December 23, 1959
Commission was held on December 21, 1959. The Chairman called the
meeting to order at 8:15 P. M. Board members present were: Gottfried,
Cook, Pares, Budish and Guhr. Mr. L. Schroeder, Mr. White and
Mr. C. Ball were also present.
The minutes of the November 25, 1959 meeting were read by the
secretary and were approved by the commission as read.
The first order of business was the consideration of the request
made by Rev. John M. Dzuro, Secretary Urban, Work, of the Synod
of Wis. of the United Presbyterian Church in the U.S.A., 2.55 W.
Broadway, Waukesha, Wis. Request was made on behalf of a group of
residents in the Hales Corners area and the trustees of the Milw.
Presbyterian Church to erect church structures and facilities on
H. Corners, intersection of Highways 24 and 100, and about 2,000 the premises of a tract of land located about 2.3 miles west of
ion of proposed site on record with the secretary. Approach to.
the premises is sought from Highway F!H and also from Highway 24,
if possible. The commission explained to Rev. Dzuro that the re-
quest for this type of structure would fall into the Conditional
Use Status under our Zonirg Ordinance (3.08). Their intentions
are to build 3 attached units, will offer ample parking facilities,
but do not plan on building a school nor provide for burial grounda.
Rev. Dzuro was directed to submit the folloning in triplicate;
formal application, plot plan showing location, building and site
plans and plan of operation, a list of names of people all living
within 300' of the area and lastly make a $25.00 deposit with the

Representative, Waukesha Div., Natll. Adv. Co., 1213 Grant St.,

Products, Muskego, Wis. Their firm erected and installed an adver-
tising sign, located east.of the Woods Road on Highway 24, around 1947 and just recently was denied a permit by the building inspector
to remove and replace the head due to a violation of zoning ordinance.
It was explained that the structure Itself had not been altered in
any way and the only change made was the head replacement. "

Only the faces are changed in the case of billboards and structures
similar to it in material. Mr. Schroeder explained that the reason
Mr. Pettey was denied was riue to a zoning ordinance violation.
The sign Is approximately 4 x 61, set-back is 37' which is a vio-
lation and also the violation has been brought to the attention
of the Inspector several times by people living in the area.
Following much discussion it became the general consenus of opinion
of the board that this particular case would come under the juris-
diction of the Board of Appeal and Mr. Pettey was then directed
tocontact them. Mr. Pettey testified that he has several other
similar structures to be installed within the township end he would
be very anxious to proceed correctly. The clerk was directed to
forward 3 appeal papers.
Mr. Cook moved, as seconded by Pares, that in view of the fact that
Mr. Petteyls request is not within the jurisdiction of the commission
Mr. Pettey-be directed to submit his appeal to the Board of Appeals.
Motion passed by unanimous ballot.
Mr. Clarence Walrath, who is presently setting up the uniform address
system for the Township of Muskego appeared to ddscuaa the inconsia
said that there are many private roads in the town and the uniform
tencies or irregularities on the present township map. Mr. Walrath
system would provide for these areas. pSt of areas was submitted
Walrath that the quarter section lines be numbered to coincide
to the commission for consideration. A suggestion was made by Mr.
with the grid numbers. The board assured Mr. Walrath that they
would take these matters under consideration.
Next order of business was the consideration of the petition of Earl
Breunig for zoning change located in Sections 34 and 35. Mr.
Breunig wishes to rezone hia land fram Agricultural to A-3, legal
description and plot plan on file withcthy secretary in addition
to petition. Mr. Ball read the findings of Nelson-Ball& Assoc.,
regarding this request. It was the general opinion of the board
that they would look at this request favorably after the long range
study is completed. Mr. Breunig stated that there is 37 acres of
less desirable' land due to elevation and the zoning of this parcel
would be left up to the discretion of the cammission. The recommendat-
Mr. Breunig was asked if a hardship would prevail if this request
ions made by the planning consultants in regard to above were read.
was tabled unt.ll the complete study is made and he answered in the
affirmative. &t this point Mr. Cook made a motion that the comiss-
ion proceed in, accordance with Nelson-Ball & Assoc. reconmendation
and that is to declare a moratorium, with the exception of any
caae in which hardship is involved, on zoning changes and then
at the time of the completed study reconsider Mr. Breunigts request.
Mr. Pares seconded the motion and motion carried unanimously.
!he petition of Fanil Hribar, 10930 W. Loomis Rd., Hales Corners,
Wis., was brought to the attention of the board and Mr. Ball
reviewed their findings regarding this situation. Petition, legal
description, etc., are on file with the secretary.
After much discussion and deliberation it was the opinion that
Mr. Hribarts request be denied on grounds contained in the review.
It is felt.that the town has need to preserve its industrially
zoned tracts for ultimate industrial development. In this case,
quarry operations would materially scar the largest single indus-
trially zoned site in Muskego and reduce its potential for ulti-
mate industrial development. Town has also rejected two previous
requests for quarry permits in this neighborhood due to their
desire of attempting to protect the topography of the area.
The situation of restoration on Durham Dr. involving Mr. Hribar
was again discussed. The commission felt that ivir. Hribar is in
no position to attempt to bargain with the town as the petitioner
is required. by ordinance to restore the Durham pit--a requirement
that must be met regardless of whatever conditions might obtain
with respect to the Crowbar Rd. permit. In hopes that this
situation could be resolved amiably several suggestions were
made; one of which was to call in Mr. Hribar perhaps for the Jan.
meeting and another would be to contact Mr. Rippenmeyer to deter-
mine the procedure regarding the above. Mr. Guhr suggested that
the town attorney draw up a directive to Mr. Hribar reminding him
of his obligation in restoration on Durham, and remind him also
of his obligation to draw up an agreement worthy of the town's
signature.
Mr. Cook made a motion that Mr. Hribarfs request for a Conditional
Use Permit for quarrying operations not be considered by the
commission due to an improper application and also due to the
fact that a limited zoning moratorium has been placed on the town
at the present time. Motion seconded by Eiudish and motion carried.
The clerk was directed to send Mr. Hribar a letter of same.
!he petition of William Jansen, R. 2, Hales Corners, Wis., for
board. Mr. Jansenfs request was the rezoning of 13 acres of land
rezoning of 13 acres in Section 13 was then considered by the
located in the NE*-of Section 13 from Residence A-1 to A-2 or A-3.
The board felt as- did Nelson and Ball that the lands in question
are' surrounded by A-1 zoning and a built-up subdivision of roughly
lots under A-1 zoning. On the basis of those findings Mr. Pares 100 acres adjoins to the west that was developed with 1 acre
moved, as seconded by Cook, that Mr. Jansen be denied his request.
Motion passed. The secretary was directed to advise Mr. Jansen
end also make arrangements for the $25.00 hearing refund.
Mr. Ball stated that the reconnaissance study is still incomplete,
but that an Interim Sign Ordinance-could be formulated by the
January meeting.
At 11:15 P.M. a motion was made by Cook, as seconded by Budish,
to adjourn. Meeting adjourned.

Dear Sirs:
Below are listed several inconsistencies which
appear on our present Town road map.
Also highways which have been assigned street signs
giving the highway as their official name; such as Janesville
Rd. marked as Hy.24. In discussing the matter with Don
Hollister he stressed the importance of having names of high
ways and roads coincide with the established names used in
neighboring localities.
Furthermore it is a known fact that highway numbers
are subject to change at any time by either the Federal, State
or County highway commission&
I have also listed several of the private lanes
that are in common use by a great many people. These lanes,
though not present town roads, should have signs indicating their
existence. An example - (Kurte Lane on the Woods Road - turn in
where all the mail boxes are grouped.)
