PCM19650111MINUTES OF THE CITY OF MUSKEGO PLANNING COMM., MEETING HELD ON JANUARY 11, 1965, 8 P.M., WITH MEMBERS GOTTFRIIJD, CHASE, MACHKOVICH, LANCE AND BOSTATER PRESENT. ALSO PRESENT, PLANNER KNETZGER AND INSP. LEE. MINUTES OF THE PR,~VIOUS MEETING WERE APPROVED UNANIMOUSLY, AS MAILED. LESTER TANS REQUESTED FINAL APPROVAL OF LAND DIVISION, SEc. 6. CLERK READ RECOMMENDATION RECEIVED FROM PLANNER WHICH WAS AS FOLLOWS: MR. TANS DEDICATE 40' TO THE CENTERLINE OF TANS DR., TOTAL OF 80' RIGHT-OF-WAY AS ESTABLISHED BY MUSKEGO, LAYOUT ALL OF THE LAND NOW FOR COMMISSION REVIEW EVEN THOUGH ONLY 1 LOT MIGHT ACTUALLY BE RECORDED, LAYOUT AND RESERVE, OR DEDICATE, A CUL-DE-SAC TYPE ACCESS FOR ALL LOTS TO BE LOCATED GENERALLY ALONG THE SOUTH LINE OF THE PROPERTY SO THAT NO LOTS HAVE DIRECT ACCESS TO TANS DR. .. IF AN AGREEMENT CANNOT BE REACHED WITH THE ADJACENT OWNER, THAT PORTION OF THE CUL-DE-SAC ON THE TANS PROPERTY WOULD STILL BE SHOWN AND ACCESS TO TANS DR., WOULD BE ONLY BY TEMPORARY PERMIT. MR. TANS STATED THAT HE HAD CONTACTED MR. GROBER AND DIVISION IS AS FAR AS HE IS GOING TO GO . THE PLANNER ASKED IF THE LAND AND HE SAID, NO . MR. MACHKOVICH MOVED, AS SECONDED BY MR. LANCE, THAT THE REQUEST FOR APPROVAL OF DIVISION OF LAND AS SUBMITTED BY MR. TANS BE DENIED, BUT THAT THE PLAN COMMISSION VEYOR MUST COMPLY WITH CHAP. 236, WIS. STATUTES AND CITY OF MUSKEGO SOBD. CONTROL ORD. 2. THAT A SKETCH OR PRELIMINARY PLAT INCLUD- ING ENTIRE 8.5 ACRES BE SUBMITTED. MOTION CARRIED UNANIMOUSLY. DAVID CUNNINGHAM OF NORTHLAND DEVELOPERS, INC., SUBMITTED A PRO- THE CORNERS OF WESTWOOD AND JANESVILLE RD. PLANNER KNETZGER THE BOARD WAS CONCERNED WITH THE LACK OF A BUFFER ALONG RESIDENT- IAL ZONING TO THE EAST. MR. CUNNINGHAM STATED THAT REDUCING SIZE HE WILL NOT SELL ANY OF HIS LAND. HE FFRTHER STATED THAT THIS HE WOULD HAVE REASON FOR NOT WANTING TO SKETCH OUT THE BALAA'CE OF 11 If II WOULD CONSIDER THE REQUEST FURTHER CONDITIONED UPON - 1. SUR- POSED SITE AND LAND USE BREAKDOWN FOR A SHOPPING DEVELOPMENT ON REVIEWED THE PLAN AS THEIR FIRM HAD MADE SOME RECOKKENDATIONS. OF BUILDINGS WOULD CREATE A PROBLEM, BUT WOULD BE WILLING TO MOVE ENTI E BUILDING TOWARD WESTWOOD DR., REQUIRING 10' VARIANCE IN m. HE FURTHER STATED AN AGREEMENT HAD BEEN WORKED OUT WITH THE MOBIL STATION USING THEIR ACCESS POINT FOR INGRESS ONLY. CHAIRMAN GOTTFRIED QUESTIONED DEPTH OF ACESS POINT ON WESTWOOD.. AND MR. CUNNINGHAM SAID - ABOUT 120'. CHAIRMAN GOTTFRIED ALSO STATED THE COUNCIL IS AT PRESENT FACED WITH A RESOLUTION AGREE- ING TO CONTROL ACCESS ALONG LOCAL STREET OF HWAY IN CONNECTION VITH A CONTROLLED ACCESS PROJECT OF THE SH COMM. OF WIS", WITH SAID CONTROL BEING 150'. TYPE OF FACING OF EXTERIOR TREATMENT, PARKING SPACE, ARCHITECTURAL DESIGN, ETC. WAS DISCUSSED. THE GENERAL CONSENT. THE PLAN COMM. RECOMMENDED THAT NORTHLAND 'I FOLLOWING WAS AGREED UPON BEING MADE A PART OF THE MINUTES BY DEVELOPERS INC., BE GRANTED A VARIANCE IN SETBACK FROM WESTWOOD DR., THUS PERMITTING THEM TO MAINTAIN 10' OFFSET ON THE EAST SIDE. MR. MACHKOVICH MOVED, AS SECONDED BY MR. CHASE, THAT RECOMMENDATION BE MADE TO THE CITY COUNCIL THAT PUBLIC HEARINGS BE SET FOR ANTONE- 'MEN, CHURCH AND THE COMMUNITY CHURCH FOR OIP - INSTITUTIONAL & PUBLIC SERV. OVERLAY AND THAT APPROXIMATELY 16.6 ACRES BE REZONED FROM RS-3 RESIDENTIAL WITH OLR LAKESHORE RECREATION OVERLAY TO B-2 GEN'L. Bus. WITH OLR LAKESHORE RECREATION OVERLAY, AS DRAFTED. MOTION CARRIED. REGARDING THE REZONING OF LANDS OWNED BY MR. MACHKOVICH ON HWAY 24 IT WAS AGREED BY THE BOARD THAT HE HIMSELF SHOULD PETITION SAME. AMENDED MINUTES TO THE OCT. 26~~ MEETING WILL BE~AILED, SAKE TO RE RECONSIDERED AT THE JANUARY 25TH MEETING. CLERK SHALL NOTIFY BO. OF APPEALS THAT IF LOCHCREST BLVD., IS EX- BALISTRERI HAS REQUES TED A VARIANCE IN SETBACK. JOTIFICATION WILL PERMIT BOARD TO RECONSIDER SAID APPEAL AT JAN. MEETING. A REQUEST TO DIVIDE 5.45 ACRES OF LAND IN SEC. 17, PORTION OF NIEMAN FARM, WAS SUBMITTED BY C. JOHNSON, SURVEYOR. IT WAS UNANIMOUSLY TENDED IT WILL ONLY BE EXTENDED TO THE SOUTH, REASON BEING, A MR. AGREED BY THE COMmISSION THAT FORMAL DECISION BE MET FOLLOWING CLARIFICATION OF TYPE OF ACCESS, OWNER OF STRIP SHOWN AS ELECTRIC R-0-WAY. MR. JOHNSON STATED THAT HE WOULD EITHER CONTACT THE SH COKM., OR POSSIBLY GAIN ANSWERS THROUGH ABSTRACT PRESENTLY BEING ~RS. ALVIN PLATZ OF St06 120503 N. SHORE DR., SUR~ITTED DIVISION OF LAND, N. SHORE DR. QUESTIONS AROSE AS TO ROAD RESERVATION, R-0-WAY SHOWN TO AJ. SHORE DR AND LOT AREA. IT WAS NOTED SURVEYOR FAILED TO PREPARE LOCATION SECTION MAP. MRS. PLATZ WAS DIRECTED TO DETERMINE OF ADJOINING LOT OWNED BY T. LUDWIG, HAVE SURVEYOR PREPARE LOCATION BROUGHT UP-TO-DATE. IF MORE LAND WOULD BE AVAILABLE TO THE EAST THUS MOVING LOT LINES SECTION MAP, CORRECT ROAD RESERVATION BOTH NORTH-SOUTH & EAST-WEST. REGARDING THE PETITION OF A. SCIANO THE FOLLOWING DISCUSSION AND ACTION FOLLOWED. ONE MEMBER FELT THAT CONSIDERING SUCH A SMALL AREA WOULD BE SPOT ZONING WHILE THE PLANNER SUGGESTED THAT THE AREA COULD BE ENLARGED POSSIBLY, 500' IN DEPTH EXTENDING EAST ALONG 24 TO PRIVATE DRIVE RESULTING IN THE GENERAL CONCENSUS OF OPINION THAT A EIORE RESTRICTIVE TYPE OF ZONING WOULD BE MORE ADVANTAGEOUS TO THIS AREA. MR. CHASE MOVED, AS SECONDED BY MR. MACHKOVICH, THAT THE RE- QUEST OF A. SCIANO FOR REZONING FROM RS-2 TO 8-4 BE DENIED, BUT RECOMMENDATION RE MADE TO THE COUNCIL THAT THEY CONSIDER REZONING LANDS OWNED BY A. SCIANO, SEC. 10, FROM RS-2 TO B-2. MOTION CARRIED UNANIMOUSLY. MR. BOSTATER MOVED, AS SECONDED BY MR. CHASE, THAT RECOMMENDATION E MADE TO THE CITY COUNCIL THAT PUBLIC HEARING BE SET IN BEHALF F LESLIE MEYER FOR OOS-OFFICE & SPEC. SERV. OVERLAY, SEC. 25. e MOTION CARRIED UNANI~OUSLY. ON JANUARY 2, 1965 THE PLANNING COMMISSION AND CITY COUNCIL ALDERMEN AND MAYOR VISIFED THE EXTRACTIVE OPERATION OF THE b HALES CORNERS SAND & GRAVEL FOR COND. USE STATUS REQUEST, AFTER MUCH DISCUSSION OF PRESENT CONDITIONS THE FOLLOWING ACTION WAS TAKEN: MR. CHASE MOVED, AS SECONDED BY MR. LANGE, THAT THE PLANNING COMMISSION OF THE CITY OF MUSKEGO RECOMMEND TO THE COMMON COUNCIL OF THE CITY OF MUSKEGO THAT THE REQUEST OF THE HALES SEPT. 14, 1964 AND INCLUDED IN THEIR RESOLUTION DATED AUGUST AGREEMENT ORIGINALLY WITH THE TOWN OF MUSKEGO ON THE 25~~ DAY c ORNERS SAND & GRAVEL INC., AS SUBMITTED IN THEIR LETTER OF 15, 1964, FOR EXTENSION OF A COND. USE PERMIT, SET FORTH IN AN OF SEPT. 1961, FOR THE CONDUCT OF ALL EXTRACTIVE OPERATIONS, BE DENIED. BE IT FURTHER RECOMMENDED THAT IF ANY FUTURE PERMIT BE GRANTED THAT THE FOLLOWING CONDITIONS BE MET: I. COMPLETELY RESTORE AND REGRADE THE AREA FROM THE OFFICE BUILDINGS SOUTH TO MCSHANE DR., AND WEST PAST EXISTING FARM BUILDINGS, PLACING A SIX-MONTH TIME LIMIT ON THIS CONDITION. 2. SUBMIT SURVEY OF EXISTING TOPOGRAPHICAL LINES - AT 5' @ CONTOURS. 3. SUBMIT MAP SHOWING AREA OF PRESENT OPERATION AND PLAN OF FUTURE OPERATION. 4. IT IS ALSO RECOMMENDED THAT THE CITY ENGINEER DETERMINE WITH THE USE OF THE ABOVE MAPS A REASONABLE AMOUNT OF MONEY NEEDED TO RESTORE AREA. MOTION CARRIED UNANIMOUSLY.
