PCM19660621CITY PLAN COMMISSION - CITY OF MUSKEG0 - MINUTES OF MEETING HELD on June 21, 1966 at the City Hall. * Chairman Gottfried called the meeting to order at 8:04 P.M. UPON ROLE - Members present were Gottfried, Chase, Buehler, Bertram, Dahlen, Lentini and Raiman. Also present were Gerald Lee and Planner ALL Knetzger. Mr. Knetzger arrived at- 8:15 P.M. MINUTES - Mr. Chase moved to defer action on the approval of minutes of June 7, 1966 until the planner was present, motion seconded by Mr. Lentini and it carried. DONALD MARZEC - Mr. Marzec, W150 S7693 Dorothy Dr., Hales Corners, Wis., appeared seeking approval of the commission for swimming pool screen- plot sketch showing all intended plantings, pool in relationship to ing in accordance with Sec. 6.06 7-D. Mr. Marzec submitted a proposed location of residence, etc. The pool shall be 4' deep, 21' in diameter with sun deck, 4' high rough cedar fencing and plastic cover for pool. HENRY PANKAU - Henry Pa.nkau of W190 S7602 Prospect Dr., Muskego, Wis., presented for approval a sketch of landscape treatment for his portable basket weave type fence. Because of its portable nature they will take 4' pool, 15' in diameter, plastic cover for protection and an intended the pool if they should ever move. CARL WOJNOWSKI - Mr. Wojnowski of S75 W15002 Kathryn Dr., Muskego also appeared seeking approval of a 4 x 21' pool. Since he did not submit a planned sketch he explained his plans as follows. Prior to receipt of letter from Insp. Lee he planned on erecting a fence on top for a sun deck, treat the south lot line with shrubs. He further stated that if he had to erect a fence he would move it closer to the garage and family room. The chair explained that the commission was more con- cerned about esthetic values as 6.06 7-D requires. GERALD MATTKE - (Please refer to minutes of 6-7-66. Mr. Mattke did not appear, the board thus referring to above minutes) Motion was made by Mr. Dahlen that the Plan Commission accept the land scaping proposals for the four swimming pools as submitted of the following persons, Donald Marzec, Henry Pankau, Carl Wojnowski and Gerald Mattke, motion seconded by Mr. Lentini, motion carried. In discussing Sec. 6.06 (7) of the Zoning Ordinance the Plan Commission took the following action. Mr. Dahlen moved, as seconded by Mr. Buehler, that recommendation be made to the Common Council that Sec. 6.06 7-D be amended so as to insert the word "permanent" before the word "Pool". Motion carried. WALTER HEINRICH - Mr. Heinrich appeared with his surveyor, D. Polzin seeking approval of preliminary plat. Mr. Heinrich wishes to divide Commission was concerned about the 60' road easement as it is in its 2 acres from the farm itself thus creating an independent parcel. The present location. Since the road is in the area of several farm build- would not wish to move these buildings because of expense. The proposed ings removal would be necessary someday. Mr. Heinrich stated that he roadway was so located so 'as to follow the existing gravel roadway and according to Mr. Polzin, someday when more land is divided the roadbed could be relocated to the north. Until then the road would serve existing buildings and the new building as an easement. 4 -2- Question arose as to why the two acre division did not abutt thejhake- shore and Mr. Polzin stated that they did not wish to involve the existing cottage and boathouse. The planner was concerned with the narrow strip of land left in between the waters edge and the proposed parcel. Mr. Lee's concern was that he could not issue a permit due to his inability to determine whether they would comply to the zoning. Planner Knetzger referred to Sec. 8.19 (7) D and 4.07 (4). Mr. Buehler moved that tentative approval of Mr. Heinrich's preliminary proposed 2 acres to a public road and presentation of further information plot be granted subject to presentation of an easement for access by the west of the division. Mr. Dahlen seconded the motion and the motion on the exact location of the present property line along the lake shore, carried. CRONIN SOD FARM - Joseph Cronin of S103 W13991 Loomis Dr., Hales Corners, Wis., appeared seeking approval of a pond, 325 x 230', which, according to him, was created about 15 years ago and it is his intention to utilize the reservoir of water for sod cultivation. The Plan Commission advised him that proper drawings should be submitted and may be done by top0 tracings which are available at the City Hall. WILFRED POSBRIG - Mr. Posbrig Of W195 S10538 Racine Ave., submitted a preliminary plat for a division of land in Sec. 32, measuring 330 x 250'. The plot would be located approximately 100 rods from John Posbrig or immediately adjacent to the Keiser property. Mr. Dahlen moved that the Commission acceDt the Dreliminarv plat Of Wilfred Posbrig as presented, Mr. Bertram'seconded the motion and the motlon carried. LESLIE CONSTANTINEAU - The Certified Survey Map of Leslie Constantineau, proposed division of two parcels on the SEk, Sec. 24. Refer to minutes S94 W12772 Ryan Dr., Hales Corners, Wis., was presented. Said map of 6-7-66. Mr. Dahlen moved that the Certified Survey Map as presented by Leslie Constantineau be approved as submitted, Mr. Buehler seconded the motion and the motion carried. CHECKERWAY CHARTER COACH CO., INC. - Mr. David L. Snyder appeared in behalf of the bus comoanv. The Recording Secretary read the following ._ communication directed to the Plan Commission and hated 6-20-66 as to- the proposed site and operational plan: Gentlemen: for your approval of the following addition and changes to our operational x 10 ft. overhead door in the front or south side of the garage with site located at S83 W20702 Janesville Rd. Replace the present 12 ft. two (2) 12 ft. x 12 ft. overhead doors and add two (2) 12' x 12' overhead doors to the rear (north) side of building to make a drive thru garage. Add a garage stall approximately 14 ft. wide by 40 ft. long to the west side of our present garage with 12 ft. x 12 ft. doors on either end to provide additional maintenance facilities. Properly surface and use an area of approximately 20,000 sq. ft. directly north of and ad- number previously authorized. This site is leased from the Muskego- lacent to our existing site for the parking of buses in excess of 'the Norway School District for this purpose. The company has had 30 buses in the past, but will extend their services to 50 and all repairing done in the garage will be confined to their own buses. Referral was made to previous. planting requirements set forth as part of the Conditional Grant. Mr. Snyder stated that the screening had been completed. Mr. Dahlen moved that action be deferred on the approval of the Checkerway Upon recommendation of the Planner the following action was taken: Charter Coach Bus Lines operation and site plans as requested until the next meeting to give the Building Inspector time to inspect the area and report back to the Commission. Mr. Raimann seconded the motion and the motion carried. PAYNE E DOLAN OF WISCONSIN, INC. - Mr. William Bechthold of 1226 W. Wisconsin Ave., Milwaukee, asked permission to operate a portable asphalt plant in Sec. 18. Said accessory use permit would be to the extractive operation of State Sand E Gravel, Inc. Mr. Bechthold stated that they would need it for not more than 2 months, the plant would be located down in the pit, the 4-ton plant is two years old producing 1% yards perminute. The question was raised as to its proximity to Crowbar Rd. and he answered - just east of the line. STATE SAND E GRAVEL, INC. - Mr. Chase moved that the Conditional Use Grant for the purpose of an extractive operation for State Sand E Gravel, Inc., Sec. 18, be approved as presented, said permit to be issued for a period of one year. Mr. Lentini seconded the motion and the motion carried. TEXACO, INC. - In accordance with the Planner's report of 4-19-66, Texaco, Inc., has resubmitted new plans for an automobile service station the corner of Tess Corners Dr. and Hiway 24. Accordingly the following motion was made bq Mr. Buehler - A public hearing be set for July 19, Bertram and motion carried. The petitioner shall be notified that 1966, 8 P. M., in behalf of Texaco, Inc., motion seconded by Mr. a new petition must be submitted. JOHN SCHAEFER - The Recording Secretary read the report received from Building Inspector Lee as follows: on the channel near the Bass Bay Sportsman's Clubhouse. This dam is An inspection was made on June 14, 1966, of the dam constructed 13" wide and 12' long, extending from bank to bank. The top of the dam is 4%'' above the dam located at the south end of Big Muskego Lake. It is 5" above the bottom of the culvert which crosses Durham Drive. The dam is constructed of re-enforced concrete. On June 17, 1966, water was being pumped at a rate of 1,000 gallons per minute. On June 18, 1966, one of the representatives of the State Conservation Dept. supervised the seining and removal of the fish which had gotten into the pond during high water this past spring. There were about 1,000 fish, none over 3" long, and one bullhead in the pond. Most bluegills. There will be a screen constructed on top of the dam in order to prevent any fish from getting into this pond when water is at a level higher than that of the dam. There was estimated to be two feet of water left in the pond and water from the ground level running into it came through gravel veins at the 4' depth. Most of this water was coming in from the east side of the pond and very little was coming from the direction of the lake. Because this is dug in silty and loamy soil and is underlain by sand the water is conducted through this sand from the which are poor conductors of water. east. The soil on the west side is of muck, silt and loam deposits, This pond should capture many of the nutrients which, in the past, have passed directly into the lake therefore making it more de- sirable to have this basin surface water directed into the pond. The total water area in Bass Bay and Big Muskego Lake totals 2,177 acres. The Schaefer's holdings east of Durham Drive are about 50 acres. In order to lower this lake 1/4", 11 inches of water must be used on the entire 50 acres. This pond holds approximately 1,200,000 gallons of water. COMMUNICATIONS The clerk read the two communications received from Hales Corners Sand and Gravel for extractive purposes, one being a renewal of a Conditional Use Grant, on pt of the SEk, Section 12, (72.51 acres of land more or less) and the other, shall a Conditional Use Grant be a- warded to Hales Corners Sand and Gravel for extractive purposes , the Ernst Bluhm property, Section 12 (20 acres more or less). Mr. Chase moved, as seconded by Mr. Dahlen, that public hearings be set in accordance with petitions submitted, for July 19, 1966, 7:OO PM, (Bluhm Property) and July 19, 1966, 7:30 PM, Hales Corners Sand and Gravel. Mr. Raiman requested that a little history be given regarding previous meetings regarding the asphalt plant operation. He further explained permits issued, etc. Mr. Buehler read excerpts of minutes of previous that he had no objection to the extractive operation, but did feel that due to the great impact on the adjacent residential community, odors, smoke, and other objectionable factors that it did result in a that the plant relocate in an industrial area. According to Mr. Buehler the original permit was issued seven years ago and was issued on the petitioners request that the plant was portable and would be temporary in nature. Again, Mr. Buehler stated that he felt the plant should be relocated. Mr. Bertram stated that even though he does not live as close to the plant as Mr. Buehler did, he would disagree with his statements. Mr. Raiman stated that if this was a temporary thing he did not think this man should be permitted to expand. Mr. Buehler moved that recommendation be made to the Common Council of the City of Muskego that the Accessory Use Permit, for the operation of an asphalt plant to the extractive operation of Gravel Inc., be denied for the following reasons. _. -. 1 i .. \. . 1.. -Th$,.?.ccessory use operation is i?..violation~--of= Sec. 4105 1-A mi - . . . __ ." . , ..~. . .. - -. ~. FORREST PERKINS - On June 7, 1966 action to recommend to grant or deny petitioner's request for rezoning two parcels in Section 4 was deferred until 6/21/66. The pros and cons of developing the 10 acre parcel asL petitioned was discussed by the commission. The Chair reminded the pN/, Board of the importance of concern as to type of development. He also asked the petitioner whether they would be willing to withdraw the re- r quest to erect a filling station and Nr. Perkins said yes, but that he7-E.I/ would have to ask his other two partners. One Board member felt that business development on this corner would be most compatable with the grocery stores, drive-in and beer depot. Another member felt that surrounding businesses, namely, a barber shop, filling station, two this should not be rezoned until bonifide leases were ready so as to ascertain type of development. Mr. Perkins mentioned that moving this other member mentioned that they would rather see business buildings station to another area, such as New Berlin, wBuld be no problem. Mr. Chase moved, as seconded by Mr. Lentini, that recommendation be made to the Common Council that the request of Forrest B-1 and the other RS-2 to RSM be approved. Motion not passed. Mr. Len- Perkins for rezoning of two parcels of land in Section 4, one RS-2 to tini moved, as seconded by Mr. Bertram, that recommedation be made to the Council that action be initiated to rezone the 10 acres owned by Mr. John Victor, from RS-2 to 8-2 Local Service Center plus the area contained in the B-1 bounded by Martin and Topaz Drives, west to Coll- ege and Gold Drive. Motion carried Mr. Chase moved that the City Plan Commission enter into a contract with Max E. Anderson Assoc., to make the preliminary study of urban re- newal needs and necessary application thereof, fee not to exceed $1,000.00. Motion seconded by Mr. Dahlen, motion carried. Mr. Chase moved that the Plan Commission recommend to the Common Coun- cil that the Zoning Ordinance of the City of Muskego be amended to in- clude the "Official Conditional Grant Form", and as such be registered in the Register of Deeds Office in Waukesha County, costs to be assumed by the petitioner. Motion seconded by Mr. Buehler, motion carried.
