PCM19650921PLANNING COMMISSION CITY OF MUSKEGO "* MINUTES OF MEETING HELD SEPTEMBER 21. i 965 - CITY HALL MAYOR GOTTFRIED CALLED THE MEETING TO ORDER AT 8:10 P. M. PREfENT: MAYOR JEROME GOTTFRIED, CHAIRMAN; WILLIAM CHASE, SEC Y; WILLARD BERTRAM, CHARLES BUEHLER, EDMUND BUDISH, JOHN MEINHARDT AND CLARENCE WALRATH. RUSSELL KNETZGER, CONSULTANT, AND GERALD LEE, BUILDING INSPECTOR, WERE ALSO PRESENT. MIIUTES: MR. BUDISH MOVED TO APPROVE THE MINUTES OF THE PREYIOUS MEETING, SEPTEMBER 7, 1965, AS MAILED. MR. BUEHLER SECONDED THE MOTION AND IT CARRIED. R- - MR. ROBERT KREUSER APPEARED TO DISCUSS WITH THE COMMISSION TWO PARCELS OF PROPERTY THE SCHOOL BOARD HAS OPTION ON FOR FUTURE SCHOOL SITES. OTHER SCHOOL BOARD MEMBERS PRESENT WERE GEORGE GUHR, GEORGE VOGEL & LLOYD HUMAN. MR. KREUSER INDICATED THAT THE OPTIONS WILL HAVE TO BE (F ONE LOCATION IS A 17 ACRE PARCEL LOCATED IN THE hW+ OF e EXERCISED FORMALLY WITHIN THE NEXT TWO WEEKS. THE SE# OF SECTION 29 AND ACCORDING TO MR. KREUSER CAN BE CENT TO THE DENOON SCHOOL. THE SECOND LOCATION IS A 26 ACRE PARCEL IN THE SES OF SECTION 10 AND COULD BE PURCHASED FOR APPROXIMATELY $40,500. MR. KREUSER ADVISED THE COMKISSION THAT THERE WERE NO PURCHASED FOR APPROXIKATELY $20,000. THIS LOCATION IS ADJA- PRESENT PLANS AS TO BUILDING ON THESE SITES, BUT THAT IF THE PRESENT RATE OF GROWTH OF THE CITY CONTINUES, ADDITIONAL HE NOTED THAT THERE HAD BEEN AN INCREASE OF 200 CHILDREN EN- ROLLED IN THE SCHOOLS SINCE LAST JUNE ST. AT PRESENT, THE SCHOOL FACILITIES WILL BE NECESSARY WITHIN THE NEXT THREE YEARS. HIGH SCHOOL COULD FACILITATE 200 MORE STUDENTS AND THE GRADE SCHOOLS COULD HANDLE 400 MORE CHILDREN. IN ANSWER TO MR. GUHR 's QUESTION AS TO THE EXPECTED RESIDENTIAL DEVELOPMENT WHEN SEWERS ARE AVAILABLE, MAYOR GOTTFRIED ADVISED THAT POTENTIAL DEVELOPERS WERE INTERESTED IN THE SEWER AREAS BUT THAT THE CITY WAS NOT INTERESTED IN BECOMING THE FASTEST GROWING COMMUNITY IN THE VICINITY AND WOULD ATTEMPT TO CONTROL THE RATE OF BUILDING THROUGH THE USE OF ITS SUB-DIVISION CONTROL ORDINANCE. IN ANSWER TO MR. BUDISH, MR. KREUSER ADVISED THAT THESE AND BUILDABLE IN THEIR PRESENT CONDITION. SITES HAD BEEN CHOSEN BECAUSE THEY WERE MORE READILY AVAILABLE i '* SCHOOL BOARD WAS THAT THEY WOULD LIKE TO BE IN A POSITION IN MR. KRUESER ADVISED THE COMMISSION THAT THE CONCERN OF THE THE FUTURE TO CONSTRUCT A SCHOOL ON THE SITES WITH NO OPPOSI- TION FROM THE CITY. HE ALSO REQUESTED THAT THE COMMISSION CON- FIRM BY LETTER THAT THE SCHOOL BOARD HAD BEEN IN COMMUNICATION REGARDING THE FUTURE SCHOOL LOCATIONS AND UNDERSTOOD THE PRO- BLEM INVOLVED. PLANNER KNETZGER ADVISED THAT A BASIC AGREEMENT COULD BE INDICATED BUT NO BINDING STATEMENT UNTIL THE OVERALL MASTER PLAN COULD BE ADJUSTED. HE NOTED THAT THIS COULD REFLECT THE SCHOOL BOARD'S THINKING AS THERE HAD NOT BEEN OPPORTUNITY BE- FORE TO DISCUSS THE MASTER PLAN WITH THE BOARD. MR. WALRATH NOTED THAT THE SCHOOL BOARD WAS NOT INTERESTED IN OBTAINING SITES WHERE THERE WAS DENSITY OF POPULATIOND BUT PROPERTY WHERE AVAILABLE FOR UTILIZATIOND AND HAVINQ SCHOOL BUSES AVAILABLE FOR COMMUTING ELIMINATED THE NECESSITY OF CONSTRUCTING A SCHOOL IN AREAS OF THE MOST POPULATION. MR. BUDISH MOVED THAT THE PLANNING CONMISSION CONTACT MUSKEGO-NORWAY SCHOOL BOARD ADVISING THEM THAT THIS COMMISSION WOULD BE WILLING TO AMEND THE MASTER PLAN TO CONFORM WITH. THE TWO SCHOOL SITES WHICH THEY ARE CONTEMPLATING PURCHASING; TO ALSO ADVISE THEM OF THE NEED FOR PERMISSION OF DIVISION OF LAND AND REZONING CHANGE PRIOR TO THE CONSTRUCTION OF ANY ATTENTION THE NEED FOR THEM TO EXAMINE THE PRESENT MASTER PLAN TO SEE IF THE OTHER SCHOOL SITES ARE ACCEPTABLE TO THEM. MR. WALRATH SECONDED THE MOTION AND IT CARRIED. < KENE P L - MR. KENNETH PHILLIPS APPEARED SEEKING APPROVAL OF AN ELECTRIC MOTOR THE COMMISSION REVIEWED THE PETITION FOR CONDITIONAL USE GRANT AND THE PLANS FOR THE SHOP. MR. PHILLIPS ADVISED THE COM- NISSION THAT HE HAD PURCHASED THE PROPERTY AND HAD PROVIDED FOR OFF-STREET PARKING. SERVICE TO BE LOCATED AT w180 S7695 RACINE AVE. IN SECTION 9. MR. BUEHLER MOVED TO SET THE PUBLIC HEARING FOR THE CONDITIONAL USE GRANT FOR KENNETH PHILLIPS FOR 7:30 P. M. NOVEMBER 2, 196s. MR. MEINHARDT SECONDED THE MOTION AND IT CARRIED ADOLPH SCHMIDT ESTATE - MR. & MRS. LOUIS F. MENGHE APPEARED SEEKING APPROVAL OF A DIVISION OF LAND ON TESS CORNERS DRIVE IN SECTION 12. THEY ADVISED THE COMMISSION THAT THEY DID NOT INTEND TO BUILD IMMEDIATELY ON THE SITE, BUT PLANNED A HOME THERE IN THE FUTURE. . THE COMMISSION REVIEWED THE SKETCH SUBMITTED AND NOTED THAT THE SKETCH WAS INCORRECT AND DID NOT SHOW THE PROPER LOCATION. THE COMMISSION REVIEWED THE TOPOGRAPHIC MAP TO DETERMINE THE CORRECT LOCATION. PLANNER KNETZGER ADVISED THAT THE SOIL IN THIS AREA WAS VERY POOR FOR A BASEMENT OR SEPTIC SYSTEM, HE ADVISED THAT THE AREA WAS SUITABLE FOR NO-BASEMENT HOMES AFTER SEWERS WERE IN. MR. BUEHLER MOVED THAT THE COMHISSION ADVISE MR. & MRS. MENGHZ WITH A CARBON COPY TO THE ADOLPH SCHMIDT ESTATE THAT THE COMMISSION'S INFORMATION SHOWS VERY QUESTIONABLE SOIL CONDITIONS AND THERE ARE DRAINAGE PROBLEMS AND SOME METLAND- FLOODPLAIN ZONING IN THAT GENERAL AREA: THAT BEFORE THEY PROCEED WITH ACTUAL LAND DIVISION THEY OBTAIN PERCOLATION TESTS AND SOIL BORINGS AND COMPARE THESE WITH THE SOIL INFOR- MATION AT CITY HALL; THAT THEY SUBMIT THE CORRECT LOCATION FROM THE TOPOGRAPHIC MAP AND PREPARE AN EASEMENT TO THE CITY TO MAINTAIN THE NATURAL DRAINAGE DITCH OR CREEK THAT DOES EXIST AS NO FILLING OF SUCH NATURAL DRAINAGE WOULD BE PERMIT- TED. MR. VALRATH SECONDED THE MOTION AND IT CARRIED. 1 - MR. RICHARD MAURICE APPEARED REQUESTING AN EXPANSION OF CONDITIONAL USE 9. THE COMMISSION REVIEWED THE PETITION AND SKETCH. FOR HIS PROPERTY LOCATED AT WIBO Sf785 RACINE AVE. IN SECTION MR. MAURICE ADVISED THE COMMISSION THAT HE HAD PURCHASED A LOT BEHIND HIS PRESENT LOCATION WHICH IS ADJACENT TO THE PRESENT LOT BUT ACROSS THE CREEK. HE ADVISED THAT WHEN &CINE AVE. IS WIDENED, IT WILL ELIMINATE HIS PRESENT PARKING FACILI- TIES. HJS PLAN WOULD BE TO BRING THIS LOT UP TO GRADE, PROVIDE ADEQUATE SCREENING, PROVIDE 8 TO 10 EMPLOYEE PARKING SPACES AND CONSTRUCT A STURDY BUT TEMPORARY BRIDGE ACROSS THE CREEK. HE ADVISED THAT THERE SHOULD BE NO PROBLEM WITH CHILDREN AS ONE END OF THE BRIDGE WOULD GO INTO THE SHOP. HE FURTHER IN- A 2 CAR GARAGE IN HARMONY WITH THE EXISTING BUILDINGS ON VALLEY DRIVE TO HOUSE HIS 3/h TON TRUCK. MR. MAURICE AGREED THAT IF DICATED THAT ,IN THE FUTURE HE WOULD POSSIBLY LIKE TO CONSTRUCT> NECESSARY HE WOULD BE UILLING TO ASPHALT THE LOT. HE ADVISED THE COMNISSION THAT LONG RANGE PLANS INCLUDE POSSIBLE PURCHASE OF THE ADJOINING LOT ON VALLEY DRIVE ON BUSINESS. THIS WOULD GIVE AMPLE PARKING IN THE BUSINESS AREA AND ELIMINATE THE NECESSITY TO PARK IN THE VALLEY DRIVE LOT. WHICH HE COULD MOVE HIS HOUSE WHICH IS PRESENTLY NEXT TO THE IN ANSWER TO QUESTION FROM MR. BUDISH, MR. MAURICE ADVISED THAT HE WOULD BE MOST COOPERATIVE IN TAKING THE BRIDGE DOWN WHEN THE CREEK WAS CLEANED AND WIDENED. THE COMMISSION CONSIDERED THE POSSIBILITY THAT MR. MAURICE MIGHT MOVE HIS HOME TO THE LOT ON VALLEY DRIVE WHICH HE HAD JUST PURCHASED, BUT MR. MAURICE ADVISED THE COMMISSION THAT BECAUSE OF THE SHAPE OF THIS LOT, HE WOULD HAVE TO HAVE THE HOUSE MOVED AROUND THE CORNER, WHEREAS IF HE HAD THE OTHER &CHARD MAURIC .. E (CONT. )- LOT, HE COULD JUST MOVE THE HOUSE ACROSS THE CREEK. PLANNER KNETZGER ADVISED THAT THIS AREA WAS ZONED FOR MULTIPLE FAMILY DWELLINGS, BUT THAT THE LANGUAGE. BUDISH MOVED TO SET THE PUBLIC HEARING FOR THE 7' - 3'- CONDITIONAL USE GRANT FOR RICHARD MAURICE FOR 7:45 P. M. NOVEMBER 2, 1965. MR. MEINHARDT SECONDED THE MOTION AND IT CARRIED. RADIO TOWE4 - MAYOR GOTTFRIED INFORMED THE COMMISSION THAT MR. KLUHSMAN HAD BEEN IN TOUCH WITH HIM AND WAS IN THE PROCESS OF PREPARING THE PETITIONS FOR REZONING, DIVISION OF LAND, AND CONDITIONAL USE AND THE PETITION FOR REZONING WOULD BE SUB- MITTED TO THE COUNCIL BY THE 28TH. PLANNER KNETZGER ADVISED THAT HE HAD DISCUSSED WITH MR. KLUHSMAN THE SMALL BUILDING TO HOUSE EQUIPMENT THAT CIRCLE COMMUNICATIONS DESIRED TO BUILD AT THE BASE OF THE TOWER. As THESE ARE USUALLY TIN ROOF SHACKS AND PLANNER KNETZGER FELT THAT THERE MIGHT BE OBJECTIONS TO THIS TYPE OF BUILDING, OF A ITORE SUITABLE TYPE BUILDING. MR. KLUHSMAN HAD AGREED TO HAVE AN ARCHITECT PREPARE SKETCHES THE COMMISSION DISCUSSED THE POSSIBILITY OF HOLDING A DOUBLE PUBLIC HEARING: THE HEARING BEFORE THE COMMISSION FOR THE CONDITIONAL USE AT THE SAME TIME AS THE COUNCIL HOLDS THE PUBLIC HEARING FOR THE REZONING. MAYOR GOTTFRIED ADVISED .THAT THE COUNCIL WOULD PROBABLY SET THE HEARING FOR THE FIRST MEETING IN NOVEMBER AND THE PLAN COMMISSION SHOULD BE PRESENT IF THERE ARE NO OBJECTIONS. COMMUNICATIONS THE RECORDING SECRETARY READ A COMMUNICATION FROM THE PUBLIC WELFARE COMMITTEE REQUESTING THE COMMISSION TO GIVE FOR PUBLICATION IN THE NEXT NEWSLETTER. AN ACCOUNT OF THEIR FUNCTIONS, DUTIES AND RESPONSIBILITIES THE COMMISSION FELT THAT THIS WOULD BE AN OPPORTUNITY TO ENLIGHTEN THE CITIZENS THAT ALL LAND DIVISIONS BE PROCESSED THROUGH THE PLAN COMMISSION. PLANNER KNETZGER OFFERED TO PREPARE THE SUMMATION. THE RECORDING SECRETARY READ A COMMUNICATION FROM PAYNE & DOLAN OF WISCONSIN DATED SEPTEMBER 2, 1965, REGARDING THG SAME REFERRED TO THE NEXT MEETING. INSTALLATION OF AN ASPHALT PLANT FOR CONSTRUCTION OF C.T.H. "F", GRAVEL OPERATION FROM ITS INCEPTION TO THE PRZSENT AND MADE THE FOLLOWING RECOMXENDATIONS: 1. THE OVERBURDEN STOCK PILE AT THE SE CORNER OF &CINE PROVIDES A VERY GOOD VISUAL SCREEN. THIS WOUND OF EARTH COULD BE EXTENDED UP RACINE AVE. TO THE TREES FOR SCREENING. 2. CLOSE THE ENTRANCE ON RACINE AYE. AND ASK FOR IMMEDIATE RESTORATION OF THIS WHOLE CORNER; ADD 6” OF TOP SOIL AND BEGIN PLANTING GRASS. 3. ACCORDING TO THE ZONING ORDINANCE, ANYTHING KEPT FOR SPARE PARTS CONSTITUTES A JUNK YARD. CHASSIS SHOULD BE DISPOSED OF AND SPARE PARTS SAVED ELSEWHERE. 4. MOUNDS SHOULD BE MOVED TO THE WEST SIDE OF THE ENTRANCE FOR STORING, THIS AREA FILLED IN AND THEN MOVE TO ANOTHER AREA 5. RE-PHRASE RESTORATION REQUIREKENTS so THERE WILL BE ACTION BY NEXT SPRING AND HAVE THEW+USE A SYSTEM SIMILAR TO THAT USED BY STATE SAND & GRAVEL. 6. INCREASE THE BOND FROM $5000 TO $20,000 AS WAS ORIGINALLY SUGGESTED BY THE ENGINEER. MAYOR GOTTFRIED REQUESTED THAT PLANNER KNETZGER PUT THERE FOLLOWED DISCUSSION OF THE GRAVEL OPERATION AND THESE RECOMMENDATIONS IN PRINT FOR REVIEW AT THE NEXT MEETING. THE ACCESSORY USE OF THE ASPHALT PLANT. THE COWMISSION NOTED THAT THERE HAD BEEN NO PLANTING SCREEN AFTER 6 YEARS OF OPERATION. ER. BUEHLER DISCUSSED THE PROBLEM OF THE ASPHALT PLANT HE NOTED THAT THERE HAD BEEN A COMPLETE LACK OF DEVELOPMENT AND THE EFFECTS OF ITS OPERATION ON THE SURROUNDING AREA. IN THE AREA AND THAT THERE HAD BEEN NO BUILDING WITHIN A HALF MILE IN EITHER DIRECTION SINCE THE OPERATION OF THE ASPHALT PLANT BEGAN. MR. BUEHLER QUOTED FROM THE MINUTES OF JUNE 15, 1965, THAT THE PLAN COMMISSION HAD GONE ON RECORD AS BEING AGAINST THE OPERATION OF THE ASPHALT PLANT. MR. BUEHLER ALSO READ IF THE PLAN COMMISSION DENIES AN APPLICATION, APPROVAL OF THE COMMON COUNCIL REQUIRES A FAVORABLE VOTE OF THREE-FOURTHS OF THAT PORTION OF ORDINANCE #I6 IN SECTION 13 (5) STATING THAT THE MEMBERS. JACK GLOCKflEd - MR. CHASE QUESTIONED IF MR. GLOCKNER HAD SUBMITTED THE SITE AND OPERATIONAL PLAN AS REQUESTED. MAYOR GOTTFRIED ADVISED THAT HE HAD TALKED TO MR. GLOCKNER AND MR. GLOCKNER THAT IF IT WERE NOT SUBMITTED BY THE NEXT PLAN COMMISSION MEETING, THE COMMISSION WOULD RECOMMEND DENIAL HE HAD NOT AS YET PREPARED THE PLAN, AND THAT HE HAD ADVISED OF THE PERMIT FOR JUNKING.
