Tho question here ie apparently one of constitutionality. It mks
&a feeling of the Board and the Tm Attorney that the doregoing
.I requirement tenda to leave the applicant for a prmit completely
at the mercy of his neighbors; that it conatitutso a denial of hi3
right to be heard by the Board: and, that it tenda to ahift the
burden of decision from the Board, where it rightfully belOng5, to
othmrs not in a podtion of authority. The remaining raquirements
governing liinited sand or gravel mining operatione appar to .be
adequate to aafeguk-d the Tcwn from indiocrisinata acti-?iiioo of
thio type.
The mtaff ie generally in agreement with the Tawn official3 on thio
wtter; and it is therefore recommended that thi3 ordinance be
approved, and that this reconmendation be transmitted to the Plan-
ning and Development Committee for eubmlttal totfre County Board.

Milwaukee Helicopter Airways. hc. would like to operate a
sightseeing ride concession at the Muskego Beach Amusement Park.
Presently based in Milwaukee, we provide passenger service from
General Mitchell Field to several locations in Milwaukee and Waukesha
Counties, Mondays through Fridays. We would like to operate at Muskego
on Weekends. I feel our service could be an asset to Muskego in that
passengers flown are from many areas and have the opportunity to view
Muskego from the air, which is most advantageous, and could possibly be
potential residents, both private and commercial. Muskego is a pretty
area and modern expansion is readily apparent.
We did operate one day, July 15, which confirmed our opinion
of the potential business in the area. Numerous complaints were received
plained to me that we were in violation of a zoning ordinance which pro-
by Mr. Smith due to the noise and nuisance involved. Also, it was ex-

Now we arrive at three problem areas.
1. Lack of regulations covering helicopters.
2. How we can modify our operation so as not to create
a disturbance to your residents.
3. Asking for a conditional use of an operation not
allowed in a business area.
tions needed to govern helicopters and airplanes. The federal government re-
alized this firat and took appropriate action. Every metropolitan area in
the country has either passed or is in the process of passing a helicopter
ordinance that will justly serve local requirements. The City of Milwaukee
with your comission to discuss feasability of adopting an ordinance that
has recently passed one also. I would appreciate the opportunity to meet

our present area. Operating as such we would never proceed further in-

operate and still be compatible with the wishes of your residents.
Helicopters are proven safer than any other form of public trans-
maximum safety in mind. Equipment and pilots are licensed by the federal
portation, excluding scheduled air lines. Our operation was planned with
and state governments. Periodic inspections and flight checks are given
to insure safe operation. This is not a fly-by-night, cheap operation. It

the present zoning.
At present aircraft can only operate in agricultural areas. Heli-

RE: Bass Proposed Platting
Gentlemen:
We have checked with the Waukesha County Park and Planning Commission
with regard to the problem of approving this plat without connection to a
public street and find that the question is one of Town policy determination.
It should be recognized that the Town in accepting dedication for a public
road must assure itself of the capacity to reach such road with public
service equipment. It would appear that a minimum condition would be that
the Town be given assured easement over the connecting private road. An
alternative possibility would be to require that the roads in the plat be con-
structed according to Town specifications but that such roads remain private
until such time as public connection can be provided.
Before further consideration can be given to the plat percolation test data
must also be submitted.
Respectfully,
NELSON & ASSOCIATES
William L. Nelson
