I MINUTES OF THE REGULAR MONTHLY MEETING OF THE PLANNING COMMISSION
I OF THE TOWN OF MUSKEGO HELD ON MAY 20, 1962 AT 0:25 P.M.. MEMBERS PRESENT WERE COOK, BUDISH, BOSTATER & PARES. MR. LEE, BLDG. INSP.
AND PLANNER NELSON WERE ALSO PRESENT.
THE CLERK READ THE MINUTES OF THE APRIL MEETING AND THEY WERE
APPROVED AS READ.
THE FIRST ORDER OF BUSINESS WAS THE CONSIDERATION OF RUDOLPH & TERESA WEBER'S REQUEST FOR A COND. USE STATUS GRANT. THE CLERK
READ THE CORRESPONDENCE RECEIYED FROM THE ATTORNEY. MR. WEBER STATED
THAT THEY DO INTEND TO ADD TO THE LIVING QUARTERS IN THE FUTURE AND
FELT THAT AS THE CHURCH MEMBERSHIP EXPANDED THERE MIGHT BE MORE
OPPOSITION. MR. NELSON EXPLAINED THAT A ~DND. USE STATUS IS A CON-
TROLLED TYPE OF USE AND AS SUBMITTED WOULD, NOT, PERMIT EXPANSION.
IT WAS THE ATTORNEYS OPINION THAT SEC. 176.05 (9PI) PLACES NO RESTRICT- ' @ IONS WHATSOEVER ON THIS PROPERTY AND THE COND. .USE GRANT WOULD NOT
BE A VIOLATION OF THIS SECTION, BUT THE BOARD QUESTIONED WHETHER
1 EXPANSION OF SAID BUILDING WOULD BE LIMITED TO JUST LIVING QUARTERS.
1 MRS. WEBER STATED THAT THEY HAVE PLACED THEIR LIFE'S SAVINGS IN
THIS BUSINESS AND FELT IT UNFAIR FOR THE CHURCH TO OBJECT AS THE
TAVERN HAD BEEN IN EXISTENCE FOR MANY YEARS PRIOR TO THEIR BUILDING. SHE SAID THEY WERE NOT IN OPPOSITION TO THE CHURCH ESTABLISHING
NEXT TO THEM.
MR. BUDISH MOVED THAT RECOMMENDATION BE MADE TO TOWN BOARD THAT THE CONDITIONAL USE STATUS OF RUDOLPH & TERESA WEBER BE GRANTED WITH
NO EXPANSION. MOTION SECONDED BY PARES. BO.TE - COOK, BUDISH AND
PARES IN FAVOR. MR. BOSTATER VOTED AGAINST.
QUESTION AROSE AS TO WHETHER FOUR CONCURRING VOTES ARE NEEDED IN
THE CASE WHEN JUST A QUORUM IS PRESENT. MR. PARES MOVED, AS
SECONDED BY BUDISH, THAT LEGAL OPINION BE OBTAINED AS TO WHETHER
MOTION CARRIED.
MR. FREUDENFELT REPRESENENTING HALES CORNERS SAND & GRAVEL WAS
A MAJORITY OR FULL VOTE IS NEEDED WHEN ONLY A QUORUM IS PRESENT.
PRESENT FOR THE PURPOSE OF SUBMITTING REQUIRED TOPOGRAPHICAL MAP. THE BOARD QUESTIONED GUARANZEED WATER TABLE, POSSIBLE OUTLET OF
.LAKE AND DEPTY. MR. FREUDENFELT SAID THAT THE MAXIMUM DEPTH WOULD
BE 35-40 ', WATER LEVEL SHALL BE MAINTAINED AND AT PRESENT THERE IS
NO OUTLET, BUT IT WOULD BE ADVANTAGEOUS TO DO SO BY PROVIDING SO TO
MAGARICH'S PROPOSED LAKE AND THEN ON T.O BLUHM'S PROPERTY. MR. PARES MOVED, AS SECONDED BY BUDISH THAT THE TOPOGRAPHICAL MAP
BE ACCEPTED AS SUBMITTED. MOTION PASSED.
THE CLERK READ THE CURRENT CORRESPONDENCE. MR. BUDISH MOVED, AS
SECONDED BY MR. BOSTATER, THAT MR. RALPH JENSEN, VICE PRES., OF JENSEN GORP., BE INVITED TO INFORMALLY MEET WITH THE PLANNING
GARDING REZONING OF LAND. MOTION CARRIED.
COMMISSION ON JUNE 25, 1962 AS A FOLLOW-UP TO THEIR INQUIRY RE-
IT WAS UNANIMOUSLY AGREED BY THOSE MEMBERS PRESENT THAT AN AGENDA
BE ADOPTED IN ADVANCE OF THE REGULAR MEETING - POSSIBLY MEETING THE
3RD MONDAY. MR. PARES MOVED THAT THE PLANNING COMMISSION MEET
THE 3RD MONDAY OF EACH MONTH AT 8:00 P.M. , FOR THE PURPOSE OF FORM-
ING AN AGENDA OR FURTHER INVESTIGATE ANY OTHER BUSINESS WHICH
MIGHT NEED TO BE DISCUSSED PRIOR TO THE REGULAR MONTHLY MEETING. MR. BOSTATER SECONDED THE MOTION AND MOTION PASSED.
MR. KENNETH KERR APPEARED SEEKING PERHISSION TO EXPAND THE F. HEINRICH BOAT LIVERY BUSINESS LOCATED ON BIG MUSKEGO LAKE. MR. KERR WISHES TO EXPAND BY SELLING SOFT BEVERAGES AND CIGARETTES. IT
AND EXPANSION OF WOULD REQUIRE COND. USE STATUS GRANT AND CONSEQUENTLY
FOR FILING, ETC. MR. BUDISH MOVED, AS SECONDED BY PARES, THAT
OF NECESSARY PETITION TO CONSIDER THE COND. USE STATUS REQUEST OF KENNETH KERR. MOTION PASSED.
MEETING WAS ADJOURNED AT 1O:OO P.M.
