Public Works Committee - MINUTES - 10/22/2002 Approved SPECIAL PUBLIC WORKS COMMITTEE MEETING – CITY OF MUSKEGO MINUTES OF MEETING HELD OCTOBER 22, 2002 Chairman Nancy Salentine called the meeting to order at 6:28 PM. Present were committee members Ald. Butch Le Doux, Ald. Patrick Patterson, Engineering/Building Inspection Director Sean McMullen, Plan Director Brian Turk, Attorney Feeley, Mayor Slocomb, Ald. Rick Petfalski, Ald. Madden, and interested citizens. Chairman Salentine led those present in the Pledge of Allegiance. Chairman Salentine noted that the meeting was posted in accordance with the Open Meeting Law. REVIEW SPECIFICATIONS FOR THE RECREATIONAL TRAIL COSTS – QUIETWOOD CREEK SUBDIVISION Mr. McMullen reviewed the developer’s bids for the installation of 6’ wide concrete combination path ($98,400) and 8’ wide asphalt path ($59,200). The $39,200 cost difference between the bids would need to be made up by the developer or lot owners. Mr. McMullen then reviewed AASHTO standards for walkways noting that 8 feet width is recommended for pedestrian only walkways, and 10 feet in width is recommended for combination paths. The City adopted an 8’ standard for all combination paths earlier this year. Alderman Patterson arrived at 6:37 PM. Attorney Feeley then addressed the Committee regarding the legal definition of the path. Attorney Feeley believes that statutes are very specific in their terms and that the Quietwood path is not a sidewalk, even if it were to be constructed out of concrete. He noted that the executed Developers Agreement for Quietwood Creek controls the meaning and is very clearly not intended to be sidewalk. As such, the liability and maintenance provisions of statutes do not apply to the Quietwood path. Alderman Petfalski arrived at 6:40 PM. Alderman Madden arrived at 6:45 PM . The Committee discussed at length the construction standards and maintenance standards with Mr. McMullen and Attorney Feeley. Alderman LeDoux expressed the concern that 9 of the affected lot owners did not appear to receive any notification from the developer. Mr. McMullen detailed the procedural changes being implemented by the Building and Engineering Department to avoid such incidents in the future. (The minutes were accepted by the Common Council on 11/12/2002 without the following paragraph. See the Council minutes of 11/12/2002 for the motion on this matter.) Ald. Salentine moved to leave the Quietwood Creek path at the City standard of 8’ asphalt width. Motion seconded by Ald. Patterson. Motion carried 2-1 (Ald. LeDoux voting “no”). Salentine moved to recommend to the Finance Committee and Common Council that the Developers Agreement be amended to permit the path installation no later than July 1, 2003. Motion seconded by Ald. Patterson. Motion carried 2-1 (Ald. LeDoux voting “no”). COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW None. ADJOURNMENT – Ald. Salentine moved to adjourn at 7:15 PM.
