PUBLIC WORKS COMMITTEE MEETING – CITY OF MUSKEGO
MINUTES OF MEETING HELD AUGUST 26, 2002
Chairman Nancy Salentine called the meeting to order at 6:30 PM. Present were
committee member Ald. Patrick Patterson, Engineering/Building Inspection Director
Sean McMullen, Public Works Superintendent Wayne Delikat and those per the attached
list. Ald. Le Doux was excused.
Chairman Salentine led those present in the Pledge of Allegiance.
Chairman Salentine noted that the meeting was posted in accordance with the Open
Meeting Law.
APPROVAL OF MINUTES – Ald. Patterson moved to approve the minutes of the
meeting held July 22, 2002. Seconded by Ald. Salentine. Motion to approve carried
unanimously.
STATUS OF PROJECTS
Woods Road Reconstruction – Sean reported that there are still a couple of touch up
areas to be restored, but for the most part the project has been completed. All the
restoration work in the District #1 is completed. They are now working from Durham
Drive west to Racine Avenue and hope to be completed by the end of next week.
Tess Corners Pond - Drainage Issues/City of New Berlin –Waiting for date of joint
meeting with City of New Berlin.
Freedom Square Pond – Will be addressed under #2 of New Business.
Janesville Road/Moorland Road Intersection – Sean reported that the section from

McShane to Woods Road would be completed by September 8. Traffic will be switched
on Moorland Road, north of Janesville Road, next week and they hope to have that
st
section open by October 1.
Durham Drive Realignment – Sean reported that soil borings were done last week and
he should be receiving the reports shortly. From initial conversations, he is anticipating
that he will have less soil problems than originally thought which will bring the project in
lower than budgeted.
MMSD Storm Water Regulations – Sean reported that this item is deferred as the next
meeting is in October.
Janesville Road Reconstruction Project – This item will be discussed under #3 of New
Business.
Martin Drive Realignment – Sean advised that a new appraiser has been hired to secure
an appraisal for the Basse property.

Bay Lane Signals – The contract has been signed and work started today. Looking at a

September 17 substantial completion date. Minor restoration work will then be done
after that date.
UNFINISHED BUSINESS
Discuss Urban/Rural Drainage - Supt. Delikat reported that with the help of Payne &
Dolan they are keeping up with projects and anticipate starting the Circle Drive (Weiner)
project shortly.
NEW BUSINESS
Discuss Mystic Drive Extended and City Services - Mrs. Sally McNutt appeared
before the committee to discuss a proposal given to her from a couple of neighbors which
indicated that they wanted to asphalt a portion of the road. Mrs. McNutt is opposed to
the proposal as the street would not be to City specifications and, therefore, all snow
plowing and refuse/recycling services would stop. Sean explained to Mrs. McNutt that
he had received word from Mr. Loomis today that he and the other neighbors had decided
not to go ahead with road paving project.
Mrs. McNutt presented the committee with a draft of a Waiver of Liability that she
thought the City could keep on file and may be able to use if this road project would ever
be resurrected. She indicated that this waiver would allow the released parties, such as
the City and the refuse/recycling hauler, to continue with all the services currently
provided by the City including, but not limited to garbage collection, recyclable items
collection, snow plowing, road grading and weed cutting for properties on Mystic Drive.
Mrs. McNutt thanked the committee for their cooperation and said that she would be
following the refuse/recycling issue on the Public Services Committee.
Review two alternatives for Freedom Square Pond – Sean reviewed with the
committee the following recommendations from Ruekert & Mielke:
Freedom Square Pond 1 Outlet Modification – Due to the known flooding
problems with the existing “V”-notched weir, it is proposed to install two rectangular
orifices (2.5 feet high by 3 feet wide) centered on the existing structure’s sides with the
bottom of the orifice set at elevation 799.0. This will allow the same flows through the
structure with reduced head thus lowering the 100-year flood elevation. In a related
matter, the Freedom Square Well #2 building elevation is at approximately 805.0 and in
order to obtain the rquird DNR permit for this project, the building elevation must be 2
feet higher than the 100-year flood elevation of the ponds. With the proposed
modifications, we will be reducing the 100 year flood elevation to more than 2 feet below
the building elevation. Sean noted that most of this project could be able to be billed
back to the TIF #8 project.
Freedom Square Ponds Outlet and Dredging Proposal – Sean reviewed with
the committee a Scope of Services to design storm water drainage improvements to the
Freedom Square Ponds. The first phase would consist of modifying the existing outlet

structure for Pond 1 and reroute its outlet storm sewer. The second phase will consist of
the dredging of Ponds 1, 2 and 3 and the construction of Pond 4 as a water quality pond
only. Sean explained that there are two purposes for the above projects 1) to increase
water quality to the lakes and 2) stop regional and local flooding. He also noted that
Ruekert & Mielke is also recommending that the future developer of upstream lands to
the north be required to construct a water quantity Pond 5 at the time of the development.
Ald. Patterson moved to direct Sean to add above projects, totaling 1.2 million dollars to
his 2003 capital budget request. Seconded by Ald. Salentine, motion carried.
Review of potential cul de sac – Durham Drive & Janesville Road – Sean explained to
the committee that he has been working closely with Waukesha County on this project
and that he wanted direction from the Committee as to the installation of a cul de sac on
Durham Drive (south of CTH L) to eliminate the safety issues at this intersection. Sean
explained that he would also be requesting Waukesha County to install an access in the
median on Janesville Road across from the entrance to Atonement Lutheran Church to
accommodate the traffic coming from the east to enter the church off of Janesville Road.
The only other alternative would be for Waukesha County to install a retaining wall on
the south side of Janesville to the Durham Drive intersection and that will not help the
safety and vision issues.
Ald. Patterson moved to authorize Sean to work with Waukesha County to install an
access median to allow ingress/egress to Atonement Lutheran Church off of CTH L
(Janesville Road). Seconded by Ald. Salentine, motion carried.
Further discussion ensued about installing a cul de sac at the intersection of CTH L
(Janesville Road) and Durham Road, abutting Janesville Road on the south. Sean
explained that this has been discussed for a considerable amount of time and that the fire
departments, the school district and the public works department all have been happy
with the proposed cul de sac and that only a couple of residents in the area have voiced
their unhappiness with any change. Ald. Salentine moved to have Sean work with
Waukesha County to install the cul de sac on Durham Drive at the intersection of CTH L
(Janesville Road). The motion died for lack of a second. Ald. Salentine moved to defer
item to September meeting in order for Sean to supply the committee with an origin
destination study and to allow Ald. Le Doux to vote as his District is west of Durham
Drive. Seconded by Ald. Patterson, motion carried.
Review stormwater, grading, and road plans for Prairie Meadows – Kevin Theissen
and Luann Lang appeared before the committee. Sean explained that the plans comply
with all regulations for storm sewer, grading and pavement for this submittal for a 21 lot
subdivision, but noted that the City is awaiting the Chapter 30 permit from the DNR.
Ald. Salentine moved to approve the above submittal subject to receipt of the Chapter 30
permit. Seconded by Ald. Patterson, motion carried.
Review stormwater, grading, and road plans for Rosewood Estates Addn. #1 – Sean
reviewed with the committee the site grading, soil erosion and stormwater maintenance
plans for Rosewood Estates Addn. #1 and advised that they meet all regulations. Sean
pointed out that when the original Rosewood Estates plans were approved, they did a

stormwater management plan for the whole area. Ald. Patterson moved to approve plans
as submitted. Seconded by Ald. Salentine, motion carried.
Review request from Schaumberg/Arndt to vacate road reservation on Parker Drive
– Sean reviewed with the committee a letter received from Richard Schaumberg
requesting the City to vacate the unnecessary road right-of-way on Parker Drive for the
properties located at W181 S9102 parker Drive (Schaumberg) and W182 S9260 Parker
Drive (Arndt). Sean reminded the committee that the Council had recently changed
Parker Drive from an 80 foot road dedication to a 66 foot road dedication and that it
would make sense to now vacate that road dedication and give back to property owners.
Ald. Patterson moved to approve request and to request the Plan Commission to start
road vacation process. Seconded by Ald. Salentine, motion carried.
Discuss existing condition/stormwater management (Southeast corner of Janesville
Road & Tess Corners Drive) – Sean explained that he felt the existing conditions at the
southeast corner of Janesville Road & Tess Corners Drive are completely impervious and
need that determination from the committee in order to avoid meeting stringent
stormwater requirements when each of the affected properties will be addressed in the
future. Ald. Patterson moved to classify the existing site of the Club 24 to be completely
impervious for stormwater management purposes. Seconded by Ald. Salentine, motion
carried.
Review status of drainage concern/Kristin Downs Subdivision – Ald. Salentine
explained that she put this item on the agenda so that she could learn the status of the
proposed drainage project scheduled for Kristin Downs Subdivision. Supt. Delikat
explained that the area in question has been located and work will hopefully be done at
the end of this week.
Discuss driveway access – Atonement Lutheran Church – Mr. Frank Waltz and Pastor
Karen Natterstad appeared before the committee to voice their concern with the
Janesville Road project and access to Atonement Lutheran Church. They are requesting
that as final planning is developed, consideration be given to making safety and
straightforward entrance to the church a priority. The committee brainstormed with Mr.
Waltz and Pastor Natterstad possible alternatives. The access median proposed for
Janesville Road was a positive recommendation.
Discuss ditches behind residences – 7200 block of Parkland Drive (Engineering) –
Sean presented a letter he received from David J. Wolfgram, W168 S7240 Parkland
Drive, requesting the City’s assistance in cleaning of a ditch that runs behind a few
residences on Parkland Drive. A similar request had been received by the City over the
years and it is the City’s determination that the property is owned by the Homeowner’s
Association and unless the request is received from the Homeowner’s Association, it is
impossible for the City to clean out the ditch and bill the property owners. Ald. Patterson
moved to deny request. Seconded by Ald. Salentine, motion carried.
Discuss charges for installation and maintenance of traffic signal pre-emption
(Engineering) – Sean reviewed with the committee a Letter of Agreement from
Waukesha County indicating that the county will permit the City of Muskego to install

emergency vehicle pre-emption equipment on County owned traffic signals at the
following intersections:
CTH O/CTHL CTH O/Kohl’s driveway CTH L/Kohl’s Driveway
CTHL/Bay Lane CTH Y/CTH L CTH L/Lannon Road
CTHL/Tess Corners Drive CTH Y/Woods Road
The installation of the pre-emption equipment is subject to the City agreeing to be
responsible for the installation and maintenance of the equipment and all associated costs;
the City will be responsible for the timing of the pre-emption equipment and will have no
authority to modify any other operational aspects of the traffic signals; the City will
supply Waukesha County Department of Public Works with whatever technical
information is necessary for our personnel to make any appropriate adjustments to the
traffic signals. Sean explain that he has included the cost for this installation in his
capital budget for nine intersections. Ald. Patterson moved to recommend to Finance
entering into this agreement with Waukesha County. Seconded by Ald. Salentine,
motion carried.
Review Quietwood Creek Letter of Credit related to Signalization (Engineering) –
Sean explained that with the original letter of credit for Quietwood Creek Subdivision,
the developer was requested to give to the City $60,000 for the proposed traffic signal for
Martin Drive and CTH L (Janesville Road). As the installation of this signal was denied
by Waukesha County, Sean is agreeing that the letter of credit be reduced by that amount.
Ald. Patterson moved to approve reduction of letter of credit for Quietwood Creek
Subdivision in the amount of $60,000. Seconded by Ald. Salentine, motion carried.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED
BY LAW - Nothing new to report.
ENGINEERING/BUILDING INSPECTION DIRECTOR’S REPORT – None.
HIGHWAY SUPERINTENDENT’S REPORT - None.
