PUBLIC WORKS COMMITTEE MEETING - CITY OF MUSKEGO Approved/AMENDED
MINUTES OF MEETING HELD MONDAY, February 28, 2000
The meeting was called to order at 7:01 P.M. by Chairman Pionek. Committee
members Ald. Kathy Chiaverotti and Ald. Nancy Salentine (7:06) were present. Also
present were Public Works Supt. Wayne Delikat, Interim Director Building/Inspector Al
Biwer, and Sean McMullen (Ruekert Mielke). And those per the attached sheet.
The meeting was posted in accordance with the Open Meeting Law on February 24, 2000.
Review of Minutes of Meeting Held January 24, 2000 - Ald. Chiaverotti moved to
accept the minutes and have them placed on file. Seconded by Ald. Pionek. Carried
by all.
STATUS OF PROJECTS - The following items were reported on:
Police Firing Range - Sean reports that the money for the firing range from the FBI has not
yet been received.
Muskego Theater - R&M sent a letter to the property owner giving a March 15, 2000 date
for a schedule to be submitted to the City for the necessary grading and erosion repair work
to be completed. The owner sent a reply requesting an extension to that requested date.
R&M has denied that request and will move forward with the pulling of the Letter Of Credit
in order to secure the funds necessary for the City to complete the work.
Woods Road Reconstruction - Sean reports that an operational meeting will be held on

the 15 of March for this project. The entire project is going to be pushed back to next year
due to the lack of a response from the State Historical Preservation office in Madison with
regard to the 3 “historical” sites located in each of the 3 phases of the construction project.
New Library Project - At this time behind schedule due to the office furniture delivery
being delayed until around April 1.
Moorland Road South Extension - Meeting to be scheduled with R&M and City officials in
order to set the alignment of the roadway. Sean reiterated that this design is not the C4-A
design originally proposed.
Tess Corners Pond Expansion - Selection of the Consultants for the Janesville Road
project has been accomplished. Waukesha County has expressed an interest in cost-
sharing this endeavor.
UNFINISHED BUSINESS
Discuss Urban/Rural Drainage - Wayne reports that there have not been many projects
underway which is common for this time of year. Ald. Slocomb stated that on Durham Drive
the Public Works Department placed 52 feet of 15 inch storm sewer last summer in that
ditch. The residents who requested the work were very happy with the outcome of the
project but now have refused to pay for the work that was completed. The residents state

that this work benefits the City and not the residents and feel that the City should have to
pay for the improvements to the ditch. Ald. Salentine questioned if this bill was placed on
the residents Tax Bill and if not, why not and if so, was it paid? Wayne was unsure if the
amount owed was placed on the bill. Ald. Slocomb has invited the residents to attend the
next Public Works Committee Meeting to voice their position on this issue and has
indicated that they must also fill out the Action Request Form utilized by this Committee in
order to be placed on the agenda and acted upon. The Committee requests that City Clerk-
Treasurer Jean Marenda check to see if the bills were added to the residents recent Tax Bill
(Ald. Slocomb to provide name/address or Tax Key #). Sean reports that HUD has sent out
forms for municipalities to request disaster relief for stormwater funding. Sean will be
requesting grant money for Tess Corners Creek and possibly the Bass Bay Basin 3000
project. A maximum of $75,000 may be awarded by HUD to the City.
Status of Public Works Committee Procedures and Policies - The Committee had
nothing new to add to the current document.
Review Information on Downspout Run-off - At this time the City Attorney is reviewing
the current document. The Committee due to the Wiza property situation discussed at
length the correct wording regarding the discharge of water onto another adjoining property
regardless of ownership of the property (two Tax Keys held by one owner). Currently the
wording of Chapter 16.20 states simply that water may not be discharged onto adjacent
properties. Sean will discuss this particular area with the City Attorney.
Further Discussion of Bass Bay Basin 3000 - Ald. Pionek the Mayor and R&M met with
the 3 interested parties (Boehm, Ludwig and Towne Reality) regarding this project. At this
time all but Ludwig are strongly interested in this project but would like to see how this
basin would look as well as the costs associated with the construction of this basin. Carity
is not interested at this time due to their near completion of their subdivision project. Sean
indicated that a conservative cost for a preliminary sketch and cost estimates could run
from $3,000-$6,000. Ald. Salentine move to direct R&M to provide a preliminary
sketch and cost estimates for the construction of the basin not to exceed $6,000.

Further Discussion on Meeting With City of New Berlin on Drainage Issues - Sean
reports that a meeting will be taking place soon.
Status of Drainage Tile Concern Mudd Lake - City of Franklin - Nothing new to report.
Status of Drawdown - Little Muskego Lake - Wayne attempted to gather all of the
drawdown depth numbers available. There is no additional data available based on his
search. This item to be removed from subsequent agenda’s until August Public Works
Meeting. Sean reports that the LML dam crack monitor has shown an 11 millimeter wide
gap in the dam structure. Last month the gap was 4 millimeters wide. Structural work may
need to be done. Place on next month’s agenda.

Final Review of Draft Ordinance Regarding Requirements for Water Discharge -
Chapter 16.20 (Sump Pump) - This item was combined with the Residential Downspout
and Sump Pump run-off agenda item (Unfinished Business #3).
NEW BUSINESS
Review Request for Reimbursement - Stormwater Damage (Pierzchalski) - Clerk-
Treasurer Jean Marenda provided a recent correspondence from the individual requesting
reimbursement for past water damage to her property. Sean reports that the individual is
not yet prepared to come to this Committee, but will be at next month’s meeting. At this
time the individuals claims have not been submitted to the City’s insurance carrier. The
resident claims that during the construction of Plum Creek subdivision her property began
to have many water problems. At the time the resident did not and refused to have
installed a sump pump. A sump pump has been installed at no charge to the resident. And
to-date no further problems with water have occurred. The Mayor stated that this claim will
be filed with the City’s insurance carrier immediately. The resident will be coming into City
Hall to fill out the necessary “Committee Action Request Form” and is planning on
attending next month’s meeting.
Review Final Release Language/Maintenance/ Wiza Cad-Cam - The Mayor supplied a
copy of the language for the two parties involved in this particular settlement. This
language states that the City will not remove the artificially placed earthen dam and will
maintain the ditch. This document will fulfill the City’s portion of the settlement. However if
future storm sewer work is initiated by the City the agreement becomes null and void.
Subsequent discussion continued regarding the manner in which Mr. Wiza is discharging
his water. Ald. Chiaverotti moved to authorize Wayne Delikat to sign the
acknowledgment. Seconded by Ald. Pionek. Carried by all. The City’s execution of
the acknowledgment was recommended by legal counsel (Amended per 3/27/2000
PW Meeting). Ald. Pionek questioned the Mayor as to why the City has to sign this
document at all? The Mayor stated that this is not in the normal realm of the City’s
standard operating procedure but, this is being requested by Mr. Hunt and if it is not signed
by the City, he will not agree to the settlement between himself and Mr. Wiza.
Quietwood Creek - Grading and Storm Sewer Plans - Sean provided copies of the plans
for the Committee to review. He is requesting that the Committee grant preliminary
approval to the plans for the sanitary sewer and water main. This approval would be
contingent upon what the DNR and Army Corps of Engineers require for this property in
addition to the changes requested by the City. The time for the review for the plans by the
DNR and Army Corps of Engineers can run anywhere from 2 days to 6 months. But until
some type of approval is granted by this Committee, that potentially lengthy process cannot
begin. These plans do follow the new storm water management plan. Additionally, R&M
has requested Carity to map south of Woods Road to Bass’s Bay for floodplain data. Ald.
Chiaverotti moved to grant preliminary approval of the grading plans contingent
upon any revisions to the plan deemed necessary. Seconded by Ald. Salentine.

COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW -
None
DEPUTY BUILDING DIRECTOR'S REPORT - Tom Chiconas is working 3 hours per day.
New home starts have begun to come into his department. Last year his department
handled approximately 130 new homes and he expects about that many this year.
HIGHWAY SUPERINTENDENT'S REPORT - Specifications for the new truck for 2000
were written and the truck has been ordered with delivery expected in 6 months. The fuel
tanks have been filled in but may require bore samples. Tree trimming is now occurring.
ADJOURNMENT - Being no further business to discuss, Ald. Chiaverotti moved to
adjourn the meeting at 9:02 P.M. Ald. Salentine seconded. Carried by all.
