF A FORMAL REQUEST, SO THAT IN THE EVENT A POTENTIAL REQUEST IS ABSOLUTELY A TECHNICAL IMPOSSIBILITY, MUCH TIME Is SAVED BOTH BY THE COMMISSION AND THE PETITIONER. I SUBSEQUENTLY, IN VIEW OF THE FOREGOING, FORMALLY PETITIONED THE COMMISSION FOR THE ABOVE MENTIONED ZONING @I CHANGES. WHEN I APPEARED BEFORE THE COMMISSION ON DECEMBER 5, 1967, MAYOR GOTTFRIED, THE CHAIRMAN, ADVISED ME THAT IT WOULD NOT BE NECESSARY TO APPEAR, SINCE THE PUBLIC HEARING HAD BEEN SCHEDULED FOR JANUARY 9, 1960, AND THAT THE COMMISSION WAS PAGE 3 - PLAN COMM. JANUARY 16, 1960 NOT INTERESTED IN A PRESENTATION AT THAT TIME AS IT WOULD MAKE NO DECISION OR RECOMMENDATION UNTIL AFTER THE PUBLIC HEARING. REGARDING THE ABOVE, THE FOLLOWING IS A QUOTE FROM THE MINUTES OF THE PLAN COMMISSION MEETING OF DECEMBER 5, 1967, - - "IT WAS THE COMMISSION'S DECISION TO DEFER ACTION ON THIS PETITION UNTIL AFTER THE PUBLIC HEARING AND RECOMMENDATION OF THE CITY PLANNER. - ON DECEMBER 30, 1967, I RECEIVED YOUR LETTER OF DECEMBER 29, 1967, ADVISING ME THAT THEY, IN FACT, DID NOT DEFER ACTION AND WOULD RECOMMEND DENIAL ON BOTH REQUESTS. IT WOULD SEEM TO ME THAT THE COMMISSION BY TAKING THE ACTION DESCRIBED IN YOUR LETTER, HAS MADE THEIR RECOMMENDATION TOTALLY WITHOUT AFFORDING US AN OPPORTUNITY TO PRESENT THE PERTINENT FACTS IW THIS REQUEST. 10 DOUBT, THIS WAS DONE UNINTENTIONALLY AND THEY HAVE OVERLOOKED THE FACT THAT WE, UP TO THIS TIME, HAVE MADE NO PRESENTATION TO THEIR BODY. JUST PRIOR TO THIS REGULAR PLAN COMMISSION MEETING. MAYOR GOTTFRIED REPORTED THAT THE COMMITTEE HAD CONCURRED ON THE FOLLOWING POLICIES: I. THAT THE PETITIONER SUBMIT A SITE PLAN INDICATING THE AREA IN WHICH THE VEHICLE WILL BE PARKED. 2. IN AGRICULTURE A REAS ONE TRUCK WILL BE PERMITTED UNLESS FACILITIES ARE AVAILABLE TO ENCLOSE ADDITIONAL TRUCKS OR EQUIPMENT. IN RESIDENTIAL AREAS ONLY ONE TRUCK WILL BE PERMITTED. 3.
