PRESENT: L~AYOR JEROME GOTTFRIED, CHAIRMAN; WILLIAM CHASE, SEC'Y; WILLARD BERTRAM, CHARLES BUEHLER, EDMUND BUDISH AND CLARENCE WALRATH. RUSSELL KNETZGER, CONSULTANT, AND GERALD LEE, BUILDING INSPECTOR, WERE ALSO PRESENT. ABSENT: JOHN MEINHARDT MLYUTES: FLANNER KNETZGER AMENDED THE MINUTES OF THE PREVIOUS MEETING, OCTOBER 19, 1965, ON PAGE 3, SECOND PARAGRAPH, TO READ: PLANNER KNETZGER ADVISED MR. PETERS OF HIS RIGHTS TO I1 PETITION FOR A ZONING CHANGE.. . APPROVED. I1 THE MINUTES AS AMENDED WERE IT WAS THE COMMISSION'S DECISION THAT COMMUNICATIONS, ETC., DETERMINED AS PERTINENT DATA BY THE COMMISSION, BE INCORPORATED INTO THE MINUTES IN THEIR ENTIRETY. GERTH HEATING - MR. RAY GERTH, SR., AND HIS REPRESENTATIVE DAVID COUTURE APPEARED SEEKING APPROVAL OF A HEATING SERVICE BUSINESS TO BE LOCATED IN THE BUILDING AT VI79 S7672 RACINE AvE., PROPERTY PRESENTLY OWNED BY CHAS. SAMUELS. MR. COUTURE ADVISED THE COMMISSION THAT THIS WAS ESSEN- TIALLY A HEATING SERVICE BUSINESS, THAT FURNACES, BURNERS, FILTERS, ETC. WOULD BE DISPLAYED IN THE FRONT, AND THAT THERE WAS INCIDENTAL SHEET METAL WORK ASSOCIATED WITH THE BUSINESS, A PORTION OF WHICH WOULD BE DONE IN THE SHOP AREA ALTHOUGH MOST OF IT WOULD BE DONE ON THE JOB SITE. IT WAS NOTED BY THE COMMISSION THAT THIS BUILDING HAD BEEN VACANT FOR APPROXIMATELY THREE YEARS. ACCORDING TO MR. COUTURE, A RESIDENCE TO THE REAR OF THE BUILDING WOULD POSSIBLY BE OCCUPIED BY OATE OF THE GERTH FAMILY. DISTRICT AND ADVISED THE COMMISSION THAT THE ZONING ORDINANCE WAS WRITTEN IN SUCH A WAY THAT THE PLAN COMMISSION WOULD HAVE TO DETERMINE THE USES WHICH WERE NOT LISTED. PLANNER KNETZGER IN THE B-3 DISTRICT. HE ADVISED THE COMMISSION THAT A BUILDING PLANNER KNETZGER REVIEWED THE USES ALLOWED IN THE 8-3 RECOMMENDED THAT THIS BUSINESS BE PERMITTED AS USE BY AIGHT'I I, .a AND OPERATIONAL PLA% woum BE REQUIRED IF IT WERE USE By RIGHTtf I1 OR CONDITIONAL USE . I1 GERTH HEATING (CONT. 1 THE PLAN COMMISSION CONSIDERED PROBLEMS WHICH COULD ARISE SUCH AS THE EXPANSION OF THE BUSINESS AS WELL AS NOISE WHICH WOULD BE DUE TO HAMMERING AND FABRICATING. THE COMMISSION THERE WAS A RESIDENTIAL AREA BEHIND THE BUILDING. MR. WALRATH REVIEWED THE QUARTER-SECTION MAP OF THE AREA AND NOTED THAT EXPRESSED CONCERN THAT CONDITIONAL USE WOULD BE TOO RESTRICTIVE AND WOULD POSSIBLY DISCOURAGE NEW INDUSTRY. MR. CHASE MOVED THAT THE COMMISSION INTERPRET A SHEET METAL SHOP AS A UNCLASSIFIED MR. BUEHLER DITIONAL USE FOR GERTH HEATING FOR 7145 P. M. , DECEMBER 7, MR. BUEHLER MOVED TO SET THE PUBLIC HEARING FOR A CON- 1965. MR. CHASE SECONDED THE MOTION AND IT CARRIED. LOUIS F. MENGHE - (LAND DIVISION, SCHMIDT PROPERTY, SEC. 12) CLARENCE H. PIEPENBERG RELATIVE TO CORRECT PERCOLATION TEST DATA AND SUGGESTED THAT MR. I~ENGHE BE PLACED ON THE AGENDA FOR PLANNER KNETZGER REPORTED THAT HE HAD CONTACTED SURVEYOR THE NEXT MEETING. A & P SIGNS - BUILDING INSPECTOR LEE ADVISED THE COMMISSION THAT THE A & P FOOD STORE REQUESTED APPROVAL OF TWO SANDWICH TYPE SIGNS FOR ADVERTISEMENT. THE COMMISSION REVIEWED THE SITE PLAN. PLANNER KNETZGER ADVISED THE COMMISSION TO REQUEST A MORE ATTRACTIVE SIGN AND STIPULATE THAT IT BE ANCHORED TO THE GROUND, AND STATED FURTHER THAT HE WAS NOT AGREEABLE TO ACCEPTING THE SIGNS AT ALL. MR. CHASE MOVED THAT THE TWO SANDWICH TYPE SIGNS BE ALLOWED AT THE A & P FOOD STORE AND SUCH SIGNS BE SECURELY ANCHORED TO PREVENT BEING BLOWN OVER BY THE WIND. MR. WALRATH SECONDED THE MOTION AND IT CARRIED. BOLDT BUTTER & EGG PLANT - THE COMMISSION REVIEWED THE SITE BOLDT BUTTER & EGG PLANT, S66 VI4328 JANESVILLE RD. WITH MR. BOLDT AND HAD MADE THE FOLLOWING RECOMMENDATIONS: AND OPERATIONAL PLANS SUBMITTED FOR THE ADDITION TO THE PLANNER KNETZGER ADVISED THAT HE HAD DISCUSSED THE PLANS I. SPORT SHACK SIGN - THE COMMISSION REVIEWED A REQUEST FOR A TO THE OUTLINE, THE 16'x2' SIGN IS TO BE ERECTED ON THE SLOPING LINE AT A HEIGHT OF NOT TO EXCEED APPROXIMATELY 15'. THE COMMISSION REVIEWED THE ZONING ORDINANCE PERTAINING TO SIGNS. SIGN FOR THE SPORT SHACK, s75 VI7374 JANESVILLE RD. ACCORDING FRONT ROOF OF THE EXISTING STRUCTURE BELOW THE EXISTING ROOF MR. CHASE MOVED TO ACCEPT^ THE SIGN. MR. BUEHLER SECONDED THE MOTION AND IT CARRIED. TECHJIGOM COEaPORATION - (RADIO TOWER, SEC~ION 7) MR. CHASE MOVED TO RECOMMEND TO THE COMMON COUNCIL THAT THE REZONING REQUEST FOR TECHNICOM GORP. IN SECTION 7 BE GRANTED TO PROVIDE AN OVERLAY DISTRICT FOR OIP. MR. WALRATH SECONDED THE MOTION AND IT CARRIED.' DISCUSSION FOLLOWED AS TO WHETHER OR NOT ACTION SHOULD BE TAKEN ON THE CONDITIONAL USE REQUEST. PLANNER XNETZGER SUGGESTED THAT THE CITY ATTORNEY BE REQUESTED TO GIVE A LEGAL OPINION ON THIS PROCEDURE. EMERSON DRIVE ACCESS - THE COMMISSION REVIEWED THE PLANS WHICH HAD BEEN SUBMITTED BY !/EW BERLIN FOR A PDQ STORE TO BE LOCATED AT EMERSON DRIVE AND HIWAY 24. THE LOCATION OF THE PROPOSED BUILDING IS IN NEW BERLIN, HOWEVER, EMERSON DRIVE HAS BEEN DEDICATED TO THE CITY OF MUSKEGO AND MUSKEGO WILL HAVE CONTROL OF THE ACCESSES. MAYOR GOTTFRIED STATED THAT HE HAD SEEN MORE ELABORATE PLANS AND THE BUILDING HAD APPEARED TO BE VERY ATTRACTIVE. THE COMMISSION EXPRESSEDCONCERN AS TO WHERE THERE WOULD BE ROOM FOR A SEPTIC SYSTEM, IT APPEARED THAT A TRAFFIC HAZARD COULD BE CREATED AND THAT THE PLANS SHOWED THAT THERE WOULD BE ONLY 120' SET-BACK FROM HIWAY 24. PLANNER KNETZGER SUGGESTED THAT THE COMMISSION REQUEST THEM TO PRESENT A SKETCH SHOWING HOW IT WOULD BE IF CONFORMING TO 150' FROM THE HIWAY. HE FURTHER SUGGESTED THAT THERE BE A PLANTING SCREEN IN ADDITION OR INSTEAD OF THE FENCE AS SHOWN ON THE PLANS. h. BUDISH MOVED TO TABLE THIS UNTIL MORE SPECIFIC DATA AS TO SITE PLAN IS AVAILABLE. CONSULTANT'S REPORTS - PLANNER KNETZGER PRESENTED COPIES OF TWO PROPOSED AMENDMENTS TO THE ZONING ORDINANCE TO PERMIT TWO FAMILY DWELLINGS. HE READ AND ELABORATED ON THE POSSIBILITIES OF EACH. THERE FOLLOWED DISCUSSION AS TO THE MERITS OF ALLOWING TWO FAMILY DWELLINGS. IT WAS THE COMMISSION'S DECISION TO D-" ESTIMATED THAT THERE WERE 250 AND OVEFi. JOHlri SIfOLEN - THE RECORDING SECRETARY READ A COMMUNICATION TO BUILDING INSPECTOR LEE FROM THE FIRM OF LOWRI; HUNTER & TIKALSKY DATED NOVEMBER 1, 1965, AS FOLLOWS: DEAR MR. LEE: IN CHECKING THE FILE AT THE COURTHOUSE, THE CERTIFIED SURVEY WHICH WAS APPARENTLY FILED PURSUANT TO THE PLANNING COMMISSION MEETING OF FEBRUARY 2, 1965, SHOWS ON IT A RIGHT OF WAY 60 FEET WIDE. PLEASE ADVISE us WHETHER OR NOT A DIFFERENT CERTIFIED SURVEY WAS AT ANY TIME FILED.
