ALSO PRESENT INSP. LEE. CLERK READ THE PETITION AND PUBLIC HEARING NOTICE CONCERNING SAME. MR. HOLZ OF THE HOLZ AND WENDT REALTY APPEARED, STATING THAT THEIR REALTORS OFFICE IS LOCATED ACROSS FROM THE PROPOSED SITE. THE ALUMINUM PAINT ON 1 a x 6" LUMBER OR 4'' MASONITE. SHOULD BE GRANTED FOR THE PURPOSE OF ERECTING A NON-ACCESSORY PLANNING COMMISSION ON AUGUST 24, 1964, 7:30 P.M., WITH MEMBERS SIGN WILL BE OF A DIRECTIONAL NATURE, 5 X 10' IN SIZE, USING NO ONE APPEARED IN OBJECTION TO THIS SIGN. HEARING DECLARED ADJOURNED AT 7:L5 P.M. MINUTES OF THE PREVIOUS MEETING WERE READ AND APPROVED. REGARDING OLD BUSINESS - RICHDORF'S UNRECORDED BAY SHORE ESTATES - OBLIGATING MR. RICHDORF TO PAY ALL COSTS INVOLVED IN PREPARING PLAT. MR. CHASE MOVED, AS SECONDED BY MR. LANGE, THAT THE PETITION OF ELMER WENDT FOR A COND. USE STATUS BE GRANTED FOR PURPOSES OF I '. CHASE, BOSTATEA AND LANGE PRESENT. ALSO PRESENT WAS ATTORNEY THE CHAIRMAN STATED THAT LEGAL DOCUMENTS HAD ALREADY BEEN DRAWN ERECTING A NON-ACCESSORY SIGN ON NW$-sE$ - SEC. 34, BE APPROVED. MOTION CARRIED. MR. BABICH OF HALES CORNERS SAND & GRAVEL APPEARED TO DISCUSS RE- NEWAL OF COND. USE GRANT FOR EXTRACTIVE OPERATION, STATING THAT ALL OF THE PAPERS REQUIRED HAD BEEN FILED WITH THE CLERK s OFFICE. MR. ANTON BALISTRERI APPEARED TO DISCUSS BUILDING GARAGE ON LOT 5, PLAT WAS REVIEWED BY BOARD IN AN EFFORT TO RESOLVE POSSIBILITY OF GAINING DEDICATION OF LANDS TO THE NORTH AND SOUTH GIVING LOTS 5, 6, 7 AND 8 PROPER ACCESS AND ALSO ACQUIRING 2 CORNER PARCELS (PT OF LOT 14) FOR SAME. MR. ZREMSKI WHO OWNS 1 CORNER PARCEL STATED 0 HILLVIEW FARM LOCHCREST PLAT WHICH DOES NOT ABUTT A PUBLIC ROAD. THAT HE IS INTERESTED IN INVESTING bo-5o,ooo IN HOME IMPROVEMENTS ON LOT 2 AND WOULD DEED THE CORNER TO THE TOWN FOR ROAD PURPOSES PROVIDING HE COULD BE ASSURED THAT HE WOULD BE d&+RTO DEVELOP HIS LOT AS PLANNED. ACCORDING TO ZREMSKI HE HAS BEEN APPROACHED BY MR. GEIBEL REGARDING PURCHASE. PROBLEM SHALL BE FORWARDED TO PLANNER FOR REVIEW. REGARDING AGENTEN’S PLAT - MR. AGENTEN AND SURVEYOR APPEARED FOR REASONS OF DISCUSSING EXTENSION OF RAWSON AvE., AND WIDTH OF 1.24~~ ST. THEY ALSO WISH TO DIVIDE 3 LOTS INTO LESS THAN REQUIRED ZONING I RESTRICTIONS. THE BOARD SUGGESTED THAT A PRELIMINARY PLAT BE PRE- PARED SUBMITTING SAME TO PLANNER. MR. W. PESBACH SUBMITTED DIVISION OF LAND ON PT OF THE NWS - SEC. 15, SAID DIVISION BEING - PARCEL A - 150 x 199.75, 29,962 SQ. FT., PARCEL B - 100 x 199.75 OR 19,975 SQ. FT. RS-2 ZONING REQUIRES 110’ WIDTH IN ULTIMATELY SEWERED DISTRICTS, RESERVING ADJOINING PARCEL IN ACCORDANCE WITH SEC. 6.01 (SANITATION & WATER SUPPLY). MR. CHASE MOVED, AS SECONDED BY MR. BOSTATER, THAT THIS DIVISION OF LAND BE APPROVED PROVIDING THAT PARCEL B BE BROUGHT UP TO PROPER SPECIFICATIONS OF RS-2 THUS CONTAINING MINIMUM AREA IN SQ. FT., (LOT SIZE) LOT AREA PER D/U AND MINIMUM AVERAGE WIDTH. MOTION CARRIED MR. SMOLEN APPEARED TO DISCUSS FULLFILMENT OF DIRECTIVE BY BOARD REGARDING DIVISION OF LANDS (SEE MINUTES OF 8-3-64) MR. REILLY, ATTORNEY, REVIEWED SALE OF LANDS BETWEEN SMOLEN AND P”.IEGEL, RE- VIEWING ALL CORRESPONDENCE CONCERNING SAME. MR. SMOL~N STATED THAT THE LEGAL DOCUMENT COVERING SALE OF PRIEGEL HAD BEEN DRAWN BY ATTORNEY SCHMID, BUT HAD NOT BEEN SIGNED. MR. REILLY THEN REMINDED MR. SMOLEN THAT A LOT COULD NOT BE CREATED BY HIM NOT CONFORMING TO EITHER THE SUBD. CONTROL OR ZONING ORD. MR. SMOLEN THEN STATED THAT SINCE CONFERRING WITH ATTORNEY SCHMID HE TALKED TO MR. HUNTER OF WAUKESHA AND WAS ADVISED THAT HE COULD DIVIDE ANY PARCEL HE WISHES BE IT 50‘ WIDE - WHETHER IT IS OF BENEFIT TO ANYONE ELSE. MR. REILLY AGAIN REMINDED MR. SMOLEN THAT A PARCEL CANNOT BE CREATED WOULD BE COURT ACTION. MR. SMOLEN ANSWERED, YES PERHAPS. MR. SMOLEN THEN STATED THAT HE HAD DISMISSED MR. SCHMID AND NOW RETAINS MR. HUNTER AS ATTORNEY. DURING THE COURSE OF DISCUSSION MR. SMOLEN ALSO STATED THAT FOLLOWING RECEIPT OF THE BOARD‘S DIRECTIVE HE HAD RETAINED F. WELLSTEIN, SURVEYOR AND WAS GIVEN THE IMPRESSION THAT THE PLAT HAD BEEN FORWARDED TO THE TOWN. THE BOARD CONTACTED fl~. WELLSTEIN AND WAS INFORMED THAT WHEN THE KROCK~SWITHDREW THEIR UNLESS IT CONFORMS TO THE DISTRICT AND PERHAPS THE ONLY SOLUTION OPTION TO PURCHASE THE TAVERN AND ACREAGE AROUND THE BUILDING HE WAS TOLD THE PLAT WAS NO LONGER NEEDED. MR. J. COUTURE, ATTORNEY, REPRESENTING OWNERS OF LANDS NORTH AND EAST OF LANNON AND HWAY 24 ASKED THAT THE B-4 DISTRICT LINES ABUTTING GIFFORD'S PROPERTY, TRIANGULAR IN SHAPE, WHICH MIGHT NOT FALL WITHIN THE 8-4 DISTRICT - THEREFORE REQUESTING DEFINITION. MR. CHASE MOVED, AS SECONDED BY MR. GUHR, THAT THE 8-4 DISTRICT ZONING BOUNDARIES HORE CLEARLY BE INTERPRETED TO INCLUDE THAT STRIP LOCATED AT THE SWS CORNER OF MARTHA MILLER TRACT, SPECIFICALLY WHERE IT RUNS EAST AND WEST ALONG THE GIFFORD PROPERTY, SUBJECT TO SUBMITTAL OF TOTAL LAND USE OF AREA. MOTION CARRIED. ATTORNEY COUTURE STATED THAT IT IS THEIR INTENTION TO REQUEST FOR DIVISION BE DEFINED. THERE IS A SMALL CORNER OF LAND, OWNED BY CLIENT, OF LAND IN THE NEAR FUTURE WITH BUSINESS DEVELOPMENT IN MIND. MOTION MADE BY MR. GUHR, AS SECONDED BY MR. BOSTATER THAT THE BOARD MAKE RECOMMENDATION TO THE TOWN BOARD THAT C. KOENIG'S REQUEST FOR VARIANCE IN LAND DIVISION (RE: LOT 6, SEC. 5) BE GRANTED. MOTION CARRIED.
