PUBLIC WORKS COMMITTEE
MINUTES OF MEETING HELD MONDAY AUGUST 14, 2006
Alderman Buckmaster called the meeting to order at 5:00 PM with Ald. Bob Melcher and
Ald. Nancy Salentine present along with Engineering/Building Inspection Director Sean
McMullen, Public Works Superintendent Wayne Delikat and those per attached list.
Alderman Buckmaster led those present in the Pledge of Allegiance.
The meeting was noticed in accordance with the Open Meeting Laws on August 11,
2006.
APPROVAL OF MINUTES OF JUNE 19, 2006 – Ald. Buckmaster requested a change
be made to the adjournment. Ald. Borgman should be Ald. Melcher moved to adjourn
the meeting at 6:40 PM. Ald. Melcher moved to approve the corrected minutes of
June 19, 2006. Seconded by Ald. Salentine. Motion carried 3-0.
COMMUNICATION FROM THE CHAIRMAN
Ald. Buckmaster thanked the Public Works Department for the work that was done to
repair the buildings in the Settlement Center.
ENG/BLDG DIRECTOR – PUBLC WORKS SUPT. REPORT
Superintendent Delikat reported the department is continuing to install culverts.
STATUS OF PROJECTS
Janesville Road Reconstruction Project – Waukesha County has made the final punch-
list walkthrough and is recommending the final payments be made to the contractor.
Field Drive Repaving – Payne and Dolan completed the driveway repair late June, this
item will be removed from the agenda.
Durham Drive Realignment – Funding applications will be distributed by WISDOT later
this month. We will review the opportunities at that time to fund this project.
Settlement Center (Old Town Hall) – discussed further under agenda item.
Waukesha County Traffic Study – nothing new to report.
Urban/Rural Drainage – nothing new to report.
UNFINISHED BUSINESS
Further discussion on 3-4 parcel land divisions and a policy for improving right-of-way to
City standards- Director McMullen informed the Committee of Assembly Bill 509 that if

passed would take away the $50,000 maximum liability for a municipality for failure to
maintain roadways. The following is the proposed policy.
City of Muskego- Public Works Policy
Policy Regarding Roadway Construction within Public Right-of-Way(ROW)
Application: This policy applies to any land division within the City of Muskego that dedicates new ROW
other than that which runs parallel to the existing ROW.
Requirements/Procedure: All land divisions which create new public ROW (generally sixty feet in
width) shall be required to improve, within said ROW, a public road to City of Muskego specifications and
detail drawings. Should the road end with a permanent cul-de-sac, land must be dedicated per City
standards and the road constructed to City of Muskego specifications. Should the road end with a future
possible road extension, a temporary cul-de-sac may be constructed with a temporary easement,
however, the size must be the same as a permanent cul-de-sac. City of Muskego storm water
management requirements must be met should the improvements add more than one half of an acre of
impervious surface. All roadway, grading, storm sewer, and storm water plans must be reviewed by the
City of Muskego as required by Municipal Code. The following requirements vary by the size of the
parcels being divided:
1) Should a land division create parcels with an average size of less than or equal to 40,000 square
feet, the road shall be built to City Specifications that include curb & gutter and storm sewer.
2) Should a land division create parcels with an average size of greater than 40,000 square feet,
the developer may choose to request a Public Works Committee decision regarding the type of
improvements required. The only option Public Works Committee will consider other than curb &
gutter section is ditch section construction per City of Muskego specifications. Should this option
be permitted the ditch sections shall be maintained by the developer initially and ultimately the
homeowners association. Furthermore, these restrictions outlining the responsibility of this
maintenance shall be recorded in a Developer's Agreement approved the City's Common
Council concurrent with the final land division document.
3) Private driveways within newly created public ROW are not allowed under any circumstance.
It is the City Attorney’s opinion that allowing private roads in a public right-of -way is not
good practice and should not be continued. Ald. Melcher moved to eliminate the
existing policy regarding roadway improvements and adopt the proposed policy
effective August 23, 2006, and further move to direct staff to amend the existing
Land Division Ordinance (Chapter 18) to reflect the proposed policy and bring
before the Common Council for approval of said amendment. Seconded by Ald.
Salentine. Motion carried 3-0.
Preliminary discussion on reopening of Durham Drive cul-de-sac (Durham Drive and
Janesville Road) – Director McMullen discussed the costs for each of the three options
with the Committee. The costs range from $963,831.05 down to $229,680.00. Ald.
Buckmaster suggested deferring this item to forward this information on the group
petitioning to open the cul-de-sac. Ald. Salentine stated this project had several public
informational meetings and the residents were informed of what was planned. Ald.
Buckmaster moved to defer. Seconded by Ald. Melcher. Motion carried 2-1. Ald.
Salentine voted no.

Discuss on-going drainage problem at S68 W17941 Island Drive – Tolfa Residence –
The costs for the City to do the work would be $3600 for storm sewer and $350 for
stone bedding and cover. It is the City Attorney’s opinion that easements would need to
be acquired to go onto the property. The legal fees and cost of the land acquisition
could run between $5,000-$10,000 for each easement. Superintendent Delikat
suggested obtaining permission from each property owner for the City to go onto their
land and do the work. Ald. Salentine moved recommend approval for the costs of
$3950.00 plus renting a machine and to move forward in obtaining right of entry
permission from each property owner. Ald. Melcher seconded. Motion carried 3-
0. Director McMullen will forward the right of entry form to Ald. Borgman.
Request for stop sign on Sunny Hill and Prospect Drive – Chief Johnson informed the

Committee a traffic study was done for this intersection at the end of June. The 85
percentile speed is 33mph westbound and 34mph eastbound in a 25mph zone. Chief
Johnson suggested using other methods of slowing down traffic such as a small raised
island in the roadway. The City of Milwaukee uses these types of islands on the East
Side. Ald. Melcher stated he would like to meet with the residents before making a
decision. Ald. Melcher moved to defer. Seconded by Ald. Salentine. Motion
carried 3-0.
Request for a stop sign on Cherrywood Drive and Westfield Way – Ald. Buckmaster
suggested deferring this item until the area develops. Ald. Buckmaster moved to
defer. Seconded by Ald. Salentine. Motion carried 3-0.
NEW BUSINESS
Discuss improvements and possible driveway maintenance agreement for the
Herda/Meinen CSM (Ryan Road) and the Kramer CSM – The Committee agreed that
this CSM should be considered under the policy that has been approved by the
Committee under unfinished business. Ald. Buckmaster moved approve both the
Herda and Kramer CSM and to require them to conform to the new policy for
access improvements.
Request for Dovic/James right of way vacation – Director McMullen explained on the
Dovic/James CSM is a 30-foot road vacation and a 30’ right of way dedication. The
same property owners that are dedicating the right-of-way will be receiving the vacated
right of way land. Ald. Salentine moved to recommend approval of the right-of-
way vacation following the Road Vacation Procedures. Seconded by Ald.
Melcher. Motion carried 3-0.
Approval of James construction plans – Director McMullen stated this will be a simple
roadway section with no storm sewer. It will be the responsibility of the property owners
through the Homeowners Association to maintain the open ditches and this will be
addressed in the developer’s agreement. Ald. Salentine moved to approve the
James construction plans. Seconded by Ald. Melcher. Motion carried 3-0.

Approval of the name change of Schmeling Court to Nursery Court in the Nursery
Subdivision – Director McMullen explained the final plat has not been recorded yet. The
developer is requesting the name be changed from Schmeling Court to Nursery Court. If
approved by this Committee the Affidavit of Correction will be recorded and the changes
will appear on the final plat. Ald. Salentine moved to approve the name change
from Schmeling Court to Nursery Court in the Nursery Subdivision. Seconded by
Ald. Melcher. Motion carried 3-0.
Request for stop sign at Sherwood Circle and Saroyan – Ald. Snead was present to
explain the residents in this area are concerned with the speed cars are traveling on
Sherwood Circle. This is a safety concern for the children in the area. Ald. Snead also
further explained there a couple of factors unique to this area; a large bush blocking the
vision corner and the fountain wood pool which brings more traffic than normal. Ald.
Salentine moved to recommend approval of yield sign installed on Sherwood
Circle at Saroyan Drive. Seconded by Ald. Melcher. Motion carried 3-0.
Request for stop sign at Belmont Drive and Cornell Drive – Ald. Snead was present to
request a stop sign on Cornell Drive at Belmont Drive on behalf of a resident in the
area. Ald. Buckmaster noted this proposed stop sign would only be 100-feet away from
the stop sign on Tess Corners. Ald. Snead will refer the resident to Chief Johnson.
This item will be removed from the agenda.
Discuss special assessment for storm water dredging at Lakewood Meadows – Director
McMullen informed the Committee over the last three years the City has been working
with the members of the Lakewood Meadows Homeowners Association to dredge the
retention pond to its original configuration. The pond has reached it’s maximum
capacity and has approximately 4-5 feet of silt on the bottom of the pond, which is 2 feet
beyond the capacity. The pond is the only settling basin between the subdivision and
the outlet to Little Muskego Lake. The members of the Homeowners Association were
given names of contractors to do the dredging work, but the estimates given were
expensive.
Lori Eihlers, S67 WW18978 Tans Drive – stated Lakewood Meadows has a storm
sewer and other homes that do not have storm sewer are running into theirs.
Sherry Kryszak, S68 W18979 Derby Court – stated the silt on her property is up 3-feet.
The water was almost running into her neighbors basement. They had to dig trenches
to re-direct the water away from the house. Concerned that children may get stuck in
the silt.
Bob Hoffmann, W192 S6781 Bluegrass – questioned if the public hearing is not a
matter of if the pond will be dredged, but how it will be paid for.
Director McMullen explained the City would need to go through the entire special
assessment process, including public hearing, design, bidding, assessment rolls and
final assessment resolution by the Council. The ideal time of year to complete this

project would be in the later winter months when the ground is frozen. Ald. Salentine
moved to direct staff to begin the process to complete the dredging project
including the creation of assessment rolls, hearing notices and preliminary and
final resolutions. Seconded by Ald. Melcher. Motion carried 3-0.

Approval of St. Paul’s 150 banner installations – Director McMullen explained St.
Paul’s Lutheran Church on Janesville Road is requesting to install 8 banners on City
th
poles from December 15, 2006 to January of 2008 in celebration of the church’s 150
anniversary. The church is requesting the banners be installed on the south side of
Janesville Road from the parsonage east to the eastern lot line of the church and along
the Kurth property north of Janesville Road. Director McMullen recommended having
an emergency contact from the Church if the banners become damaged or need
maintenance. The City has a permit from Waukesha County to install and maintain the
light poles and any installations must be consistent with this permit. St. Paul’s will need
a building permit from the City prior to installing the banners, but the fees will be waived.
Ald. Salentine moved to recommend approval of the proposed locations of the St.
Paul’s banner along Janesville Road in front of the Kurth farm and the Church,
consistent with the existing County permit, from December 15, 2006 to January
2008. Further recommending the Church supply an emergency contact for
maintenance of the banners and that any requests or directions of the City be
addressed within 48 hours of notification. Seconded by Ald. Melcher. Motion
carried 3-0.
NEW BUSINESS SPECIFIC TO SETTLEMENT CENTER
Review of building improvements final report – The invoice for the repairs to the School

House and the Wollmann House for $2858.29 was paid in full on Friday August 11.
SUBDIVIDER’S EXHIBITS
Denoon Country Estates – Director McMullen reviewed the plans with the Committee.
A temporary diversion berm will be installed along the property line to control drainage.
Any water issues will be handled through the Developer’s Agreement. Ald. Salentine
moved to approve the grading and drainage plans for Denoon Country Estates.
Seconded by Ald. Melcher. Motion carried 3-0.
