MINUTES OF MEETING HELD MONDAY NOVEMBER 4, 2009
Alderman Snead called the meeting to order at 5:00 p.m. with Ald. Schneider and Ald.
Schaumberg present along with City Engineer David Simpson.
Alderman Snead led those present in the Pledge of Allegiance.
The meeting was noticed in accordance with the Open Meeting Laws on November 2, 2009.
APPROVAL OF MINUTES OF OCTOBER 7, 2009
Ald. Schneider moved to approve the minutes of October 7, 2009. Seconded by Ald.
Schaumberg. Motion carried 3-0.
CITY ENGINEER/PUBLIC WORKS SUPT. REPORT
City Engineer Simpson informed the Committee that leaf pick up has started.
STATUS OF PROJECTS
Janesville Road Phase II – Nothing new
Refuse/Recycling Contract – City Engineer Simpson stated that the pre-bid meeting will be held
thth
November 5, 2009. Bids are due back to the City November 18, 2009. The contract might
have to go straight to Council.
Durham Drive Reconstruction – City Engineer Simpson informed the Committee that the City
received a letter from the DNR stating that they would most likely deny the proposed new
alignment based on alternatives.

NEW BUSINESS
Consideration regarding mutual release and agreement between the City of Muskego and
Richard and Kathy Beaudry (W180 S6698 Muskego Drive) – Mr. and Mrs. Beaudry are
contending that the City’s Department of Public Works installed a storm sewer on the properties
directly adjacent to their property and this installation has caused damage to their property. The
Beaudry’s have also claimed that the city installed a portion of the storm sewer onto their
property without an easement. The City has completed their survey work and it appears that a
small section of the pipe installed does encroach onto their property. Mr. Beaudry would like the
City to install stone near the toe of the hill, which he believes will stabilize the bottom of the hill
and provide some relief to his problem. In exchange for permission to enter upon the Beaudry’s
property to relocate the pipe into the proper location and for the signing of a Mutual Release, the

City will provide the services outlined above. The City Attorney has already approved these
agreements. Ald. Schneider moved to approve the Mutual Release and Agreement to the
Common council and direct City staff to complete the work as soon as weather and staff
time permits. Seconded by Ald. Schaumberg. Motion carried 3-0.
Request for consideration of reduced roadway improvement requirements for Laura Lane by
Mike Birkley – Mr. Birkley has submitted a request for information as to what requirement will
be placed on him should he decide to create a lot at the end of Laura Lane. City Engineer
Simpson informed the Committee that Laura Lane is a publicly dedicated roadway, however it
was built prior to our current policy requiring all roads to be publicly improved. When the three
lot land division was completed the developer was given a stipulation should more than three
houses access the road the future developer that added the fourth house would be required to
update Laura Lane to full City standards. The third house on Laura Lane is accessed off of
Schultz Lane, so technically at the present time there are only two houses that access Laura Lane.
City Engineer Simpson recommends allowing Laura Lane to be updated to the private road
standard of a 16’ wide 8” thick crushed aggregate roadway with a full cul-de-sac at the end.
Should any other properties wish to access Laura Lane, a full improvement to City standards
should be revisited. Ald. Schneider moved to approve City Engineer Simpson’s
recommendation. Seconded by Ald. Schaumberg. Motion carried 3-0.
