GUHR, THAT RECOMMENDATION BE MADE TO THE TOWN BOARD THAT R. BAUSCHEK BE GRANTED COND. USE STATUS FOR PART OF THE SE$ - SEC. 3, CONTAINING 1 ACRE. LEGAL DESCRIPTION ATTACHED. MOTION CARRIED. CONCERNING SONNY & MARGE KOCH'S PETITION FOR COND. USE GRANT AND EXPANSION OF, WAS RESOLVED AS FOLLOWS; CONVENANT AGREEMENT AS DRAWN BY TOWN ATTORNEY WAS REVIEWED BY BOARD AND IT WAS THE OPINION THAT THIS AGREEMENT WAS AN UNREASONABLE RESTRAINT ON THE PROPERTY. IT WAS THE GENERAL OPINION THAT IT WAS THE BOARDIS ORIGINAL INTENT TO MERELY PREVENT THE PETITIONER FROM SUBSEQUENTLY REDIVIDING LAND RESULTING IN INADEQUATE REMAINING LAND NEEDED FOR OPERATION OF GOND. USE GRANT. THIS COULD BE RESOLVED, ACCORDING TO IVELSON, IN CREATE AND RECORD ONE SINGLE LOT. MR. NELSON ALSO FELT THAT SINCE EITHER OF THE FOLLOWING WAYS - OBTAIN A CERTIFIED PLOT SURVEY OR PETITIONER HOLDS CLEAR TITLE TO LAND IN QUESTION AND THAT BOTH ZONING AND THE SUBD. CONTROL ORDINANCE WOULD PROHIBIT FUTURE CREATION OF SUBSTANDARD LOT AREA, IT WOULD BE HIS RECOMMENDATION TO THE BOARD TO GRANT SAID REQUEST. MR. BUDISH MOVED, AS SECONDED BY MR.
