THE HEARING WAS HELD AT THE MUSKEGO TOWN HALL WITH SMITH, BUDISH, MACHKOVICH, GUHR, PARES, NELSON, SCHROEDER, AND FOLF PRESENT. THE PUBLIC HEARING CONCERNED THAT PETITION OF HILLVIEW SAND & GRAVEL INC., AND PROSPECT HILLS DEVELOPNENT INC., FOR 60 ACRES ON PART OF THE NE$ - SEC. 6. QUESTION - SHALL THE DISTRICT MAP OF THE ZONING ORDINANCE BE AMENDED FROM RES. A-1 TO AGRICULTURAL? THE CLERK READ THE PETITION AND PUBLIC HEARING NOTICE. "3. THOMAS P. MARONEY, ATTORNEY, REPRESZNTING THE PETITIONERS EX- PLAINED THAT IT WAS THEIR INTENT TO RESTORE THE PROPOSED 60 ACRES FOR RESIDENTIAL PURPOSES. IT WAS POINTED OUT BY THE PLANNER THAT THE 750' SETBACK SHOWN WAS INCORRECT AND, MR. MARONEY ASSURED THE BOARD THAT THE CORRECTION WOULD BE MADE (SEC. 3.00 (413-A-1 )e ACCORDING TO MR. BARTEL THERE WILL BE NO STOCK PILING-AT .,ANY TIME AND THEY WOULD BE WILLING TO DISCUSS ALL REQUIREMENTS OF THE PERMIT WITH THEIR NEIGHBORS AND THE TOWN BOARD. THE ANNEXATION ,THREAT WAS DISCUSSED AND MR. BARTEL STATED THAT IT WAS HERELY A NOTICE THE GRANT. IT WAS BROUGHT OUT BY THE CHAIRMAN THAT NO SLOPE SHALL THE FLOOR RAISED THE QUESTION AS TO WHETHER THIS WILL BE REZONED TO 8-3 LOTS FOLLOWING XERMINATION OF QUARRYING. THE ANSWER - COULD OF INTENT AND WOULD, ASSUME THAT THIS COULD BE INCLUDED AS PART OF BE LEFT WHICH IS STEEPER THAN A RATIO OF HORIZONTAL TO 1 VERTICAL. NOT ,TECHNICALLY INCLUDE PLAN OF LOTS AND WOULD BE REZONED UPON TERMINATION; HOWEVER THE TOWN BOARD COULD INITIATE REZONING AT ANY TIME. QUESTION WAS RAISED AS TO TYPE OF EQUIPMENT INVOLVED. ANSWER BY MR. BARTEL - THE HOME OFFICE IS LOCATED IN NEW BERLIN TAXES. MR. MARONEY POINTED OUT THAT THE RESTORATION STUDY SUBMITTED NELSON REMINDED THE PETITIONERS THAT BEFORE COND. USE COULD BE GRANTED A CORRECTED RESTORATION PLAN MUST BE SUBMITTED. MR. BuoIsH SHOWED CONCERN OF THE LAKE LEVEL AND THE PLANNER SUGGESTED THAT THE RESTORATION PLAN INCLUDE A PROVISION NECESSARY TO PRO- TECT THE TOWN'S LIABILITY TO MAINTAIN PROPER LAKE LEVEL. MRS. STARZAK STATED THAT THEIR GROUP DID NOT WISH TO PLACE THE CONTROL AND IT IS THEIR INTENT TO MAKE A FAIR AND EQUITABLE DIVISION OF WOULD BE SHRUNK IN RELATIONSHIP TO PROPOSED SITE & SIZE. MR. ON TOWN LEVEL, BUT TO MAKE IT THE RESPONSIBILITY OF THE SUBDIVISION. SHE ALSO REQUESTED THAT DEFINITE BOUNDARIES OF OPERATION BE PLACED AND THE PETITIONERS OFFERED TO INCLUDE BOUNDARY STAKES AS PART OF THE GRANT. C'. -I PAGE -2- MR. MARONEY PRESENTED THE ORIGINAL LIST OF PROPERTY OWNERS CONSENT AS REQUIRED BY SEC. 3.08 3-A-(1). THE CHAIRMAN INQUIRED AS TO WHETHER THERE WAS ANY OPPOSITION AND THERE WAS NONE. MR. BARTEL AGAIN SAID THAT HE WOULD APPRECIATE IT IF THE ADJOINING PROPERTY OWNERS WOULD MAKE RECOMMENDATIONS TO THEM AND THE BOARD AS TO CONDITIONS OF OPERATION TO BE MADE PART OF THE GRANT. MR. QUESTION - SHALL A COND. USE STATUS 0 GRAVEL INC., AND PROSPECT HILLS DEVELOPXENT INC., FOR 60 ACRES BE GRANTED FOR THE PURPOSE OF QUARRYING OPERATIONS? THE CLERK READ THE PETITION AND PUBLIC HEARING NOTICE. MR. NELSON VIGOROUSLY OBJECTED TO THE REZONING AND COND. USE THE TOWN'S BEST INTEREST. THE REVENUE RECEIVED IS PRACTICALLY GRANT OF THIS AREA BECAUSE HE DID NOT FEEL THAT IT WOULD BE IN NIL IN COMPARISON DONE IN DAMAGE TO ROADS, DEPRECIATION IN SURROUNDING PROPERTY VALUES AND THE DISTURBANCE OF ANY POTENTIAL RESIDENTIAL DEVELOPMENT. MRS. STARZAK STATED THAT SHE AND HER NEIGHBORS SIGNED THE CONSENT DUE TO THE THREAT OF ANNEXATION. MR. NELSON FELT THAT THIS ATTEMPT OF ANNEXATION WAS AN UNTENABLE AND INAPPROPRIATE WAY AT AN ATTEMPT OF REZONING. MR. MARONEY'S REBUTTAL WAS THAT THE ANNEXATION PRO- CEDURE WAS PROPER AND THAT HE FELT THAT THE SURROUNDING AREA IS VERY APPROPRIATE DUE TO THE ALREADY EXISTING QUARRYING OPERATIONS. MR. HEIPEL POINTED OUT THE NATURAL TERRAIN NEEDED WHICH IS PRESENT, OFF- STREET PARKING, BUILDING USES, HIGHWAY SCREENING, EXISTING POND IN ADDITION TO THE BENEFICIAL USE TO THE COKMUNITY AS WELL AS NEED. A SMALL CONCESSION STAND WOULD BE USED FOR SALE OF GOLF EQUIPMENT, SODA, ETC. BUILDING PLANS WERE NOT DRAWN AT THIS TIME, BUT WOULD BE AVAILABLE FOR APPROVAL. MR. SCHROEDER ASSURED THE BOARD THAT HE HAD EXAITINED THE AREA AND KENTIONED THAT THE PETITIONERS WERE AWARE OF THE NEEDED PUBLIC TOILET FACILITIES. MR. BUDISH SAID THAT HE FELT THAT THE TOWNSHIP NEEDED THIS TYPE OF RECREATIONAL FACILITIES AND IT WAS MR. NELSON THOUGHT THAT THIS WOULD ENHANCE THE AREA THUS UPGRADING THE COMMUNITY. THERE WAS NO OPPOSITION TO THIS REQUEST. MOTION WAS KADE BY MR. GUHR TO ADJOURN AT 8:4O P.M. AS SECONDED BY G. MACHKOVICH. MINUTES OF THE REGULAR KONTHLY MEETING OF THE PLANNING COMKISSION HELD ON AUGUST 20, 1961 - 0:40 P.M., AT THE MUSKEGO TOWN HALL WITH THESE KEKBERS PRESENT - SKITH, BUDISH, MACHKOVICH, GUHR, PARES, NELSON, SCHROEDER AND WOLF. THE CLERK READ MINUTES OF THE JULY 24, 1961 MEETING AND THEY WERE APPROVED AS READ. UNDER OLD BUSINESS - THE CONDITIONAL USE STATUS GRANTED TO ACE OIL Co., WAS DISCUSSED. MR. NELSON SAID THAT MR. HIRSCH HAD SUBEIITTED HIS TENTATIVE BUILDING PLANS TO HIS COMPANY AND AS DIRECTED BY THE BOARD WILL RETURN TO THE BOARD FOR FINAL APPROVAL. REGARDING THE AMER. LUTHERAN - LANDSCAPE PLANS WILL BE SUBMITTED TO THE BOARD WHEN COKPLETED. THE CLERK PRESENTED THE PROPOSED BUILDING AND SITE PLANS IN BEHALF OF SHAMROCK STABLES AND IT WAS 2. * PAGE - 4 - THE CONSENSUS OF OPINION THAT THE PLANS SUBMITTED DID NOT SHOW PRO- POSED REMODELLING PLANS, BUT THOSE OF EXISTING BUILDINGS. IT WAS SUGGESTED THAT MR. HAVERKAMP CONTACT A QUALIFIED BUILDER TO OBTAIN @COSTS, PROPER DRAWINGS, ETC. THE BOARD ALSO POINTED OUT THAT TOILET FACILITIES WOULD HAVE TO BE MADE AVAILABLE. MR. GRAVES APPEARED SEEKING APPROVAL FOR THE PRELIMINARY PLAT OF HALE PARK WEST ADD. #2. IT WAS RECOMMENDED THAT PRELIMINARY PLAT BE APPROVED INCLUDING THOSE .CORRECTIONS MADE. ROAD STRIP TO BE RESERVED BY SUB- DIVIDER FOR FUTURE EXIT TO WEST, ENTRANCE FROM TESS CORNERS ROAD TO SIP AND CERTIFIED SURVEY MAPS SHALL BE SUBMITTED. PERCOLATION TESTS ACRE LOTS. MOTION WAS MADE BY MR. MACHKOVICH, AS SECONDED BY MR. BUDISH, THAT THE PRELIMINARY PLAT OF HALE PARK WEST ADD. #2 BE APPROV- MOTION CARRIED. THE PRELIMINARY PLAT OF LAKE DENOON ESTA'TES AS SUBMITTED BY LAND TESTS. MR. GRAVES POINTED OUT THAT RESTRICTIONS SHALL BE INCLUDED WITHIN THE DEEDS FOR LAKE ACCESS. IT WAS THE BOARD AND PLANNER'S WERE REVIEWED AND FOUND SATISFACTORY IN RELATIONSHIP TO PROPOSED TWO ED SUBJECT TO CLEARANCE AND APPROVAL OF FINAL DRAFT BY THE PLANNER. DEVELOPMENT GORP., WAS ALSO REVIEWED ALONG WITH NECESSARY PERCOLATION OPINION THAT LOTS WERE OF ADEQUATE SIZE AND IF ELEVATION WERE KEPT HIGH ENOUGH, IN ACCORDANCE WITH BUILDING RESTRICTIONS, THERE WOULD PLAT FOR LAKE DENOON ESTATES BE APPROVED SUBJECT TO SUBMITTAL OF RE- BE NO PROBLEM. A MOTION WAS MADE BY MR. HACHKOVICH THAT PRELIMINARY U UIRED CERTIFIED SURVEY MAPS. MOTION SECONDED BY MR. BUDISH AND OTION PASSED. MR. C. VALRATH SUBMITTED AN ARTICLE COVERING NUCLEAR BOMB SHELTERS. THE PRESENT BUILDING CODE DOES NOT PROVIDE AS SUCH AND IT WAS MR. NELSON'S THAT NO VIOLATION WOULD EXIST PROVIDING THE SHELTER WERE BUILT UNDERGROUND AS LONG AS THE NEIGHBORING PROPERTY WAS NOT UNDERMINED. A DEBATE FOLLOWED CONCERNING THE PETITIONS OF HILLVIEW SAND AND GRAVEL AND PROSPECT HILLS DEVELOPNENT CORP., FOR A REZONING AND COND. USE GRANT. MR. NELSON STRENUOUSLY OBJECTED TO THE REZONING OR GRANT DUE TO THE ULTIMATE IMPACT ON SURROUNDING PROPERTY, FUTVRE TOWN DEVELOPHENT AND THE NEAR COMPLETION OF THE GENERAL USE PLAN. TWO BOARD MEMBERS FELT THAT THE EXISTING QUARRYING OPERATIONS AROUND THIS SITE, PROPOSED HIGHWAY 15, TERRAIN, ETC., WOULD DISCOURAGE ANY SUBSTANTIAL RESIDENTIAL DEVELOPMENT. MR. MACHKOVICX MOVED~ AS SECONDED BY MR. GUHR, THAT RECOMMENDATION BE MADE BY THE BOARD TO THE TOWN BOARD THAT THE PETITION OF HILLVIEW SAND & GRAVEL AND PROSPECT HILLS DEVELOPMENT TO REZONE APPROXIMATE 60 ACRES IN PART OF THE NE$ - SEC. 6 BE GRANTED.
