UNDER OLD BUSINESS - CHAIRMAN GOTTFRIED BROUGHT THE BOARD GP-TO- DATE CONCERNING THE ANNEXATIOFJ PETITIONS OF HILLVIEW AND VALLEY SAND AND GRAVEL SUBMITTED TO THE CITY OF NEW BERLIN. REGARDING THE REQUEST OF BODUS BROS., RE - EXTRACTING IN SECS. 7 AND 10 THE CLERK WAS DIRECTED TO CONTACT, J. RADTKE, ATTORNEY, FOR BODUS BROS., NOTIFYING THEM OF THE FOLLOWING DECISION MET BY THE BOARD, FOLLOWING THEIR REQUEST THAT THE BOARD EXTEND AN IN- THEY SHALL PROCEED AS REQUIRED BY ZONING ORDINANCE SUGGESTING THAT ZONING THEY PETITION FOR COND. USE STATUS GRANT WHILE IF THEY INTEND FORMAL DECISION THUS SAVING COSTS OF RESTORATION PLANS, ETC. I IF IT IS THEIR INTENTION TO LIMIT QUARRYING TO THE 39 ACRES IN 1-1 TO DEVELOPE THIS PARCEL AND THAT LOCATED IN RC-E IN SECTION THEY WOULD HAVE TO PETITION FOR REZONING, COND. USE STATUS GRANT, ETC. THIS DECISION WAS RENDERED DUE TO VARIED OPINIONS OF MEMBERS SUCH AS ADVISABILITY TO ALLOW EXTRACTION NORTH OF SEC. 18 DUE TO TERRAIN AND NATURAL BEAUTY, ONE ANOTHER MEMBER FELT THAT ENOUGH AREA HAD ALREADY BEEN CREATED FOR EXTRACTION AND CREATING MORE WOULD ONLY BRING MORE PROBLEMS TO THE TOWN WHILE ANOTHER MEMBER FELT THAT PERMISSION TO EXTRACT SHOULD NOT CROSS SECTION LINES WHILE ANOTHER MEMBER FELT THAT SECTION LINES SHOULD NOT LIMIT A MAN'S OPERATION AS LONG AS HE OWNS THE PROPERTY AND IT WOULD NOT BE ADVERSE TO THE SURROUNDING AREA. MR. HACHKOVICH MOVED, AS SECONDED BY MR. CHASE, THE COMMISSION NORTH SIDE OF HIGHWAY 24 FROM LANNON DR., WEST 1,400 FEET TO THE EXISTING OLE DISTRICT LINE FOR A DEPTH OF 400 FEET FROM THE CENTER OF HWAY 24, BE REZONED FROM RS-3 RESIDENTIAL TO 8-4 HWAYS BUSINESS - TOTAL OF 12.0 ACRES. MOTION PASSED. RECOMXEND TO THE TOWN BOARD THAT THE PROPERTY LOCATED ALONG THE REGARDING PETITION FOR EXP. OF COND. USE STATUS GRANT OF JAMES D. ~HERNKE, SAID PETITIONER OFFERED THE FOLLOWING INFORMATION - ADDIT- io^ WILL BE 7' X 14' THUS EXPANDING PRESENT INSIDE SINGLE CAR STALL. QUESTION AROSE AS TO STORAGE OF JUNKED CARS. MR. HERNKE SAID THAT MR. GUHR, PREVIOUS OWNER, HAD JUNKED CARS STORED THERE BEFORE AND AT THE TIME OF PURCHASE AGREED TO MOVE THOSE THAT BE- LONGED TO HIM, BUT HAD NOT. HE HIMSELF USES THOSE THAT HE OWNS FOR PARTS. STRIPPING OF EACH CAR FOR USABLE PARTS PRIOR TO JUNKING OULD NOT BE FEASIBLE DUE TO LACK OF STORAGE, ACCORDING TO HERNKE. %R. HERNKE OFFERED TO PLANT SOME TREES, POSSIBLY POPLARS, THUS SCREENING AREA OFF AND AFTER SOME DISCUSSION REGARDING LEGALITY OF SUCH STORAGE THE FOLLOWING MOTION WAS MADE BY MR. CHASE, AS SECONDED BY MR. BUEHLER, THAT THE EXPANSION OF A COND. USE STATUS BE GRANTED TO JAMES HERNKE FOR PURPOSE OF REMODELLING IN ACCORDANCE WITH SEC. 8, l4c ON PT OF THE flW2 - SEC 70, CONDITIONED UPON REMOVAL OF SAID JUNKED VEHICLES WITHIN ONE YEAR FROM DATE OF GRANT. MOTION CARRIED. MR. EUGENE SOBEK APPEARED SEEKING SOLUTION TO DIVISION OF LAND IN SEC. 15. THE RIGHT TO DIVIDE A PARCEL FROM THE ESTATES 3 ACRE PARCEL WAS WILLED TO HIS SISTER IN A RECENT WILL LEFT BY HIS MOTHER. THE BOARD, IN AN ATTEMPT TO SOLVE THIS PROBLEM, SUGGESTED THAT SUFFICIENT LAND BE RESERVED FOR A PUBLIC ROAD AND IT WAS AT THIS POINT THAT MR. SOBEK SAID THAT HE DOES NOT WANT A TOWN ROAD ADJACENT TO HIS PICNIC AREA. THE BOARD THEN SUGGESTED THAT EACH PARTY IN- VOLVED RETAIN AN ATTORNEY IN AN EFFORT TO SOLVE THEIR PROBLEM. THE CHAIRMAN ANNOUNCED TO THE BOARD THAT THE MUSKEGO ATHLETIC Assoc., HAD TURNED OVER HORN FIELD TO THE TOWN AND ASKED THAT THE BOARD TAKE FORMAL ACTION FOLLOWING DISCUSSION. MR. BUEHLER MOVED THAT THE PLANNING COMMISSION RECOMMEND TO THE TOWN BOARD THAT THEY ACCEPT HORN FIELD IN THE APPROXIMATE AMOUNT OF 11 ACRES FROM THE &USKEG0 ATHLETIC ASSOC., SEC 16. MOTION SECONDED BY MR. nACHKOVICH AND MOTION CARRIED. MR. F. SCHAEFER OF SEC. 13 APPEARED SEEKING PERMISSION TO DIVIDE 3s DWELLING, PRELIMINARY PLAT SHOWS 60 RESERVATION FOR ROADWAY WITH LAND DIVISION MEASURING APPROX. 516 x 300 LOCATED WEST OF THE M. HE STATED THAT IT WOULD It NOT PROTRUDE ANYMORE THAN THE FORMER SIGN, WILL EXTEND UPWARDS AN ADDITIONAL 7', WILL CONSIST OF ONE STEADY LIGHT, 8" LETTERING WITH THE LOWER PART OF A WATER-FALL TYPE LIGHTING.
