MINUTES OF MEETING HELD MONDAY, APRIL 15, 2013
Ald. Neil Borgman called the meeting to order at 6:00 PM. Also present were Ald. Robert
Wolfe and Public Works Director David Simpson. Ald. Eileen Madden absent.
Ald. Borgman led those present in the Pledge of Allegiance.
The meeting was noticed in accordance with the Open Meeting Laws on April 12, 2013.
APPROVAL OF MINUTES OF MARCH 18, 2013
Ald. Wolfe moved to approve the minutes of March 18, 2013. Seconded by Ald. Borgman.
Motion carried 2-0.
STAFF REPORTS
None
STATUS OF PROJECTS
Director Simpson gave updates on the following projects:
Janesville Road Reconstruction – Utility relocates are going okay. Rain slowed them down.
Racine Avenue Recreational Trail – Still waiting for permit from DNR.
2013 Road Program – Will be out for bid soon.
Flood Proofing of Structure on Saroyan Road – Still working with DNR on some issues.
UNFINISHED BUSINESS
Discuss Moose Lodge’s Request for Reduced Interest Payment Related to a Deferred
Sanitary Sewer Assessment – Director Simpson advised discussion at the last meeting we
wanted to discuss the policy in general before we make a motion on it. Ald. Wolfe made a
motion to defer while the Committee looks into the policy. Ald. Borgman seconded. Motion
carried 2-0.
NEW BUSINESS
Discuss Drainage issue at W174 S6802 East Drive – Director Simpson stated the
homeowner has expressed great concern related to storm water runoff coming from
City owned conservation land onto their property. There is a storm inlet and berm
system that was designed and installed to collect runoff from the conservation land.
This inlet has become clogged during past rain events and the water then spills over
the berm and down the property line. The resident would like the City to solve this
issue so that the water does not spill onto her property. There are two options to
resolve this issue. One would be to install an end section out of the existing field
inlet to prevent the existing inlet from becoming clogged with leaves. The second
would be to install the end section and also construct an overland relief path (swale)
down the City’s property to East Drive. If this option were chosen, many mature
trees would need to be removed from the City’s conservation land. If this option is

chosen, we should refer this issue for discussion at the Conservation Commission
as this is deemed conservation land. Ald. Borgman made a motion to install an end
section and a recommendation to the Conservation Commission that we would want
to construct this swale and remove some of their trees. Seconded by Ald. Wolfe.
Motion carried 2-0.
Discuss Drainage from Tess Corners School to Cornell Drive. (Ald. Harenda) – Ald.
Harenda stated that in 2011 flooding was transpiring around the City and this was
one of the areas. Work transpired and water now flows south. What we still have is
the issue of storm water runoff coming from Tess Corners Elementary School. We
still have issues from storm runoff from Tess Corners that travels over land. Ald.
Harenda said he wanted to make the Committee aware of this and come up with
some options. Per Director Simpson during heavy rain in 2010 the City experienced
multiple locations where flooding caused damage to homes. One of those problem
areas were homes near Cornell and Catalina intersection. The City installed a relief
sewer that would reduce the likelihood of future flooding of the intersection. The
project was installed by fall of 2011. A resident along the north side of Cornell Drive
had also requested that the City look into the possibility of installing a storm sewer
through yards from Cornell Drive north to the Tess Corners Elementary School
property to reduce the amount of overland drainage through the side yards. During
the initial design, the Public Works Committee voted to add this section of pipe to the
project for an estimated cost of $22,500. Design progressed and more detailed cost
estimates were produced by GRAEF. The project was severely over budget and the
decision was made to reroute the main pipe and remove the section of pipe between
the homes to the north of Cornell Drive. After discussion with Committee, Ald.
Borgman stated to keep monitoring it, and check with school district.
Review New Berlin’s Request for an Additional Sanitary Connection in the Linnie Lac
Area – Per Director Simpson the City of Muskego and the City of New Berlin entered
into an agreement to provide a limited number of sanitary sewer services. In this
agreement, it specifically states that no additional connections are to be allowed
within the area referred to. The City of New Berlin is requesting the City of Muskego
consider one additional connection to a parcel. Should the City of Muskego approve
this request, the existing agreement must be amended and approved by the
Common Council. Staff feels that the addition of this connection in this area would
promote the overall environmental health of this area, and recommends working with
New Berlin toward an amendment to the current agreement. City of New Berlin has
offered to reimburse us for all legal fees. Ald. Wolfe made a motion to approve
“Agreement to Amend the Linnie Lac Sewer District between the City of Muskego
and the City of New Berlin” pending approval by the City Attorney. Seconded by
Ald. Borgman. Motion carried 2-0.
Review Vision Corner Encroachment Request for Monument Sign for a New
Commercial Building at the Northeast Corner of Moorland and Janesville – Per
Director Simpson the Muskego Retail Center is requesting that their proposed
monument sign be located within the City’s standard vision setback area. Given the
geometrics of this intersection, there is no need to enforce the vision corner setback
in this situation. Ald. Borgman made a motion to approve placement of the

monument sign in the vision setback area. Ald. Wolfe seconded. Motion carried 2-
0.
Discuss Revised Prioritization of Recreational Trail Construction and Potential
Authorization to Proceed with Waukesha County Engineering Assistance for CTH
OO Recreation Trail Design – Director Simpson stated the recreational trail
construction plan for 2014 included the segment of trail along CTH “00” (North Cape
Road) from Durham Drive to STH 36 (Loomis). He would like to utilize Waukesha
County for survey and design, and move ahead with a design agreement with the
County that would be taken to future Finance Committee and Common Council
Meetings for approval as the design dollars are not currently in the 2013 budget.
Ald. Wolfe made a motion to move forward with design agreement and final approvals for
expenditure. Ald. Borgman seconded. Motion carried 2-0.
