PUBLIC WORKS COMMITTEE MEETING – CITY OF MUSKEGO
MINUTES OF MEETING HELD NOVEMBER 18, 2002
Chairman Nancy Salentine called the meeting to order at 5:00 PM. Present were committee
member Ald. Butch Le Doux, Engineering/Building Inspection Director Sean McMullen, Public
Works Superintendent Wayne Delikat, Ald. Eileen Madden and those per the attached list.
Chairman Salentine led those present in the Pledge of Allegiance.
Chairman Salentine noted that the meeting was posted in accordance with the Open Meeting
Law.
APPROVAL OF MINUTES – Ald. Le Doux moved to approve the minutes of the meeting held
October 28, 2002. Seconded by Ald. Salentine. Motion to approve carried unanimously.
STATUS OF PROJECTS
MMSD Storm Water Regulations – Sean reported that the next MMSD TAT meeting is
scheduled for December 12, 2002, to continue discussion and hopefully finalize.
Tess Corners Pond - Drainage Issues/City of New Berlin – Sean advised that the plans are in
the final design stage including wetland and floodplain issues. Final design will continue into
December. He indicated that there would be a three-month process for land acquisition. Sean
would like to hire a consultant to do all of the land acquisitions that would include the entire
process and take the onus off of the City. He explained that land acquisition is a very long
process and having a consultant do the entire process would add 5% to 10% to the project cost
and that cost would be 100% DNR eligible for reimbursement. The Committee indicated that
they are very much in favor of hiring a consultant for this project and all others.
Janesville Road/Moorland Road Intersection – Sean reported that he received correspondence
from Ruekert & Mielke indicating an overage on the project of $82,000.00. Sean will continue
discussion with them and indicated that Waukesha County also has concern with the overage.
Durham Drive Realignment – Sean reported that work is progressing with the design phase of
McShane south to North Cape Road and is ahead of schedule. Looking at a November 2003 date

for final design and land acquisition. Should have a set of 60% complete plans by February 1.
Sean met with the State on Friday and next week he will be applying for a State Connecting
Highway Funds grant. If received, the city’s portion could be reduced to $500,000.
Lions Park/Oak Grove Intersection – Sean reported that Waukesha County was having the
same concerns with Ameritech and would be meeting with them on the Janesville Road project.
Sean is attempting to move that meeting from Waukesha County to the City of Muskego in order
to also address this issue.
Janesville Road Reconstruction Project – Waukesha County is waiting for additional
information before scheduling the informational meeting

Hillendale/Racine Intersection – Sean explained that a request was received from Ald. Rick
Petfalski, on behalf of several of his constituents, to look into traffic signals at this intersection.
This item was on the last Finance Committee agenda and the committee approved an amount of
$9,500 to hire Ayres & Associates to conduct a signal warrant analysis. Upon reviewing the
estimate, Sean had staff out on site to do some of the preliminary work that will reduce the
amount by $3,500, to $6,000.00. As a result of this request, Chief John Johnson is requesting an
analysis of all main intersections in the City and then rank them as to need and add them into the
five-year capital project.
Martin Drive Realignment – Sean advised he is still waiting for two appraisals and has
received the 95% complete plans from Ruekert & Mielke on Friday.
Bay Lane Signals – Traffic signals are up and running. He is waiting for the pre-emption device
to go in and will be doing some minor realignment on striping.
UNFINISHED BUSINESS
Discuss Urban/Rural Drainage – Wayne Delikat reported that all of his crews are collecting
leaves and indicated that, because of the lateness of the season, this has become a major project
and he is not sure that his department will be able to handle in the future.
Status of Chapter 30 permit from DNR for drainage easement - Holly Patch Court - Sean
updated the committee that he has worked with new personnel from the DNR on whether or not
a Chapter 30 permit would be required and the DNR has indicated that unless we have different
information than they have, that no permit is necessary as they do not consider it a navigable
waterway. Ald. Petfalski will secure the requested permission to go onto the property and
complete the ditch work this week.
NEW BUSINESS
Request for installation of berm – Richard Warzak – Mr. Richard Warczak, W150 S7232
Westcot Drive, appeared before the committee to request additional berm and planting for his
property. He explained that when he purchased the property he was not aware of any plans for
Moorland Road South Extension and that the road now abuts the back of his property and
through construction, 80% of the tree line has vanished. He feels it affects the privacy and value
of his new home in Rosewood Subdivision. He feels the roadbed has risen at least three feet
from the original grade. He also voiced concern with the vehicles driving 50-60 mph in a 35
mph speed zone. He met with the engineering department and was told that a landscape plan
was being created. Mr. Warczak is requesting that the landscape plan include a taller berm and
additional privacy plantings that have lost in order to return some privacy and value to his home.
Mr. Warczak showed a short video showing the before and after of his property.
Sean explained that there are traffic counters on the road now counting speed and volume. The
current results show the average to be 42-44 mph. He further explained that the resolution
setting the 35 mph speed limit was just adopted at the Council meeting of 11-12-02, and prior to
that time there could be no legal enforcement.
On the berm issue, Sean explained that a berm Mr. Warzak referred to being installed across the
road was actually done by a private developer. Sean stated that a landscape plan is being worked

on with tree being proposed every 75 feet, staggered along the centerline. Sean explained that if
the committee was receptive to the additional expense, that an agreement could be reached with
the contractor to do the work using the City’s excess topsoil material, but the City first must have
permission from all of the adjoining property owners. If approved, Sean stated that Sunnyslope
Grading would work with the City to construct the berm this year with restoration and plantings
being done next year, and this would include the south portion of lot 8 through lot 14. It is
estimated to be anywhere from $5,000 to $10,000 for this project. Ald. Le Doux moved to
approve a not to exceed a $10,000 amount for this project for the installation of the berm
and additional plantings which would have tree spacing at 75 feet apart with plantings
between. Seconded by Ald. Salentine, motion carried. It was agreed that Sean would draft
a letter and send to the property owners explaining the project and requesting their
permission for entrance onto their property.
Review proposed changes to sump pump ordinance – Sean explained that this ordinance had
been recommended for approval from this committee on November 22, 1999, but had been put
on hold. Sean just wanted the committee to be aware and to be receptive to this ordinance being
reviewed and adopted by the Council at the next meeting.
Determine concrete path specifications – Sean reviewed with the committee the specifications
for a 6 ft. concrete path. He explained that several people had questioned him as to whether or
not the completed path would be strong enough to hold City vehicles. Sean is recommending the
same strength of material as major roads used, but it results in a finer surface. The heaviest
machine that would ever be on the path would be the City’s skid loader. Ald. Le Doux moved
to recommend acceptance of this standard for the Quietwood creek concrete recreation
combination trail. Seconded by Ald. Salentine, motion carried 2-0.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY
LAW - Sean advised that an ad had been placed for sale of the two Public Works municipal
trucks. He will bring results to the committee. Sean also advised that plans for a new
subdivision, Settlement on Woods Road, were brought in on Friday and he asked the committee
if they would be receptive to a special Public Works Committee meeting before the next Council
in order to review and approve the submittal. The committee agreed to a 6:40 PM special Public

Works Committee meeting on Tuesday, November 26, prior to Finance and Council.
ENGINEERING/BUILDING INSPECTION DIRECTOR’S REPORT
HIGHWAY SUPERINTENDENT’S REPORT - None.
