CALL TO ORDER
Alderperson Madden called the meeting to order at 5:01 PM.
PLEDGE OF ALLEGIANCE
Those present recited the Pledge of Allegiance.

The meeting was posted in accordance with open meeting laws.
APPROVAL OF MINUTES
Alderperson Engelhardt made a motion to approve the minutes of December 17,
2018. Alderperson Borgman seconded.
Motion Passed 3 in favor.
STATUS OF PROJECTS
Discussion update. No formal action may be taken on any of the following:
Waukesha Water
Director Kroeger stated we will have 90% plans available in April for the return flow only with a
30” pipe. Public Information Meetings will be held in Spring 2019. Some residents will be
inconvenienced again, just as with the Moorland Road construction.
Bay Lane Reconstruction
Director Kroeger stated the City is reviewing the final PSE (plans, specs and estimates) plans.
Plans will go out to bid in Feb/Mar 2019. Construction to take place between May-Sept 2019.
Bellview Road will NOT be connected.
Hillendale Reconstruction
Director Kroeger stated the 60% plans are moving forward without a trail and a reduced speed
limit of 35 MPH to 30 MPH. Drainage issues are currently being addressed.

Request for Curb Cuts at City Hall for Snowmobiles
Director Kroeger stated this is the second time this request has been brought to the Committee
to determine if we will allow the curb cuts and who will pay to have this completed. The City
does not have any type of agreements in place with the Icetronauts along Racine Avenue.
However the snowmobile club requests yearly access to Little Muskego Lake and Lake
Denoon. Director Kroeger believes the snowmobiles are truly riding in the Waukesha County
right of way and we cannot make the decision to allow the curb cuts. Chief Rens gave some
additional background regarding the laws, driving at night, the legality of the trail, complaints,
etc.
Alderperson Madden made a motion to deny the request for Curb Cuts. Alderperson
Borgman seconded.
Motion Passed 3 in favor.

COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW
The Committee briefly discussed running low on road salt and the City is currently combining
sand with the salt. We are looking into purchasing more, but it is very costly this year. The City
is also receiving numerous complaints about garbage/recycling pickups that were missed.
Advanced Disposal is currently caught up, but did have vehicle issues during the deep freeze.

seconded.

Subject: Watermain Assessments

The City of Muskego took over four private water services built in the middle or late 1970s.
The areas of concerns include Lake Lore (2000s), Lake Brittany (2000s), Guersey Meadows
(1980s), and Kristin Downs (1990s) subdivisions. The City of Muskego did not charge a
hook up fee or charge to put these homes in the WCA (Water Capacity Assessment).
These systems are made out of ductile iron and have reached their life expectancy. These
areas have consistently been the City of Muskego’s highest areas of water main repairs.
The estimated cost to design and construct brand new watermains for these 4 areas is
approximately $8.5 million.
The watermain will not be replaced until they are in the area of the road program. The
City of Muskego will continue to make repairs as needed.
For the Baylane road project we have a small portion of watermain (approximately 1,000
feet) to be replaced. Since we are digging up Baylane road for this project this is the time to
do this work. Therefore, the City of Muskego needs to put a policy in place on how to
handle these costs so we are consistent moving forward.
Recommendation for Action by the Committee:
I am looking for a policy recommendation from the Committee.

Subject: Guhr CSM
Date: March 12, 2019
Mr. Guhr is requesting a waiver from the following ordinance 392-41 sewage disposal
facilities per his CSM. Please refer to attach ordinance 392-41, 392-35 and a copy of the
Guhr CSM. Existing sanitary sewer is located on Kelsey Drive just west of the Guhr CSM
and as part of City of Muskego ordinance must extend to the farthest affected area.
Mr. Guhr is asking for a waiver from the requirement to extend sanitary sewer down Kelsey
Drive as part of the CSM. This land division is being done for estate planning currently not
development. The City of Muskego staff recommends this waiver. However there will be
firm language on the CSM on the requirement of sanitary sewer extension if/when
development is proposed on the Guhr CSM or the property to the east of the Guhr CSM
down Kelsey Drive.
Recommendation:
The City of Muskego staff recommends to the Public Works and Safety Committee for a
waiver with regards to the ordinance regarding sanitary sewer extension as part of this
CSM.
However, there will be very descriptive language placed on the CSM with regards to this
waiver. If the owners proposed to build on this land, sanitary sewer will be extended along
Kelsey Drive to the edge of the property. If the land is sold for a proposed development, the
sanitary sewer will be extended along Kelsey Drive to the edge of the property. If the land
to the east of the Guhr CSM is developed, sanitary sewer must be extended along Kelsey
Drive to the edge of the Guhr CSM. Etc.

Chapter 392. Land Division
Article VI. Required Improvements: Conventional
Subdivisions
§ 392-41. Sewage disposal facilities.
When public sanitary sewer facilities are available to the subdivision plat or certified survey
map, the subdivider shall construct sanitary sewerage facilities in such a manner as to make
adequate sanitary sewerage service available to each lot within the subdivision. When only
private sanitary sewer facilities are available to the subdivision plat or certified survey map,
the subdivider shall follow the rules and restrictions of Waukesha County and Ch. SPS 383,
Wis. Adm. Code. In addition:
All subdivisions and minor land divisions within the adopted sanitary sewer service area
shall be provided with public sanitary sewer facilities, unless a waiver is granted by the
Public Works and Safety Committee or Public Works and Development Director or
designee in accordance with the procedures of Chapter 290, Sewers, of the City Code
due to insufficient service.
The subdivider shall install sewer laterals to the street lot line for all lots.
The size, type and installation of all sanitary sewers and sanitary sewer laterals
proposed to be constructed shall be in accordance with plans and standard
specifications adopted by the Common Council.
The subdivider shall assume the cost of installing all sanitary sewers, sewer laterals and
sewer appurtenance within the proposed subdivision, except for the added cost of
installing sewers greater than eight inches in diameter which are necessary to serve
tributary drainage areas lying outside of the proposed subdivision, unless the over-sizing
is required to serve vacant lands owned or controlled by the subdivider or adjacent
landowner. In addition, the subdivider shall pay to the City a sanitary sewer trunk line
connection fee based on the added cost of installing larger sewers in the total tributary
drainage area which shall be prorated in proportion to the ratio which the total area of
the proposed plat is to the total drainage area to be served by such larger sewers.

Chapter 392. Land Division
Article VI. Required Improvements: Conventional
Subdivisions
§ 392-35. General standards.
All required improvements shall be constructed in accordance with plans and standard
specifications approved by the City Public Works and Safety Committee, City Engineer,
Wisconsin Department of Natural Resources and Milwaukee Metropolitan Sewerage District,
as may be appropriate. Such plans and standard specifications shall be submitted, reviewed
and approved in accordance with § 392-49 of this chapter.
The improving of a dedicated roadway to City specifications must follow the following
guidelines: All land divisions which create new public right-of-way shall be required to
improve, within said right-of-way, a public road to City of Muskego specifications and
detail drawings. Should the road end with a permanent cul-de-sac, land must be
dedicated per City standards and the road constructed to City of Muskego
specifications. Should the road end with a future possible road extension, a temporary
cul-de-sac may be constructed with a temporary easement; however, the size must be
the same as a permanent cul-de-sac. City of Muskego stormwater management
requirements must be met should the improvements add more than 1/2 of an acre of
impervious surface. All roadway, grading, storm sewer, and stormwater plans must be
reviewed by the City of Muskego as required by Municipal Code. The following
requirements vary by the size of the parcels being divided:
Should a land division create parcels with an average size of less than or equal to
40,000 square feet, the road shall be built to City specifications that include curb
and gutter and storm sewer.
Should a land division create parcels with an average size of greater than 40,000
square feet, the developer may choose to request a Public Works and Safety
Committee decision regarding the type of improvements required. The only option
the Public Works and Safety Committee will consider other than curb and gutter
section is ditch section construction per City of Muskego specifications. Should this
option be permitted, the ditch sections shall be maintained by the developer initially
and ultimately the homeowners' association. Furthermore, these restrictions
outlining the responsibility for this maintenance shall be recorded in a developer's
agreement approved the City's Common Council concurrent with the final land
division document.
Private driveways within newly created public right-of-way are not allowed under
any circumstance.

Improvements to be extended to farthest limit of parcel or lot. Any and all improvements,
streets, or utility services required by this chapter, for the subdivision, certified survey
map, or condominium plat, shall be extended to the farthest limit of the parcel or lot as
set forth on the plans and specifications approved by the City. If determined by the Plan
Commission, based on the information of engineering staff, that a resulting development
will cause increased effects on existing infrastructure, the cost of all reasonably
necessary improvements on the exterior of a development, such as expanded
roadways, intersections, and/or utility extensions, shall be paid by the developer/owner.
Improvements to be extended to farthest affected area. Any and all improvements,
streets, or utility services required by this chapter, for the subdivision, certified survey
map, or condominium plat, shall be extended to the farthest affected area. If determined
by the Public Works and Safety Committee or Plan Commission, based on the
information of engineering staff, that a resulting development will cause increased
effects on infrastructure, the cost of all improvements on the exterior of a development,
such as expanded roadways, intersections, and/or utility extensions, shall be paid by the
developer/owner.
