Public Works Committee- MINUTES - 10/17/2005 Corrected/approved CITY OF MUSKEGO PUBLIC WORKS COMMITTEE MEETING MINUTES OF MEETING HELD MONDAY, October 17, 2005 Chairman Chris Buckmaster called the meeting to order at 5:05 PM. Present were Committee Members Ald. Bob Melcher and Ald. Neil Borgman. Also present was Ald. Pat Patterson, City Administrator Jennifer Scheiffer, Engineering/Building Inspection Director Sean McMullen, Public Works Superintendent Wayne Delikat and those per the attached list. Chief John Johnson was excused. Chairman Buckmaster reported that the meeting was noticed in accordance with the Open Meeting Law. PLEDGE OF ALLEGIANCE Chairman Buckmaster led those present in the Pledge of Allegiance. APPROVAL OF MINUTES Ald. Melcher moved to approve minutes of the meeting held August 22, 2005. Ald. Borgman seconded. Motion carried 3-0. ENGINEERING/BUILDING DIRECTOR – PUBLIC WORKS SUPERINTENDENT REPORTS – Discuss Urban/Rural Drainage – Superintendent Delikat reported ditching work is done. Working on culvert clean up. Leaf pick up will begin next Monday. STATUS OF PROJECTS (per the Engineers Report from 10-12-2005)  Tess Corners Pond Expansion/Drainage Issues (New Berlin) – nothing new to report.  Janesville Road Reconstruction Project – Additional punchlist items as a result of dry weather and subsequent dry weather. Lights are completely installed and WE Energies will be energizing the control cabinet this week. The Committee requested adding Status of Janesville Road/County Capital Plan to the future agendas. Director McMullen noted Rich Bolte of Waukesha County will be meeting with the City the second week of November.  Martin Drive Realignment – Super Excavators have completed all road repairs and will be returning to repair the ditch line and shoulder restoration.  Durham Drive Realignment – Nothing new to report.  Freedom Square Ponds – The concrete invert has been installed. Restoration will commence this week and will be completed the week of October 24, 2005. Rip rap will be installed this week and will also be installed around the culvert of the small Public Works Committee Minutes – October 17, 2005 Page 2 pond. Restoration will be done this year with an erosion matt. The willow tree will stay.  Quietwood Creek – Diverting Structure – Ald. Buckamster explained this is the only item left to be completed prior to acceptance of improvements.  Field Drive Repaving – S74 W21052 Field Drive – Due to rain, Payne and Dolan will be rescheduling a meeting with the property owner later this week.  Settlement Center (Old Town Hall) – Public Works Department have completed interior trim work and dry-walling totaling approximately 8 hours of time. Public Works has been directed to raze the tool shed. This will be completed after electrical has been disconnected. Superintendent Delikat reported the electric has been disconnected at the Tool Shed and the building will come down on Friday. Town Hall is scheduled to be completed on Friday for Park and Recreation’s program use. Payne and Dolan will be paving the handicap areas of the parking lot on Thursday. Final occupancy will be issued on Friday. There is a change order to remove all lower level finishes. The upper level is occupiable. The lower level is not occupiable until the cosmetic finishes of painting, flooring, staining and tile work are completed. Financing is not available at this time to complete the work. The state is requiring all the work for the Town Hall be completed by June 30, 2006. Ald. Melcher will place this item on the Committee of the Whole agenda.  Waukesha County Traffic Study (Racine/Henneberry/North Shore Drive – The counts and data collection are completed. Waiting for Traffic Analysis and Design to submit the report. The developer of Woodland Creek will be paying for 95% of the bill.  Bellview Subdivision drainage & neighbor concern with Library prairie grass – Director McMullen explained there is a drainage issue which can be resolved by cutting a ditch along the east side of the library. Permission is needed by the condo assocation, to the south of the library, before work can begin. Ald. Buckmaster questioned the water that collects at the parking lot. Director McMullen explained there is a small ridge at the end of City property and neighbor’s property that needs to be cut down and the culvert under Janesville Road needs to be cleaned out. The Utilities Department will use the vacuum truck to clean out the culvert. Marjorie Backhaus, W165 S7467 Bellview Drive – stated she is concerned with the slope from the condominums. Water runs down from the condos and washes out her trees and yard. Director McMullen explained the proposed berm on the east side of the complex will block the water to remain on City property. Mrs. Backhaus further explained the land was level and now the land slopes down because of the water running down her property. All the problems began when the library was built. Mrs. Backhaus added she has had mice in her garage because of the prairie grass at the library. Director McMullen stated the work will be done this year once permission is given by the Condo Association. The Park and Recreation Department will maintain and cut the grass at the library once a week. Public Works Committee Minutes – October 17, 2005 Page 3 UNFINISHED BUSINESS Status of parking concerns / Fountainwood Pool - Ald. Patterson reported he is working with the residents and the owner of the pool to reach an agreement by spring. Review request for stop sign (Meadow Green West) Joel & Brennan – Director McMullen explained there are trees and schrubs located in the vision corner of the Joel and Brennan intersection. Ald. Melcher moved to direct staff to order the tress and schrubs in the vision triangle to be removed or trimmed. Seconded by Ald. Borgman. Motion carried 3-0. Status of acceptance of extension of Center Dive – Waiting for the title to come back from the Title Company. NEW BUSINESS Discuss annual drawdown of Little Muskego Lake/Big Muskego Lake – Superintendent rd Delikat reported Little Muskego Lake is usually drawn down beginning the 3 Monday of October. The DNR requirement is 18-20 inches. The residents on the lake would like the lake only drawn down 12 inches. The Committee requested confirmation on the level the DNR requires the City to drawn down Little Muskego Lake. The Committee directed Public Works to begin lowering the lake 12” until a special Public Works meeting prior to th Council on the 25 to confirm what the DNR requirements are. Superintendent Delikat noted in his experience with the City this past spring is the first year the Lake has not filled up. Ald. Buckmaster requested a supplement be prepared by the special meeting explaining the process and the effects to Big Muskego lake and also noting Superintendent Delikat’s history with the lake filling up. Superintendent Delikat will begin tomorrow lowering the lake by 12 inches. Discuss city-wide refuse/recycling – Former Mayor Don Wieselman was present to request the charges for refuse/recycling be dropped or significantly reduced. Mr. Wieselman explained he only puts out a small grocery bag of garbage each week. Mr. Wieselman suggested the City switch to a program like pay as you throw. Ald. Patterson explained he was on the Committee that negotiated the refuse and recycling contract. Ald. Patterson explained the fees are based on each house, not the amount of people living in the house. Director McMullen added there have been previous requests from seniors or part-time residents that have been denied. Director McMullen also noted that the fees to drop off at the refuse and recycling centers are included in the contract and if you have a Muskego driver’s license there is no charge for this service. The current contract will not expire until December 2008. To make any changes to the current contract both side would have to agree to re-open the contract. Ald. Melcher moved to direct staff to gather information on different types of programs such as pay as you throw. Seconded by Ald. Borgman. Motion carried 3-0. Discuss request for “No Parking” signs – Center Drive - Willard Bertram and Donald Knoll were present. Director McMullen explained the extension of Center Drive was originally dedicated to the City as public right of way. Eleven years later the original developer deeded the area to four family members for lake access. The Homeowners Association has been collecting the taxes, paying the lake association fees and keeping the area up. Public Works Committee Minutes – October 17, 2005 Page 4 The Homeowners Association requested the City tear out the asphalt, restore the area and install “no parking” signs to resolve the problems they are having with neighbors who are not part of the association parking on the property. The asphalt has been removed and the area has been seeded. Staff is recommending the installation of no parking signs 50’ east and west of the centerline of Center Drive. Staff is also recommending installing beam guard to stop people from inadvertently driving over the road down into the lake. To resolve other issues, “no trespassing” signs can be posted once the City receives the new title and the lease agreement is in place. Ald. Borgman moved to recommend approval for the installation of beam guards and “no parking” signs along the north side of Lake Drive from the centerline of Center Drive to 50’ east and west. Seconded by Ald. Melcher. Motion carried 3-0. The beam guard will be installed after trash has been removed from the property. Discuss signage at intersection of Windsor and Saroyan – Ald. Patterson explained neither Windsor or Saroyan are controlled intersections and there is a problem with drivers not knowing who has the right of way. Chief Johnson is recommending placing a “Yield” sign on Saroyan Court and Saroyan Road at Windsor. Director McMullen has looked at the intersection and agrees a yield sign would be helpful at this intersection. Ald. Borgman moved to recommend approval of a “yield” sign on Saroyan Court and Saroyan Road at Windsor. Ald. Melcher seconded. Motion carried 3-0. Discuss location of Tess Corners holiday decorations – Director McMullen explained he received a request from the Chamber of Commerce to place holiday decorations on the light polls in the Tess Corners area. The Chamber of Commerce is proposing to use garland with lights and a bow on 10-16 lights. Director McMullen has no concerns with the proposed decorations. Ald. Patterson expressed concern with only doing 10-16 light poles and not the entire area. Ald. Melcher moved to approve the holiday decorations in Tess Corners but requiring them to be removed by the end of January 2006. Seconded by Ald. Borgman. Motion carried 3-0. Review request to vacate Martin Drive Right of way – Copper Oaks Subdivision – Director McMullen explained he received a request from the developer of Copper Oaks Subdivision to vacate the remaining two pieces of excess right of way on the north end of lots 4&5 of Copper Oaks Subdivision. Ald. Melcher moved to recommend approval for the vacation of right of way on Martin Drive and forward to Plan Commission and future Public Works meetings for final recommendation to Common Council. Seconded by Ald. Borgman. Motion carried 3-0. Determine meeting dates for November and December – The Committee discussed possible dates for the November and December meetings. The meetings will be prior to thth the Common Council meetings on Tuesday November 8 and Tuesday December 13. Review request for “No Trucking” signs in the Industrial Park – Since the construction of G&G Trucking there has been an increase of truck traffic going out through the Plum Creek East subdivision. Residents of Plum Creek East have expressed concerns with the truck traffic. Ald. Melcher moved to place “No Trucking” signs at the western border of the industrial park on Apollo and at the entrance to Plum Creek East on Providence Way off of Janesville Road. Restricting all truck traffic on Apollo Drive west of the Industrial Park limits and on Providence Way except for local deliveries to Plum Creek East residents. Seconded by Ald. Borgman. Motion carried 3-0. Public Works Committee Minutes – October 17, 2005 Page 5 Nature Estates – Request for final lift of asphalt – Director McMullen explained Nature Estates is currently 88-89% built up. The requirement for the final lift of asphalt is to 90%. There is one house that will have occupancy by the middle of December, and there is one lot that is owned by the neighboring property owner who is not planning on building on it in the near future. Also, Public Works has a much more difficult time plowing roadways that do not have the final lift of asphalt installed. Ald. Borgman moved to approve the final lift installation prior to the close of asphalt plants in 2005, if, the temperature conditions meet City requirements and that all other standards specifications are met. Seconded by Ald. Melcher. Motion carried 3-0. Birkely Land Division – Determination of Required Improvements – Director McMullen explained there is a new policy that proposed land divisions where private roads will be in public right of ways must come before the committee for approval. This proposed land division is similar to the Lembezder Court land division. No further extension of the current road is allowed. A driveway agreement will be required. This agreement would run in perpetuity with the land and be binding on all future landowners. This agreement puts the burden of maintenance upon the landowners and not the City. A note would also be added to the CSM that states a private drive is to be constructed in the ROW and that no maintenance, plowing, or refuse collection will occur with the newly dedicated ROW unless it becomes publicly improved to City of Muskego standards at no cost to the City of Muskego. A minimum width and thickness of crushed aggregate is required for emergency access. Ald. Melcher moved to recommend approval of this land division based on staff recommendation allowing a private drive within public right-of-way with the following restrictions: have language placed on the CSM and the driveway agreement recorded upon land division. Require an 8” thick, 16’ wide crushed aggregate private drive with a 4” thick 16’ wide by 50’ long area of asphalt abutting Durham Drive be constructed prior to release of building permits. Also, have the proposed land division appear again before the Committee prior to recording of the CSM to ensure the driveway agreement and CSM language meets their intent. Seconded by Ald. Borgman. Motion carried 3-0. Hrin Land Division – Determination of Required Improvements – Director McMullen explained this land division is similar to the above land division. Director McMullen is recommending lots 1 and 2 come off the private roadway. Ald. Borgman moved to recommend approval of this land division based on staff recommendation allowing a private drive within public right-of-way with the following restrictions: have language placed on the CSM and the driveway agreement recorded upon land division. Language should also be placed on the CSM that required full public improvements be made should future land division occur and that burden shall not be placed on the City of Muskego or the residents of lots 1-4. Require an 8” thick, 16’ wide crushed aggregate private drive with a 4” thick 16’ wide by 50’ long area of asphalt abutting Parker Drive be constructed prior to release of building permits. No vehicular access is to be allowed onto Parker Drive from lots 1 or 2. Also, have the proposed land division appear again before the Committee prior to recording of the CSM to ensure the driveway agreement and CSM language meets their intent. Seconded by Ald. Melcher. Motion carried 3-0. Moorland Road Extension by pass lane – Durham/ Cherrywood &Sandalwood – Director McMullen explained staff has received complaints on the by pass lane at Sandalwood and Cherrywood Drive on Durham. After viewing the area during peak hours there are bottlenecks at these two intersections. Ald. Melcher moved to direct staff to complete Public Works Committee Minutes – October 17, 2005 Page 6 the survey work, engineering and design for the bypass lanes on Moorland Road at the intersections of Durham Place/ Candlewood Lane and Sandalwood Drive and report back to the Committee for further direction. Seconded by Ald. Borgman. Motion carried 3-0. SUBDIVIDER’S EXHIBITS None ACCEPTANCE OF IMPROVEMENTS None NEW BUSINESS PLACED ON FILE – No action intended for these items. The following may be placed on the agenda at a future meeting. Reopening Durham Drive cul de sac (Durham Drive and Janesville Road) – Ald. Buckmaster referred to the petition to re-open Durham Drive cul de sac. Ald. Buckmaster directed staff to look at the options. This will be a future item for the Committee of the Whole. Speed study on Pasadena Drive and Thornapple Trail – Zak and Stacie Schwartz, W197 S6946 Thornapple Trail, were present to request speed limit signs be placed in the subdivision. Ald. Melcher has requested a speed study be done on Thornapple and Pasadena Drive. Discuss off lake parking and public access to lake - Ald. Melcher requested to defer this item. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW – st Ald. Buckmaster noted Trick or Treat will be Monday October 31 from 6-8 pm. Ald. Borgman requested an item be placed on next month’s agenda to vacate the right of way on Pearl Drive. Ald. Borgman requested the old culvert at Freedom Square Ponds be abandoned. Director McMullen explained this has to be done in winter to get the machines over the ice. Ald. Borgman requested a speed study be done for Martin Drive. The speed limit is 35 mph and would like it changed to 30. Ald. Borgman noted Lannon Drive is 30 mph. ADJOURNMENT – Ald. Borgman moved to adjourn the meeting at 7:40 PM. Seconded by Ald.
