PUBLIC WORKS COMMITTEE MEETING - CITY OF MUSKEGO
MINUTES OF MEETING HELD MONDAY, MAY 19, 2003
Chairman Nancy Salentine called the meeting to order at 5:32 PM. Present were committee
members Ald. Chris Buckmaster and Ald. Eileen Madden. Also present were
Engineering/Building Inspection Director Sean McMullen, Planning Director Brian Turk, Ald.
Rick Petfalski (arrived at 5:37 P.M.) and those per the attached list. Chairman Salentine led those
present in the Pledge of Allegiance.
Chairman Salentine noted that the meeting was posted in accordance with the Open Meeting
Law.
APPROVAL OF MINUTES – Ald. Madden moved to approve the minutes of April 28, 2003.
Seconded by Ald. Buckmaster, motion carried 3-0.
STATUS OF PROJECTS
MMSD Storm water Regulations – Sean reported that the meeting scheduled for last week was
cancelled and rescheduled for June 19, 2003.
Tess Corners Pond Expansion/Drainage Issues New Berlin - Sean advised that he and Tom
Koepp (Ruekert & Mielke) are finalizing an executive summary requested by the City of New
Berlin in order to bring all new council members abreast of the project. Both the City of New
Berlin and the City of Muskego signed the DNR permit application. Sean advised that the DNR
waived permit fee.
Janesville Road/Moorland Road Intersection - Nothing new to report. Final punch list items
being done.
Durham Drive Realignment (McShane south to “OO”) –Item under New Business.
Martin Drive Realignment – Mr. Lindeman has given the City the required land for the
stormwater management project. The City is now working with Mr. Borchardt on purchase of a
small piece of property and once that is done, we are ready to bid the project.
Janesville Road Reconstruction Project – Sean provided the committee with a draft resolution to
be sent to Waukesha County after approval at the Council meeting of May 27, 2003. The
resolutions states that the City of Muskego, upon the recommendation of the Public Works
Committee, and Mayors Task Force on Economic Development does hereby recommend to
Waukesha County to be included as part of the Janesville Road reconstruction project the
installation of decorative street lighting, burial of overhead electric and telephone utilities, the
cul-de-sac of Durham Drive, the installation of paved pedestrian paths, the installation of
concrete surface treatments and the installation of streetscaping. Sean advised that the city
would pay for its proportionate share of these costs. Ald. Madden moved to recommend

approval of resolution to the May 27, 2003 council. Seconded by Ald. Buckmaster, motion
carried 3-0.
1. City’s agreeing to having Waukesha County cul de sac Durham Drive at the
intersection of Janesville Road
2. City’s agreeing to installation of streetscaping
3. City’s willingness to participate in the burying of electric cable for street lighting.
Quietwood Creek Recreation Trail – Contractor is expected to start path construction tomorrow,
weather permitting.
UNFINISHED BUSINESS
Discuss Urban/Rural Drainage – Crews working on culvert installations.
Further review of request for berm and plantings – Rosewood Subdivision – This item was
referred back to the Public Works Committee by the Common Council at their meeting of May
13, 2003, for further consideration. Mr. & Mrs. Eric Johnson and Mr. Richard Warczak
appeared before the committee to continue discussions. Ald. Petfalski explained that the Council
had reservations as to setting a precedent by paying for and installing trees and/or fencing for
these properties as he felt that it was the property owners responsibility, prior to purchasing and
building their homes, to research city improvements. He reminded the committee that the
installation of the Moorland Road-South road had been platted for several years. Ald. Petfalski
further explained that he had a similar situation in Lake Forest Subdivision, but the neighbors
were installing arbor vitas to eliminate excess noise that was coming from the Payne & Dolan
Asphalt plant. Ald. Petfalski state would be more receptive to planting arbor vitas in the planting
easement rather than installing fencing on private property.
Ald. Madden and Ald. Buckmaster voiced concern with the previous actions of the committee
explaining that this item has been discussed at the past six months’ meetings and that the
committee wrote to each affected property owner and asked them to select an option. The option
selected was to install fencing and both aldermen felt that it would be unfair to now back down.

There was agreement that work would not be done on the 5 property (Tax Key MSKC
2202.020) in the original motion at the April 28, 2003 meeting as the property already had
plantings and was set back further than the agreed upon five.
After considerable discussion, Ald. Madden moved to re-approve Option #1, installing a
cedar “Shadow Box Fence” on down slope of berm on Moorland Road-South, within the
utility easement. The fence will include the street line of the following five homes, with the
work to be done by the Public Works Department, subject to the following, and not to
exceed $9,714.00:
1. All legal owners of the above five properties will sign a temporary easement
for the installation of the fence, to be recorded with Waukesha County
Register of Deeds, on each property.

2. All legal owners of the above six properties will sign a maintenance
agreement to be assigned to the property whereby maintenance of the fence
will be the responsibility of the property owner. This maintenance
agreement will also be filed with Waukesha County Register of Deeds, on
each property.
Seconded by Ald. Buckmaster, motion carried 3-0.
Chairman Salentine advised Mr. & Mrs. Johnson and Mr. Warczak that if the Council overturned
this action, the committee would then research the possibility of arbor vitas or other plantings.
Director McMullen advised the committee that he may be requesting a special Public Works
Committee meeting prior to the June 10, 2003 Council meeting for another item, and that if this
action is overturned, it could then be addressed at that meeting so something can be done by the
middle of June.

Review and recommend approval of Amendment to Chapter 34/MMSD Stormwater Regulations
– Ald. Madden moved to defer. Seconded by Ald. Buckmaster, motion carried 3-0.
NEW BUSINESS
Confer with CDA re Redevelopment District #2 – Planning Director Brian Turk appeared before
the committee to discuss the CDA Redevelopment District #2 which had been previously
presented to the Council at the Public Hearing held on May 15, 2003. Wisconsin State Statutes
require that the street improvements and stormwater plans must be presented to the committee to
confer. Director McMullen stated that his department had reviewed and had no objections. Ald.
Madden moved to approve to confer with CDA re Redevelopment of District #2. Seconded
by Ald. Buckmaster, motion carried 3-0.
Amendment to Official Street Map, Durham Drive Realignment – Sean explained that the as part
of the planning process, the City has been working on the proposed realignment of Durham
Drive. After final review of the design dated May 14, 2003, Ald. Buckmaster moved to
recommend to Common Council the amendment to official street map to include the
realignment of Durham Drive. Seconded by Ald. Madden, motion carried 3-0.

ADJOURNMENT – Ald. Buckmaster moved to adjourn the meeting at 6:24 PM. Seconded
by Ald. Madden, motion carried unanimously.
