RUSSELL KNETZGER, CONSULTANT, AND GERALD LEE, BUILDING INSPECTOR, WERE ALSO PRESENT. MINUTES: PLANNER KNETZGER AMENDED THE HINUTES OF MARCH IST ON PAGE 1 UNDER PORTION TITLED JOHN PETERS, TO INCLUDE THE FOLLOWING: PLANNER KNETZGER RECOMMENDED THAT THE CONDITIONAL 11 USE NOT BE GRANTED. rl THE MINUTES WERE APPROVED AS AMENDED. WALTER GEIBEL - MR. GEIBEL, Y190 s7272 LOCHCREST BLVD,, APPEARED BEFORE THE CONMISSION REGARDING A PENDING LAND DIVISION ON LOCHCREST BLVD. IN SECTION 0 AND PRESENTED PLOT PLANS OF THE PROPOSED DIVISION FOR THE CONMISSION'S REVIEW. CONCERNING THE GEIBEL DIVISION FROM PREVIOUS PLAN CONMISSION THE RECORDING SECRETARY READ THAT PORTION OF THE MINUTES MINUTES OF JANUARY 27, 1964, APRIL 14, 1964, MAY 25, 1964, AND OCTOBER 1, 1964. SUCCESSFULLY WITH MR. ZREHSKI AND MR. BERINGER IN AN ATTENPT AND MR. BERINGER HAVE TWO SMALL PARCELS, EACH HAVING A GARAGE ON IT, IN THE NORTHEAST CORNER OF LOT 14 WHICH WOULD ALSO HAVE TO BE INVOLVED IN THE WIDENING OF LOCHCREST BLVD. 1 MR. GEIBEL POINTED OUT THAT A STANDARD 60' ROADWAY WAS BADLY NEEDED; THAT THE COMMISSION REVIEWED THE SECTION MAP AND DISCUSSED THERE WAS SOME %ISCUSSION OF CONDEMNATION PROCEDURES, BUT MR. GEIBEL INDICATED THAT HE HAD BEEN UNABLE TO NEGOTIATE TO GAIN 60' ROADWAY FOR THIS PROPOSED DIVISION. (MR. ZREMSKI DRAINAGE FROM THE SUBDIVISION ABOVE WAS A PROBLEM. DRAINAGE POSSIBILITIES. THE QUESTION AROSE, CAN YOU PROCEED BY STATE STATUTE FOR DEDI- CATION WHEN THERE IS NOT A LAND-LOCKED PARCEL. (AS THIS IS NOT A RECORDED DIVISION, A LAND-LOCKED PARCEL DOES NOT ACTUALLY EXIST AS YET. ATTORNEY AND MR. GEIBLE WAS ADVISED THAT HE WOULD BE NOTIFIED. II ' IT WAS THE COMMISSION'S DECISION TO CONFER WITH THE FORREST &f. .PERKINS - MR. PERKINS, W179 S6711 MUSKEGO DRIVE, APPEARED TO DISCUSS PLAN DEVELOPMENT FOR THE CORNER OF COLLEGE AND MARTIN DRIVES IN SECTION 4 AND PRESENTED A SECTION MAP, A PLOT PLAN FOR A PROPOSED AUTOMOBILE SERVICE STATION, AND PLANS FOR 2 TWELVE UNIT APARTMENT BUILDINGS. MAYOR GOTTFRIED POINTED OUT THAT THERE WAS NO PROVISION IN OUR ZONING ORDINANCE FOR MULTIPLE-FAMILY UNITS UNTIL PUBLIC SEWERS WERE INSTALLED,' THAT IT WOULD REQUIRE A CHANGE IN THE TEXT OF THE ORDINANCE EVEN FOR CONSIDERATION. PLANNER KNETZGER POINTED OUT THAT THE INTERSECTION OF MARTIN AND COLLEGE DRIVES CREATED A TRAFFIC PROBLEM AND IF ANY CONSIDERA- TION WOULD BE GIVEN TO THIS PROPOSED DEVELOPMENT A LONG-RANGE LOOK SHOULD BE TAKEN OF THIS CORNER WITH REDESIGNING IN MIND WHICH WOULD INVOLVE THE CITIES OF MUSKEGO, NEW BERLIN, STATE HIWAY COMMISSION AND COUNTY HIGHWAY DEPARTMENT. HE ADVISED THE COMMISSION THAT IT WOULD BE UNWISE TO ENCOURAGE NEW BUSINESS IN THIS AREA AS IT IS NOW. MR. PERKINS WAS ADVISED THAT IF HE WANTED TO MOVE AHEAD WITH HIS PLANS FOR A SERVICE STATION, THE FIRST STEP WOULD BE TO PETITION FOR A REZONING. IT WAS PLANNER KNETZGER'S OPINION THAT IN THE EVENT MR. PERKINS DESIRED TO PETITION FOR REZONING, THE B-1 ZONING WOULD BE DESIRABLE AS IT WOULD BE COMPATIBLE WITH THE ADJACENT AREA; NEXT STEP BEING TO PETITION FOR A CONDITIONAL USE FOR THE SERVICE STATION. E. J. SALENTINE - THE COMMISSION RECEIVED A PETITION FOR Ex- PANSION OF CONDITIONAL USE FROM E. J. SALENTINE FOR AN ADDITION TO HIS AUTOMOBILE BODY SHOP, S66 WI458O JANESVILLE ROAD, SEC. 2. MR. BUEHLER MOVED THAT A PUBLIC HEARING TO CONSIDER THE PETITION OF E. J. SALENTINE FOR EXPANSION OF CONDITIONAL USE BE HELD APRIL 19TH AT 7:3O P. M. MR. WALRATH SECONDED THE MOTION AND IT CARRIED. VALLEY DRIVE REZONING - PLANNER KNETZGER RECOMMENDED THAT THIS PETITION FOR REZONING THE RSM DISTRICT IN SECTION 9 ALONG VALLEY SOUTH. HE ADVISED THAT THIS AREA HAD BEEN ZONED RSM BECAUSE IT FOR URBAN RENEWAL, ESPECIALLY ALONG HIWAY 24. PETITION INCLUDED ALL OF THE RSM ZONED AREA IN SECTION 9 ALONG COMMISSION RECOMMEND TO THE COMMON COUNCIL THAT ALL OF THE AREA ZONED RSM AS INDICATED ON THE ZONING DISTRICT MAP IN SECTION 9 ALONG VALLEY DRIVE BE RE-ZONED TO RS-3 WITH AN OED OVERLAY. DRIVE TO RS-3 BE GRANTED BUT ONLY FROM THE BASELER PROPERTY WAS AN IDEAL AREA FOR MULTIPLE FAMILY AND WAS EVENTUALLY SLATED AFTER CONSIDERABLE DISCUSSION AND DETERMINATION THAT THE VALLEY DaIvE AND HIWAY 24, MR. BUEHLER MOVED THAT THE PLAN I. MR. BERTRAM SECONDED THE MOTION AND THE MOTION CARRIED. PLkNNER'S REPORTS WITH PLANNER KNETZGER ADVISED THAT HE HAD NOT AS YET CONFERRED PLANNER KNETZGER SUBMITTED A FORM FOR THE COMMISSION'S SEWRPC RELATIVE TO THEIR EVALUATION OF SOILS. REVIEW WHICH COULD BE USED FOR RECORDING CONDITIONAL USE QRANTS. IT WAS THE COMMISSION'S DECISION THAT THIS FORM BE REFERRED TO CITY ATTORNEY HIPPENMEYER FOR APPROVAL. JOHNNY'S PETROLIUM PROD. - JUILDING INSPECTOR LEE ADVISED THAT JOHNNY STRASSER HAD REQUESTED PERMISSION TO INSTALL A PUMP TO A DIESEL FUEL OIL PUMP AT HIS SERVICE STATION, S76 10,000 GALLON FUEL TANK WHICH WOULD INVOLVE CONVERTING A GAS W17871 JANESVILLE ROAD, TO ACCOMODATE HIS TRUCK PATRONS AS MANY TRUCKS WERE CONVERTING TO DIESEL POWER. AFTER CONSIDERABLE DISCUSSION IT WAS THE OPINION OF THE COMMISSION THAT SINCE THIS CHANGE WOULD NOT AFFECT THE APPEAR- EXPANSION OF THE PRESENT CONDITIONAL USE HELD BY I~R. STRASSER, ANCE OF THE SERVICE STATION AND WOULD NOT INVOLVE A MAJOR A PUBLIC HEARING WOULD NOT BE NECESSARY, PARTICULARLY SINCE THE ADDITIONAL TANK WOULD NOT CREATE A CONSIDERABLE INCREASE IN THE NUHBER OF TRUCKS USING THE SERVICE STATION. MR. BUDISH HOVED THAT THE BUILDING INSPECTOR BE AUTHORIZED TO ISSUE A PERMIT TO JOHNNY STRASSER FOR THE PURPOSE OF IN- STALLINQ A ~O,OOO GALLON DIESEL FUEL TANK UNDERGROUND. MR. BERTRAN SECONDED THE NOTION AND IT CARRIED. COMMUNICATIONS - THE RECORDING SECRETARY READ THE FOLLOWING LETTER DIRECTED TO MERLE HANPE IN REPLY TO HIS LETTER CONCERNING THE APPROVAL OF THE CONDITIONAL USE GRANT FOR RICHARD MAURICE. HAMPE: YOUR LETTER OF FEBRUARY 16, 1966, TO THE COMMON COUNCIL OF THE CITY OF MUSKEGO HAS BEEN REFERRED TO THE CITY PLAN COMMISSION SINCE THEY WERE THE BODY THAT GRANTED THE CONDI- TIONAL USE ON VALLEY DRIVE. WITHIN THE ZONING ORDINANCE THE CONDITIONAL USE WAS CREATED TO TAKE CARE OF TION OF THE ZONING ORDINANCE. THE PURPOSE OF THE CONDITIONAL THE INDIVIDUAL AND AT THE SANE TIME GIVE THE PLAN COMMISSION FUNCTIONS FIRST, TO GIVE SOME IMPLEKENTATION TO THE COX- THOSE UNIQUE SITUATIONS WHICH WERE NOT FORESEEN AT THE ADOP- USE IS TO ATTEMPT, IF POSSIBLE, TO SOLVE THE PROBLEMS OF SUFFICIENT AUTHORITY TO MAKE CERTAIN THAT SURROUNDING PROPERTY OWNERS COULD BE PROTECTED. THEY DID THIS AFTER A GREAT DEAL OF DISCUSSION AND AND THE OBJECTIONS OF THE SURROUNDING PROPERTY OWNERS, VOTE ON FEBRUARY iSTH, WHEN MR. MAURICE AGAIN PRESENTED HIS PETI- AFTER SETTING DOWN A NUNBER OF CONDITIONS WHICH THEY FELT WOULD PROTECT THE PROPERTY OWNERS IN THE SURROUNDING AREA.
