MINUTES OF JOINT MEETING OF CITY OF MUSKEGO PUBLIC WORKS
COMMITTEE AND CITY OF NEW BERLIN BOARD OF PUBLIC WORKS HELD
MONDAY, OCTOBER 07, 2002, IN THE COUNCIL CHAMBERS OF THE CITY OF
NEW BERLIN, 3805 SOUTH CASPER DRIVE, NEW BERLIN, WI 53151
Public Works Committee Chairman, Alderman Nancy Salentine, called the meeting to
order at 8:10 AM, introduced those present: Public Works Committee members
Alderman Patrick Patterson and Alderman Butch Le Doux, Mayor Mark A. Slocomb,

Engineering/Building Inspection Director Sean McMullen and 5 District Alderman Rick
Petfalski.
Ald. Salentine noted that the meeting was noticed in accordance with the Open Meeting
Law.
Those present from the City of New Berlin were Mayor Wysocki, City Engineer J. P.
Walker, Alderman Chiovatero, Alderman Harenda and Alderman Ament, along with
various staff members in the audience.
Alderman Nancy Salentine thanked the City of New Berlin for agreeing to the joint
meeting to discuss their mutual storm drainage issues and to discuss the proposed Tess
Corners Pond.
Alderman Nancy Salentine turned the meeting over to Engineering/Building Inspection
Director Sean McMullen who introduced the engineering representatives from Ruekert &
Mielke, Tom Koepp and Michael Campbell, who have been designing this project
through direction from both cities in a signed 66.0301 inter-governmental agreement.
Engineer Koepp from Ruekert & Mielke gave an overview of the project explaining that
engineering representatives from both communities have met with Ruekert & Mielke and
the DNR to go over the plans so that they meet all criteria. The DNR had several issues
that included warm water base flow and wetland delineations. They were looking at
connected ponds and issue of whether or not this would fall into the dam classification
and would need additional permitting. As a result of the DNR concerns, the engineers
have revised the plans to eliminate the on-line pond. The proposed pond is designed to
take a 100-year storm and hold it and release it at a 10-year storm that will protect
property owners downstream and eliminate flooding. This pond is being funded with a
water quality fund grant, as it will be improving the water quality.
Engineer Koepp explained that the plans are 95% complete and should be 100%
complete by the end of this week. He would like direction so that he can submit the plans
to the DNR and then the communities can start with the land acquisition process.
Alderman Patterson moved to give formal approval to Engineer Koepp to submit
the plans to the DNR, to authorize the engineering representatives from both
communities, along with their respective city attorneys, to meet with Ruekert &
Mielke staff to finalize the timeline for construction and proceed with map and legal

description for relocation order for the October 22 Council Meeting. Seconded by
Alderman Le Doux, motion carried unanimously.
The City of New Berlin also made motion to that effect in their minutes.
Engineering/Building Inspection Director Sean McMullen explained that the relocation
orders have to be passed by both of the public works boards, plan commissions and
common councils.
Mayor Ted Wysocki questioned what cost have the changes made, if any? Engineer
Koepp explained that most of the changes were in grading as well as the berm was
changed to articulated concrete block and he did not feel that on this large a project there
would be any cost increase.
This project is proposed for Spring of 2003 and with a two to two and on-half month
construction window, bidding could be as early as February 2002. If the relocation order
is uncontested, it would take until at least December to acquire the land.
Aldermen Nancy Salentine questioned whether the two affected property owners are
receptive to selling their land for this project and Sean McMullen advised that he and Mr.
Walker have met with the landowners but that it is against the law to discuss amount for
the lands until an appraisal is completed and an offer is submitted. Sean advised that
there are only two appraisers that the DNR allows to be used for this project and the

earliest the appraisal could be completed would be the 15 of November.
Mayor Ted Wysocki questioned if this project falls under Metropolitan Milwaukee
Sewerage District’s new stormwater regulations and both engineers agreed that the
project would be in compliance with all MMSD standards. It was clarified that although
this project is not in their immediate sewer service area, it is in the ultimate sewer service
area and, therefore, requires submittal to MMSD. Ruekert & Mielke’s engineer, Michael
Campbell, advised that he was a member of the committee drafting the Chapter 13
stormwater regulations and that he felt there should be no problem with getting their
approval and also stated that the revised Chapter 13 regulations deal manly with new
construction.
It was requested that a digital copy of the plans be submitted to the City of New Berlin’s
engineering staff.
Engineering/Building Inspection Director Sean McMullen advised both communities that
Ruekert & Mielke are coming to the end of their contractual agreement for this project
and he would like to be given the authority to continue working with Ruekert & Mielke
on this project and that there is sufficient funds still available for this project. Ald.
Patterson moved to give Sean McMullen the required authorization to continue
working with Ruekert & Mielke on this project. Seconded by Ald. Le Doux, motion
carried unanimously.

The City of New Berlin also made motion to that effect in their minutes.
Mayor Wysocki requested a copy of the current financial report on this project and
Ruekert & Mielke engineer Michael Campbell will provide an updated copy to both
communities.
Ald. De Doux moved to adjourn at 8:50 AM. Seconded by Ald. Patterson, motion
carried unanimously.
