BUILDING INSPECTOR LEE WAS ALSO PRESENT. MINUTES: THE MINUTES OF THE PREVIOUS MEETING, BOVEMBER 7, 1967, WERE APPROVED AS MAILED. PERSONAL APPEARANCES: STANLEY DOBRZYNSKI & THOMAS DAHLMAN - TRUCK PARKING MR. & MRS. DOBRZYNSKI, Wl52 S8901 THODE DR., APPEARED SEEKING APPROVAL TO PARK A COMMERCIAL TRUCK AT THEIR RESIDENCE IN SEC. 35 (A-DISTRICT) IN ACCORDANCE WITH THE NEWLY CREATED SECTION 6. Ob (4) (G) 2 OF THE ZONING ORDINANCE. THE COMMISSION REVIEWED THE AREA IN QUESTION ON AERIAL 0 MAPS AND REVIEWED THE TOPOGRAPHICAL SKETCHES SUBMITTED BY THE DOBRZYNSKIS. IN ANSWER TO QUESTIONS FROM THE COMMISSION, MR. DOBRZYNSKI ADVISED THAT THE TRUCK IS A SEMI-TRAILER AND TRACTOR, THAT THE MATERIAL CARRIED IS FLAMMABLE, THAT HE USES THE TRUCK TO DRIVE BACK AND FORTH TO WORK, THAT THE TRUCK IS OWNED BY HIS EMPLOYER MILWAUKEE SOLVENTS & CHEMICALS, THAT HIS WORKING HOURS ARE BETWEEN 5: 00 A. M. AND I 0: 00 P. M. WHEN HE IS IN THE CITY, THAT NEIGHBORS HAVE NOT COMPLAINED DIRECTLY TO HIM, THAT HIS ROUTE OF TRAVEL FROM HOME IS THODE DR. TO HIWAY 36, THAT HE HAS WORKED FOR THIS COMPANY FOR 6 YEARS AND HAS BEEN PARKING HIS TRUCK AT THIS RESIDENCE FOR 6 YEARS. HE ALSO ADVISED THAT IT WOULD BE A HARDSHIP IF HE WERE NOT ALLOWED TO PARK THE TRUCK AT HIS HOME AS IT WOULD INVOLVE THE PURCHASE OF AN ADDITIONAL TO OBJECT TO THE PARKING OF THE TRUCK BECAUSE OF THE NOISE, POINTING OUT THAT THE TRUCK COMES IN AT ALL TIMES OF THE DAY OR NIGHT. IN ANSWER TO A QUESTION FROM MAYOR GOTTFRIED, MR. WIESELMANN ADVISED THAT HE HAS LIVED AT THIS ADDRESS FOR ALHOST 7 YEARS. MR. THOMAS DAHLMAN, W127 Sa901 N. MAPS AND REVIEWED THE TOPOGRAPHICAL SKETCHES SUBMITTED BY MR. DAHLMAN. IN ANSWER TO QUESTIONS FROM THE COMMISSION MR. DAHLMAN ADVISED THAT HE IS THE OWNER OF THIS THE COMMISSION REVIEWED THE AREA IN QUESTION ON AERIAL THAT IT IS FILLED WITH FUEL OIL WHEN PARKED, AND THATTHERE HAD BEEN NO COMPLAINTS FROM IMMEDIATE NEIGHBORS AS IT IS IN AN UNDEVELOPED AREA. BUILDING INSPECTOR LEE ADVISED THAT HE HAD BEEN THE COMPLAINING WITNESS ON SUMMONSES ISSUED TO MR. DOBRZYNSKI AND MR. DAHLMAN IN 1966 AND THAT THE DECISION OF THE COURT SUMMONSES HAD BEEN AGAIN ISSUED TO MR. DOBRZYNSKI AND MR. DAHLMAN TO APPEAR IN COURT DECEMBER 13, 1967, TO ANSWER TO HAD BEEN THAT THE TRUCKS BE MOVED. HE FURTHER ADVISED THAT THE SAME CHARGES OF PARKING COMMERCIAL TRUCKS IN A RESIDENTIAL AREA. THE RECORDING SECRETARY THEN READ ORDINANCE #74 WHICH HAD BEEN ADOPTED BY THE COMMON COUNCIL OCTOBER 24, 1967, CREATING THE FOLLOWING SECTION OF THE ZONING ORDINANCE: e l 'a "SEC. 6. 04 (4) (GI 2. PARKING OF ONE PANEL OR PICK-UP TRUCK ON THE OWNER'S - PREMISES SHALL BE PERMITTED IN ANY DISTRICT. (A) THE PLAN COMMISSION MAY PERMIT ADDITIONAL PARKING OF TRUCKS AND EQUIPMENT IN AN AGRICULTURAL DISTRICT. SAID PERMIT SHALL BE IN WRITING AND SHALL SET FORTH THE TERMS AND CONDITIONS OF THE PERMIT. (B) THE PLAN COMMISSION MAY ALSO PERMIT ADDITIONAL PARKING OF TRUCKS AND EQUIPMENT IN ANY OTHER DIS- TRICT IF, IN THEIR OPINION, THE AREA IS PREDOMIN- ANTLY UNDEVELOPED. SAID PERMIT SHALL BE IN WRITING AND SHALL SET FORTH THE TERMS AND CONDITIONS OF THE PERMIT BUT UNDER NO CIRCUMSTANCES SHALL THE TERM OF THE PERMIT BE IN EXCESS OF THREE YEARS FROM THE DATE OF ISSUE. SAID PERMIT MAY BE RENEWED FOR A LIKE PERIOD IF THE PLAN COMMISSION IS STILL OF THE OPINION AT THAT TIME THAT THE AREA IS PREDOMI- NANTLY UNDEVELOPED AND THAT SUCH PARKING WILL NOT HINDER THE PROPER DEVELOPMENT OF THE AREA. CHASE QUESTIONED HOW MANY SUCH..CASES MIGHT COME BEFORE THE COMMISSION AND BUILDING INSPECTOR LEE ADVISED THAT HE HAD THAT THEIR TRUCKS MUST BE PARKED ELSEWHERE. MR. CHASE EXPRESSED DIRECTED APPROXIMATELY 20 LETTERS TO RESIDENTS ADVISING THEM CONCERN THAT IN CARRYING OUT THIS PORTION OF THE ORDINANCE, PAGE 3 - PLAN COMM. NOVEMBER 21, 1967 THE COMMISSION WOULD BE DISCRIMINATING BETWEEN THOSE WHO COULD WAS MR. CHASE'S OPINION THAT THIS MATTER SHOULD BE REFERRED TO ATTORNEY HIPPENMEYER TO DETERMINE THE ADVISABILITY OF THIS ORDINANCE. IT WAS NOTED BY THE COMMISSION THAT WHEN THIS AMENDMENT TO THE ORDINANCE WAS BEING CONSIDERED, ATTORNEY HIPPENMEYER AND PLANNER KNETZGER HAD ADVISED AGAINST IT. OF HIS SECOND, MR. DEANGELIS. IN ORDER TO REFER THE MATTER TO ATTORNEY HIPPENMEYER FOR AN OPINION. MR. DEANGELIS SECONDED THE MOTION AND THE MOTION AND THOSE WHO COULD NOT PARK THEIR TRUCKS AT THEIR HOMES. IT MR. BERTRAM WITHDREW HIS MOTION TO DENY WITH THE CONSENT MR. CHASE THEN MOVED TO DEFER ACTION UNTIL THE NEXT MEETING CARRIED UNANIMOUSLY. MAYOR GOTTFRIED DIRECTED THAT JUDGE BERGEN BE ADVISED THAT THESE CASES ARE PENDING IN PLAN COMMISSION. WILFRED POSBRIG - MR. POSBRIG, W195 S10538 RACINE AYE., APPEARED SEEKING APPROVAL OF THE CERTIFIED SURVEY MAP FOR THIS 15.07 ACRE LAND DIVISION OF HIS PROPERTY IN THE 112 OF SEC. 32. THE COMMISSION REVIEWED THE CERTIFIED SURVEY MAP AS WELL AS A REPORT FROM THE CITY ENGINEER RECOMMENDING APPROVAL WITH WE DO NOT KNOW ITS INTENDED IMMEDIATE USE. THE PERCOLATION THE OPPOSITE. THE BUILDING INSPECTOR SHOULD CHECK SITE FOR SOIL APPROVAL. THE %RAINAGE DITCH STATUS SHOULD BE DETERMINED THE FOLLOWING SPECIAL COMMENT: AS THIS IS A 15 ACRE PARCEL I1 TESTS INDICATE GOOD SOILS, HOWEVER, THE SOILS MAPS INDICATE FOR FUTURE USE ALSO. MR. POSBRIG ADVISED THAT THE DRAINAGE DITCH IN QUESTION DRAINS INTO LAKE DENOON AND THAT THERE WOULD BE AN EASEMENT A FOR THIS DITCH. MAYOR GOTTFRIED POINTED OUT THAT IF THIS CITY TO GET AN EASEMENT. MR. BUEHLER MOVED TO APPROVE THE CERTIFIED SURVEY MAP. ALDERMAN LENTINI SECONDED THE MOTION AND THE MOTION CARRIED ACROSS THE DIVISION AS WELL AS ACROSS THE REMAINING PROPERTY 15.07 ACRE PARCEL WERE REDIVIDED, IT WOULD BE NECESSARY FOR THE UNANIMOUSLY. OTHER BUSINESS: RICHARD THODE - THE COMMISSION REVIEWED THE CERTIFIED SURVEY MAP FOR A 3.035 ACRE DIVISION OF THE MYRTLE THODE PROPERTY IN THE SW$ OF SEC. 26 WHICH HAD BEEN PREPARED BY WAUKESHA LAND SURVEYS AS WELL AS A REPORT FROM,,THE CITY ENGINEER WITH THE FOLLOWING SPECIAL COMMENT: NOTE: LOT LINES INTERSECT INDICATING NO LAKE FRONTAGE. ZONING IN AGRI- CULTURE DISTRICT REQUIRES 60,000 SQ. FT. AND 150' MINIMUM . WIDTH. THIS LOT IS IRREGULAR AND SHOULD MERIT FURTHER STUDY. THERE IS A QUESTION ON WETLAND AND FLOODPLAIN LOCATION ON ZONING MAP AS IT APPLIES HERE. DESCRIPTION IS SOMEWHAT CON- FUSING, SEE NOTES IN RED ON COPY RETURNED. 11 As THIS REPORT FROM THE CITY ENGINEER HAD BEEN FORWARDED PAGE 4 - PLAN COMM. NOVEMBER 21, 1967 TO SURVEYOR JOHNSON, IT WAS THE COMMISSION'S DECISION TO AWAIT HIS REPLY, MR. THODE TO BE so ADVISED. ADDITION TO PUBLIC WORKS BUILDING - THE COMMISSION REVIEWED THE PLANS FOR A PROPOSED ADDITION TO THE PUBLIC WORKS BUILDING WHICH IS LOCATED DIRECTLY BEHIND THE CITY HALL. MAYOR GOTTFRIED EXPLAINED THAT THE COST OF THE ADDITION WOULD BE APPROXIMATELY $53,000 AND THAT FOR AN ADDITIONAL $12,000 THE EXISTING BUILDING COULD BE BRICK VENEERED, MR. BERTRAM, HIGHWAY SUPERINTENDENT, ADVISED THAT THE HIGHWAY DEPARTMENT WAS PRESSED FOR ROOM AND THAT THIS 72' X 5b' ADDITION WOULD PROVIDE OFFICES AS WELL AS ADEQUATE SPACE FOR SHELTER FOR FOUR OR MORE VEHICLES. MR. CHASE EXPRESSED CONCE,RN AS. TO WHETHER OR NOT THIS BUILDING ADDITION WOULD SERVE FOR YEARS, IF THIS WOULD BE CONSIDERED IDEAL UNDER A LONG-RANGE PLAN AND THE AFFECT THE APPEARANCE OF THE BUILDING MIGHT HAVE ON THE PROPERTY TO THE REAR WHICH WILL PROBABLY BE DEVELOPED IN THE NEAR FUTURE. HAYOR GOTTFRIED POINTED OUT THAT THE PUBLIC WORKS COMMITTEE HAD CONSIDERED THAT THE COST OF BUILDING IN ANOTHER LOCATION WAS NOT WARRANTED, THAT THE INITIAL DISCUSSION HAD BEEN FOR A MUCH SMA.LLER ADDITION AND THAT THIS BUILDING WOULD BE ADEQUATE 0 FOR MANY YEARS. THERE WAS CONSIDERABLE DISCUSSION AS TO HOW THE PROPERTY OWNED BY THE CITY COULD BE UTILIZED IF THE CITY HALL BUILDING WERE MOVED. IN DIS'CUSSION OF WARD YARDS OR MORE THAN ONE CITY GARAGE LOCATION, MR. BERTRAM POINTED OUT THAT HE HAD DISCUSSED THIS WITH OTHER MUNICIPALITIES AND IT APPEARED THAT MORE THAN ONE LOCATION COULD CREATE PROBLEMS AS EVERYTHING WOULD HAVE TO BE DUPLICATED. MR. CHASE MOVED TO REFER THE PLANS FOR THE CITY GARAGE ADDITION TO PLANNER KNETZGER FOR CONSIDERATION UNDER A LOT LINE PERIMETERS. ALDERMAN LENTINI SECONDED THE MOTION AND LONG RANGE PLAN AND THAT A PLOT PLAN BE SUBMITTED SHOWING THE THE MOTION CARRIED UNANIMOUSLY. HI-Y RANCHES & HILLENDALE HEIGHTS SUBDIVISIONS - THE PUBLIC WORKS COMMITTEE HAD REFERRED TO THE PLAN COMMISSION THE CONDITION OF LOT 1, BLOCK D, HI-Y RANCHES AND LOTS 6, 7, & 0, BLOCK A, HILLENDALE HEIGHTS. MR. BERTRAM ADVISED THAT THE LOTS HAD BEEN STRIPPED OF TOP SOIL WHICH WAS CREATING A,. DRAINAGE PROBLEM, THAT IF THE TOP SOIL WAS RESTORED AND SEEDED, IT WOULD HELP TO ALLEVIATE THE PROBLEM. IT WAS NOTED BY THE COMMISSION THAT THE OWNERS OF THE LOTS IN QUESTION WERE AWARE OF THIS SITUATION. MR. BERTRAM MOVED TO REFER THIS PROBLEM TO CITY ATTORNEY HIPPENMEYER TO DETERMINE IF THERE Is A ZONING VIOLATION AND IF so, WHAT ACTION COULD BE TAKEN. MR. WHICH HAD BEEN PREPARED BY SURVEYOR STANLEY J. POTRYKUS. THE COMMISSION ALSO REVIEWED A REPORT FROM CITY ENGINEER RUEKERT RECOMMENDING APPROVAL WITH THE FOLLOWING SPECIAL COMMENT: II NOTE: AT THIS TIME THE CITY MAY WANT TO HAVE THE OWNER GIVE AN EASEMENT OR DEDICATI4)IN FOR CREATING A BETTER INTERSECTION BY CUTTING BACK CORNER. NOVEMBER 7TH, 1967, PLAN COMMISSION MEETING. MR. BERTRAM SECONDED THE MOTION AND THE MOTION CARRIED UNANIMOUSLY. MR. CHASE MOVED TO RECONSIDER THE MOTION MADE AT THE MR. CHASE MOVED TO RECOMMEND APPROVAL OF THE ANNEXATION AND THAT THE TEMPORARY ZONING BE CLASSIFIED AGRICULTURE, AND THAT THE PETITIONERS PAYNE & DOLAN BE REQUESTED TO SUBMIT A RESTORATION PLAN FOR THE ENTIRE GRAVEL OPERATION IF THE ANNEXATION IS APPROVED.
