ALSO PRESENT WERE KNETZGER, BUDISH & LEE MINUTES OF THE PREVIOUS KEETING WERE READ AND APPROVED. UNDER OLD BUSINESS - CLERK WAS DIRECTED TO CONTACT VALLEY SAND & GRAVEL INVITING THEM TO APPEAR AT A FIEETING TO BE HELD ON DEC. 16~~ TO DISCUSS RESTORATION AND BOND. THE FIRN OF PELLES & JOHNSON REQUESTED THAT A PUBLIC HEARING BE SET TO CONSIDER WHETHER A COND. USE STATUS GRANT BE AWARDED FOR THE PUR- POSE OF ERECTING A SIGN ON A BARN FACIA" ON THE J. SMALL PROPERTY, THAT A PUBLIC HEARING BE SET IN BEHALF OF PELLES & JOHNSON ON DEC. I/ SEC. 1. A MOTION WAS NADE BY NR. GUHR, AS SECONDED BY MR. BUEHLER, 16TH, 8:OO P.M., TO CONSIDER WHETHER A COND. USE STATUS SHALL BE GRANTED FOR THE PURPOSE OF ERECTING A PRESENTLY LEGAL NON-CONFORHn ING SIGN? MOTION CARRIED. M. TESS APPEARED WITH L. HAKM IN AN EFFORT TO RESOLVE POSSIBLE RE- LOCATION OF 33' ROW PROVIDED IN HIS PRELIKINARY PLAT. ACCORDING TO MR. HAWM e59*+33 HIS HOKE IS LOCATED APPROXIKATELY 33' FROM LOT LINE AND IF ROW WERE RELOCATED IT WOULD RUN WITHIN 10-15;' OF HIS HOKE. IN CHECKING PAST COMKISSION AND TOWN BOARD KINUTES IT WAS FOUND THAT MRS. LOUIS TESS WAS GRANTED PERMISSION TO REZONE LAND IN "61, BUT THAT THE TESS'S NEVER RETURNED FOR APPROVAL OF PRELIMINARY'AND FINAL PLAT IN .ACCORDANCE WITH REQUIREMENTS OF SUBD. CONTROL ORD. MR. TESS STATED THAT HE DOES NOT INTEND TO REDIVIDE LAND AS THE 33' ROW PROVIDED WILL LEGALLY SERVE BALANCE OF ACREAGE TO REAR AS WELL AS FULFILL HIS OWN NEEDS AND THAT HE WAS GRANTED PERKISSION TO DIVIDE LAND. ONE BOARD MEMBER FELT THAT RESOLUTION OF THE PROBLEN OF THE RALPH E. LEE ESTATE SHOULD COKE AS A RESULT OF THEIR REQUEST THAT BOTH PROBLEMS COULD PERHAPS~~ESOLVED AT ONE TIME SINCE THEY MIGHT BE INDIRECTLY RELATED. IT WAS AGREED THAT LEGAL OPINION TO OPEN UP THIS LAND-LOCKED PARCEL YET IT WAS THE PLANNER'S FEELING SHOULD BE GAINED AS TO TEE BEST SOLUTION TO THIS PROBLEN. . JYR. IRWIN POSBRIG'S PRELIWINARY PLAT WAS DISCUSSED. MR. KNETZGER UBXITTED TWO SUGGESTED PLANS FOR PARKWAY DRIVE PRESENTLY PROVIDED ~qN OPEN SPACE EASEKENT IN COKP. PLAN AS AN EXTENSION TO HEN~EBERRP DR. MR. POSBRIG SAID THAT HE WOULD NOT BE IN FAVOR OF THE CIRCULAR ROUTE TO PARKER DRIVE. THE BOARD SUGGESTED THAT HE PRESENT THE DRIVE AS PROVIDED, FEELING THAT IT SHOULD BE DIRECTED IN A STRAIGHT I. c PLANS TO HIS SURVEYOR FOR HIS SUGGESTIONS. @ON OCTOBER 28TH, 1963 THE BOARD GRANTED MR. REISER APPROVAL OF A PRELIMINARY PLAT TO DIVIDE LAND IN SEC. 32. MR. KEISER STATED THAT HE HAD RECEIVED A LETTER FROM THE PLANNER NOTIFYING HIM THAT DIVID- ING LAND IN ADDITION" TO TEAT DIVIDED IN THE:-PAST AND THAT PROPOSED ON OCTOBER ~TH WOULD BE IN VIOLATION TO SUBD. CONT. ORD. SEC. 3-A-1-2. HE THEREFORE REQUESTED THAT THE BOARD WITHDRAW THE PREVIOUS PERNISS' ION GRANTED TO EIN THUS PERWITTING HIS SON, JON TO SUBKIT THE SAXE PROPOSED DIVISION IN HIS OWN BEHALF. MR. KEISER HAS SINCE DEEDED THE LAND TO HIS SON RESULTING IN THE FOLLOWING NOTION. MR. CHdSE MOVED, AS SECONDED BY MR. GUHR, THAT THE BOARD APPROVE THE PRELIMINARY THE NE3 - SEC. 32., PROVIDING THAT DEED RESTRICTIONS FOR FUTURE ROW PLAT OF MR. JON KEISER IN ACCORDANCE WITH PLAT SUBMITTED FOR PT OF BE PROVIDED. MOTION CARRIED. MR. KEISER WILL RENOVE 60' ROW AS INDICATED OM PRELIWINARY PLAT THUS INCREASING LOT AREA TO 180' WIDTH FOR EACH LOT ADJACENT TO ROW. THIS RESTRICTION WOULD PROVIDE ROOM FOR A ROW WHICH COULD BE OPENED UP SERVING THE LAND TO TEE REAR IF NEEDED IN THE FUTURE. ~ THE PLAT OF BASS AND oSCHNANN'S sUBD., IN sEC. 15 AND ROAD EXTENSION 1 .ION OF TABLES WAS DISCUSSED.
