Minutes of the Bebruary 16, 1965, meeting were approved. March 23rd at the City Hall beginning at 7:OO P.M. for the follaning rezoning Chairman Gottfried advised the commission that a public hearing would be held petitions - Robert Gebhardt &Alvin C. Basse property; bkrtin P. Mayer &Rose Enterprise, Inc. property; Leslie Mayer property; and Duane Whitehouse property. ?k. Mlle Peters appeared seeking division of land in Section 33. He presented sketches of the proposed division, an area bordering North of Muskego Dam Road, on which he desires to build a home with less than the floor area required for E-1 District. The commission advised Mr. Peters that any reduction of the Board of Appeals. &. Peters will have the area surveyed ad it was suggested required square foot area for a home must hwapproved by the City of ?duskego by Planner Knetzger that he also get a percolation check of the area. A motion nas made by Mr. Walrath, as seconded by Mr. Budish, that Mr. Peters be given iniormal approval of his request for division of land. Motion carried. Planner Knetzger reviewed the YJuties and Powers of the Plan Comission, Wisconsin Statutes 62.2311, gave a brief history of Nelson & Associates, and dis- cussed the General Plan for Community Development for the City of kskego as shown 1~1 the long range plan and as to what has been accomplished toward this goal. PRESENT: Mayor Jerome Gottfried, Chairman; William F. Chase, Sec'y; John Meinhardt, Willard Bertram, Charles Buehler, Clarence C. Walrath and Edmund A. Budish. Also present were Russ Knetzger, Consultant, and Gerald Lee, Building Inspector. The meeting was called to order at 8:40 P.M. by Chairman Gottfried. MINUTES of the previous meeting (March 16, 1965;) were approved as amended with the following addition: Mr. Budish moved, as seconded by Mr. Walrath, to approve the request for division of land of Orville Peters subject to the presentation to the Commission of a corrected certified survey map. Motion carried. HEARINGS for Duane Whitehouse, Mayer & Rose, and Gebhardt & Basse held on March 23, 1965, were reviewed by Chairman Gottfried. Correspondence from Attorney Gyrus Shabaz was read by the Recording Secretary in regard to the rezoning of the Mayer - Rose property. 0 DUANE WHITEHOUSE - Mr. Chase moved, as seconded by Mr. Walrath, that the Planning Commission recommend to the Common Council of the City of Muskego that the ammendment to the zoning map be made providing overlay of OA Agriculture District to the area described as Pt NWT, Sec. 7, approximately 17 .Ob acres, W219 ST436 Crowbar Rd. Motion carried. Mr. Chase made a motion, seconded by Mr. Buehler, that a hearing be held May 18, 1965, to consider the conditional use operation of a kennel as applied for by Mr. Duane Whitehouse. Motion carried. Notice of hearing to be published in the official newspaper was Orma Walrath for publication. drafted by Mr. Chase and Planner Knetzger and given to Reporter have the following information available at the hearing. Size of buildings? Shrubbery & planting? The Commission discussed a time limit for kennel operation but felt it could be indefinite as long as ownership did not change. It was noted by the Commission that Mr. Whitehouse stated very clear15 9 kennel. MAYER & ROSE PROPERTY - It was the opinion of the Commission that because of the size of the Martin P. Mayer parcel and location ness purposes and rezoning should not be considered until such time (next to firehouse) there would be inadequate parking area for busi- as this parcel becomes evolved with adjacent land. Mr. Chase moved, as seconded by Mr. Budish, to withdraw the Planning Commission petition to rezono-that portion of land in Section 9 known as the Martin P. Mayer and Rose Enterprise, Inc., property from R-3 Residential with OLR Lakeshore Recreation OV to B-3 General Business with OLR Lake Shore Recreation Overlay. Motion carried. Planner Khatzger will draft letters to Mayer & Rose advising same. LESLIE MEYER PROPERTY - Motion made by Mr. Budish, as seconded by Mr. Chase, that the Planning Commission recommend to the Common 00s - Office and Special Service, Sec. 25, be granted in accord Council of the City of Muskego that Leslie Meyer's request for with said petition. GEBHARDT & BASSE - Planner Knetzger advised the Commission that Nelson & Associates did not feel that they could give a fair recom- .,, , , fi / .'A r, ~ ~~~ mendation in this instance as they have been hired as consultants Knetzger gave the names of three firms he would recommend. Mr. Chase moved, as seconded by Mr. Walrath, that the Planning Commission petition the Common. Council to provide the Commission particular zoning case. Discussion followed and it was felt by with the services of another independent consultant on this property. The Commission desired to turn down the recommendation the Commission that they could render a fair judgement on this of its Planning Consultant to hire another consultant in this matter and the motion was withdrawn. Mr. Chase moved that the petition to rezone that portion of land in Sec. 10 known as the Wm. Basse Farm, from RS-2 to B-4 Highway Business, be denied but that a petition to rezone same to an Overlay Plan Developement would be received favorably by the Planning Mr. Budish abstained from voting. Commission. Mr. Meinhardt seconded and the motion was carried. FUTURE ROAD EXTENSION - Planner Knetzger presented large scale maps showing recommendations for the proposed North - South roadways of Sunny Slope, Moorland & Calhoun. He noted that the Highway Dept. would be out sometime during the year to show the Commission their total plan. I . for the future shopping center on Lannon and Hiway 24. Planner . 1) Mr. Budish moved, as seconded by Mr. Walrath, that the Planning Highway Commission to discuss the possible roadways. Motion Commission authorize Planner Knetzger to take the maps to the carried. WILLIAM L. SCHUBEL - Mr. Buehler moved to set hearing for May 18, 1965, 7:45 P.M., for request of Wm. L. Schubel for expansion of conditional grant for tavern addition, NWa, See. 5. Mr. Meinhardt seconded and motion carried. PROPOSED AMENDMENTS TO ZONING ORDINANCE were given to Planner Knetzger for review and recommendation. Mr. Chase suggested indexing the minutes. The secretary was instructed to send to each of the members a copy of Petition for Zoning Change, Petition for Conditional Use Grant, Checklist for Approval of Building, etc., and Land Division Procedure for review and suggestions for improval. Planner Knetzger will make arrangements for the Planning Commission to meet with Greendale's Planning Commission to discuss their drainage and grading procedures. Arrangements will also be made by Planner Knetzger to meet with Franklin's Planning Commission to discuss their Master Plan. The meeting was declared adjourned at 12 midnight. LEON BOURDO -Mr. Leon Bourdo appeared before the Commission in re- gard to his property located at the SW corner of Kelsey & Crowbar in Sec. 31. Mr. Bourdo presented the Abstracts of Title and Plat of Survey to the Commission for review. The 8 acres had been divided into 1 acre lots and Lot #2 had been sold. As this division of land had not been recorded to make a legal deed, the Commission felt that this matter should be referred to the City Attorney. Mr. Budish moved, as seconded by Mr. Chase, that the matter of division of land of Mr. Leon Bourdo be referred to City Attorney Hippenmeyer. Motion carried. NORTH-SQUTH BYPASS - Planner Knetzger presented large scale maps of DroDosed roadways. He uointed out in Darticular Calhoun Road as it would run from Highway 15 to Highway 24. Planner Knetzger also presented the Southeastern Wis. Regional Planning Commission map of Existing Land Use and map of Arterial Streets and Highways. MEETING WITH FRANKLIN - Secretary Chase informed the Commission Tuesday evening to discuss their Master Plan. As this was agree- that a meeting with Franklin could be arranged on a Monday or able with the Commission, Secretary Chase will make the necessary arrangements. ~ GREENDALE DRAINAGE PROCEDURES - Planner Knetzger cited the problems that Greendale had encountered as concerned drainaize. Copies of their ordinance in regard to same will be made by Flamer- Knetzger and presented to the Commission members for their review. LESLIE MEYER PROPERTY - It was noted by the Commission that the overlav zoning had been auvroved bv the Council. Corresvondence from &. Meye; was read byMayor Gottfried and sketch of-his pro- perty was reviewed by the Commission. Mr. Budish moved, as seconded by Mr. Walrath, to approve the building site and operational plan of the Meyer request as des- cribed in his letter of April 10, 1965. Motion carried. MAYER - ROSE PROPERTY - Council Resolution #44 concerning further study and report of the Mayer-Rose Property by the Planning Commission was read by Sec:iy Chase. Letter from Sec!y Chase to Mrs. Martin-P. was instructed to attaeh a copy of same to the minutes with a Mayer was read by the Recording Secretary. The Recording Secretary felt that no action in this matter was necessary unless Mrs. Mayer corrected date of Tuesday night, April 6, 1965. The Commission presented a petition. February 16, 1965, as regarded road location correction of Tenngson TENNYSON LANE - Minutes of the Planning Commission meeting of Lane were read by the Recording Secretary. Petition signed by the land owners was read by Mayor Gottfried. - Mr. Buehler moved, as seconded by Mr. Budish, to approve the va- cating of the land and accept the revised location of Tennyson Lane as indicated on the Certified Survey map prepared by Wilbert Stambaugh, Jr., dated February 16, 1965, and the petition of the owners of the roads abutting that portion of Tennyson Lane- dated this 13th day of April, 1965, and that this recommendation be transmitted to the Common Council. Motion carried. Discussion was held relative to the action of the Common Council regarding the Basse - Gebhardt zoning request. Mr. Chase asked explained by Planner Knetzger that the Common Council has the final the question of who actually approves zoning amendments. It was has jurisdiction in all cases of conditional use other than say on all zoning matters; however, that the Planning Commission extractive operations. There was some concern over the fact that relative to zoning request within a single night. It was thought the Common Council could nullify many hours of study and discussion that part of the problem was lack of communication between the two. It was suggested by the Commission that minutes of the Planning Commission meeting be sent to the Council members and that the Council minutes be sent to the Planning Commission to alleviate this problem. AMENDMENTS TO THE ZONING ORDINANCE - Planner Knetzger reviewed the amendments to the zoning ordinance as prepared by Attorney Hippenmeyer. Mr. Budish moved, as seconded by Mr. Walrath, that the Commission authorize Nelson & Associates to contact Attorney ordinance. Motion carried. The meeting was declared adjourned at lO:jO P.M.
