PRESENT: MAYOR JEROME GOTTFRIED, CHAIRMAN, YILLIAM F. CHASE, SECRETARY, WILLARD BERTRAM AND CHARLES BUEHLER. ALSO PRESENT WERE BUILDING INSPECTOR GERALD LEE AND PLAN CONSULTANT RUSSELL KNETZGER. ED RAIMANN ARRIVED AT 0:12 P. M. AND ALDERMAN LENTINI ARRIVED AT 0:20 P. M. ABSENT: ROBERT GUMIENY MINUTES: THE MINUTES OF THE PREVIOUS MEETING, DECEMBER 6, 1966, AND OF THE SPECIAL MEETING OF DECEMBER 20, 1966, WERE APPROVED AS MAILED. Cm - THE COMMISSION REVIEWED THE REVISED CERTI- FIED SURVEY MAP AND PERCOLATION TESTS FOR THIS 2.5 ACRE LAND DIVISION IN THE NE$ OF SECTION 29. THE COITMURICATION FROM TO THE COMMISSION INDICATING DISCREPENCIES IN THE ORIGINAL CERTIFIED SURVEY MAP WHICH HAD BEEN SUBMITTED NOVEMBER ?ST, CITY ENGINEER FRANK RUEKERT DATED OCTOBER 31, 1966, DIRECTED 1966, WAS READ BY THE RECORDING SECRETARY. (THIS LETTER RECORDED IN THE PLAN COMMISSION HINUTES OF NOVEMBER 1, 1966. ) ON THE sk/ CORNER OF THE PARCEL HAD NOT BEEN RESERVED FOR IT WAS NOTED BY THE COMMISSION THAT THE TRIANGLE FRAGMENT ROAD OR PARK PURPOSES AS SUGGESTED BY CITY ENGINEER RUEKERT. PLANNER KNETZGER RECOMMENDED THAT THE PARKWAY THROUGH THE PARCEL SHOULD HAVE BEEN DEDICATED RATHER THAN RESERVED, HOWEVER, IF THE TRIANGLE MAS ADDED TO THE ROAD, HE WOULD RECOMMEND ACCEPTANCE OF THE RESERVATION. PLANNER KNETZGER SUGGESTED THAT THE SURVEY BE REFERRED TO CITY ENGINEER RUEKERT TO DETERMINE IF THE RESERVATION FOR THE TRIANGLE PIECE OF PROPERTY COULD BE INSCRIBED ON THE EXISTING SURVEY RATHER THAN NECESSITATING THE DRAFTING OF AN ENTIRELY NEW DOCUMENT. THE COMMISSION NOTED THAT THE PERCOLATION TESTS INDICATED GOOD SOIL ABSORPTION, HOWEVER, THERE WAS SOME DISCUSSION OF THE LEGALITY OF A MASTER PLUMBER MAKING THE PERCOLATION TFS TS . MR. CHASE MOVED TO REFER THE CERTIFIED SURVEY MAP TO @ CITY ENGINEER FRANK RUEKERT TO DETERMINE PROCEDURE TO RESERVE THE TRIANGLE. MR. BERTRAH SECONDED THE MOTION AND THE MOTION CARRIED UNANIMOUSLY. PAGE 2 - PLAN COMM. JANUARY 3, 1967 CHAIRMAN GOTTFRIED EXCUSED HIMSELF AT 0:30 P. M. AND RELINQUISHED THE CHAIR TO SECRETARY CHASE FOR THE BALANCE OF THE MEETING. JAMES HERNKE - MR. HERNKE DID NOT APPEAR NOR SUBMIT PROPOSAL TO CONPLY WITH CONDITIONAL USE CONDITIONS FOR JIM'S AUTO SERVICE, S73 W16600 JANESVILLE RD., IN ACCORDANCE WITH THE PLAN COMMISSION'S INSTRUCTIONS AT THEIR MEETING OF DECEMBER 6, 1966. MR. BUEHLER MOVED THAT A LETTER BE SENT TO MR. HERNKE ADVISING HIM TO MAKE AN APPEARANCE AT THE NEXT PLAN COMMISSION MEETING, JANUARY 17, 1967, AND SUBMIT A PROPOSAL TO COMPLY WITH C ONDITIONAL USE CONDITIONS. ALD. LENTINI SECONDED THE IT WAS THE COMMISSION'S DECISION THAT IF MR. HERNKE MOTION AND THE MOTION CARRIED UNANIMOUSLY. IGNORED THIS REQUEST, ACTION WOULD HAVE TO BE TAKEN BY THE COMMISSION. MRS. HATTIE STEFANIAK - THE COMMISSION REVIEWED THE DRIVEWAY EASEMENT BETWEEN MRS. HATTIE STEFANIAK AND LEONARD & MARY STEFANIAK GUARANTEEING SHARED USE OF AN EXISTING DRIVEWAY. THIS EASEMENT HAD BEEN REQUESTED BY THE COMMISSION AT THEIR MEETING NOVEMBER 15, 1966, PRIOR TO FINAL ACCEPTANCE OF THE CERTIFIED SURVEY MAP FOR THIS LAND DIBISION IN THE Nw$, SEC. 21. IT WAS NOTED BY THE COMNISSION THAT THE EASEMENT HAD BEEN DRAFTED AND RECORDED BY HALES CORNERS SAVINGS & LOAN Assoc. AND APPROVED BY CITY ENGINEER FRANK RUEKERT AS INDICATED IN THE FOLLOWING LETTER OF DECEMBER 30, 1966, DIRECTED TO THE COMNIS- SION: II GENTLENEN: WE HAVE REVIEWED THE CERTIFIED SURVEY PREPARED FOR MRS. HATTIE STEFANIAK WHICH WAS QUESTIONED FOR C.T.H. Y ACCESS. THE DESCRIPTION SUBMITTED TO us DECEMBER 19, 1966, HAS BEEN CHECKED AND INCLUDES AN EASEMENT ALONG THE 10' TO THE NORTH OF SAID PROPERTY. JANUARY 3, 1967 EXTRA TERRITORIAL PLAT JURISDICTION OF THE CITY OF MUSKEGO HAD NOT AS YET BEEN SUBKITTED, IT WAS THE COMMISSION’S JANUARY 17, 1967. DECISION THAT THIS ITEM BE TABLED UNTIL THE NEXT MEETING, PLANNER’S REPORTS RECOMMENDATION - ZONING CHANGE - IN ANSWER TO BUILDING INSPECTOR LEE ‘s COHMUNICATION OF NOVEKBER 11 TH, 1966, REGARDING POSSIBLE ZONING CHANGES IN SECTION 8.01 (7) B (PAGE 65) OF THE ZONING ORDINANCE, PLANNER KNETZGER RECOKMENDED THAT OF BUILDING AND SITE PLANS BY THE PLAN COHKISSION”. QUARTERS FOR EKPLOYEES AND GUEST HOUSES BE SUBJECT TO APPROVAL AFTER DISCUSSION, IT WAS THE COKMISSION’S OPINION THAT THIS It PORTION OF THE ORDINANCE COULD POSSIBLY BE CIRCUMVENTED AND MISCONSTRUED AND MR. CHASE KOVED TO SEND THE CHANGE TO THE CITY ATTORNEY REQUESTING HIS ADVISE ON THE PROPOSED CHANGE BUEHLER SECONDED THE MOTION AND THE MOTION CARRIED. AND THE VALIDITY OF THE PRESENT WORDING IN THE ORDINANCE. MR. MUSKEGO FREEWAY LOCATION - PLANNER KNETZGER REVIEWED THE PRELIMINARY LAYOUT OF THE FREEWAY SYSTEK PROPOSED FOR CONSTRUC- TION THROUGH MUSKEGO IN 1971 , REQUESTING PERKISSION TO NEGOTIATE FURTHER WITH THE HIWAY DEPT FOR THE TREATKENT OF THE FREEWAY INTERCHANGE SYSTEM ALONG MCSHANE ROAD. IT WAS THE COMMISSION’S DECISION TO GRANT PERKISSION FOR FURTHER NEGOTIATION WITH THE HIWAY DEPT. EXTENSION OF PLANNED SEVERED AREA - THE SEWER INTERCEPTOR SYSTEM AS PREPARED BY RUEKERT & I~IELKE FOR THE INDUSTRIAL STUDY WAS REVIEWED BY PLANNER KNETZGER. PLANNER KNETZGER ADVISED THAT IF THE COMMISSION DESIRED TO CHANGE ITS MIND AND HAVE A POTENTIAL UNSEWERED AREA AVAILABLE FOR SEWERS, THIS WOULD HAVE TO BE INDICATED TO THE ENGINEERS IN ORDER THAT THE INTERCEPTORS COULD BE PROPERLY SIZED, THIS DECISION TO BE MADE AT A LATER DATE. IlYDUSTRIAL STUDY - PLANNER KNETZGER ADVISED THAT THE INDUSTRIAL STUDY REPORT WOULD BE READY SOON. MYLmAR ZONING MAP - PLANNER KNETZGER ADVISED THAT HE HAS THE HYLNAR ZONING HAP IN HIS POSSESSION, THAT IT WILL BE RETURNED TO CITY HALL AS SOON AS HE HAS THE CORRECT LEGAL DESCRIPTION OF THE BEIERLE PROPERTY TO MAKE THE NECESSARY ZONING CHANGE.
